The Northampton Board of Health has inspected the premises at
5 Sherman Avenue, Northampton, MA (assessor's map 25A parcel 103 .),
for compliance with Chapter II of the State Sanitary Code.
This letter will certify that the inspections revealed violations listed below,
which are serious enough as to endanger or materially impair the
health, safety, and well-being of the occupants.
Under authority of Chapter III, Section 127 of the Massachusetts General
Laws, and Chapter II of the State Sanitary Code,you are hereby ordered to
make a good faith effort to correct the following violations
within SEVEN DAYS of the receipt of this order.

in an approved manner.

approved manner.

Dear Erica,
I removed the section of ceiling in your bathroom to inspect the plumbing.
Your room mate was there at the time and we spoke at length about the
insurance adjuster wanting to look at the area so that I could collect
damages for the ice and water problems. You were not there at the time. I
then went upstairs and covered over the area in the shower that we
believed caused the leak. I ran the water and it DID NOT leak downstairs. I
went back down stairs and spoke with Janet again. I asked her to let me
know if the leak started up again. Since Tom and Eileen were moving soon,
it made sense to wait until they were gone to tear out their bathroom. I
couldn't leave them with no shower.If I install a new ceiling in your
apartment, I may have to tear it out for the insurance inspector and then
just rebuild it again. The insurance Inspector told me that he came by
several times but found no one home. Your room mate agreed to wait until
the inspection was made and then I would close the ceiling one time This
would inconvenience us all a lot less, and avoid the possibility of the
insurance company making it difficult for me to collect anything. You and I
never spoke about this and I assumed that you and Janet did. If you had a
problem with the arrangement that Janet made, you should call me
yourself. I am home nearly every morning at 665-7577 and at the airport
all the other time. Its located right across the street from you, remember?
A simple phone call would have made this very easy. I received NO call
from you and NO written communication that you and your room mate had
anything other than the same perception of the problem NO ONE called to
tell me that the ceiling was leaking again. I would have taken care of it if
you had taken the time to let me know. The ceiling will be closed up by
this Friday. I expect you to pay the rent on time and to let me know if you
do not agree with your roommate on any agreements that we have made. I
will have the lawn mowed. Your rent remains the same. I do not want you
to mow the lawn. The rent has been late several times. Please take notice
that late rent payments will result in a demand to vacate.

According to the records at the Assessor's Office,you are the owner of the property of the above
address.
An inspection conducted by this department on 1/6/2014 has revealed violations with one or
more of the following laws. The Massachusetts General Laws, Chapter 111, Sections 122, 123,
124 and 125, Abatement of Nuisances; Northampton Code of Ordinances, Chapter 272, Solid
Waste; or Chapter II of the State Sanitary Code.
Listed below is a description of the violation(s):
Pursuant to complaint from a passerby a plain view inspection from Sherman Avenue
showed construction debris and bags of trash possibly including garbage piled
approximately 8'high against the side of Unit#7,a violation of the State Sanitary Code
(provides food and harborage for pests)
You are hereby ordered to correct the violations no later than 1/13/2014 . A re-inspection for
compliance with this order will be conducted at that time. IF THE VIOLATIONS ARE NOT
CORRECTED BY THIS DEADLINE DATE,YOU WILL BE SUBJECT TO RECEIVING A VIOLATION
TICKET WITH A FINE. The fine will not be less than $25.00 and not more than $300.00 per
violation, per day. Each day's failure not to comply with this ordinance or any other order shall
constitute a separate violation. If you have any questions, please feel free to call the Health
Department at (413) 587-1214.
