DECISION OF
NORTHAMPTON ZONING BOARD OF APPEALS
At a meeting held on February 15, 1989, the Zoning Board of
Appeals of the City of Northampton voted unanimously to GRANT
the Applications of the City of Northampton Department of
Public Works for Special Permits under Section 14, Page 14-
1, Section 11.1(16), Page 11 -4, and Section 11.3 , Page 11-
5, and for a Variance from the Provisions of Section 11.1(2)
to dredge approximately 10,000 cubic yards of silt from an
existing reservoir, establish a site off Sylvester Road to
store the material that is dredged, allow the transport of
said material, and to construct a public restroom and parking
lots, all in conjunction with a new city recreation area
located at the Lower Roberts Meadow Reservoir in Leeds.
Present and voting were Chairman Robert C. Buscher, Dr. Peter
Laband, and M. Sanford Weil, Jr.
For all three of the Special Permit Applications, the
Findings were as,follows:
All of the requested uses are listed in the Table of Use
Regulation or in other sections of the Zoning Ordinance.
Treating all three of the requested uses as being necessary
to achieve one end, the establishment of this recreational
facility, the Board finds that said facility does bear a
positive relationship to the public convenience and welfare
in that it offers a needed facility that the public will
enjoy.
There will be no undue traffic congestion so long as the plan
for off - street parking is adhered to.
p There will be no overload of any municipal systems.

There will be no impairment of the character or integrity of
the zone. This location has been a "swimming hole" for
n longer than most people can remember.
As to the Variance, the Findings are as follows:
The Variance is requested for a specific parcel of land.
The soil conditions and topography of the reservoir are
unique in this district.

The Northampton Zoning Board of Appeals met at 10:05 p. m. on
Wednesday, February 15, 1989 in Council Chambers, Wallace J.
Puchalski Municipal Building, to continue the Public Hearing on the
several applications of the City of Northampton Department of
Public Works relative to constructing a swimming and recreation
facility at the Lower Roberts Meadow Reservoir in Leeds. In
addition to the original application, also before the Board tonight
is a new application for a Variance from the Provisions of Section
11.1(2) which prohibits the removal of any earth materials from
land within the Watershed Protection District. Applicant is now
requesting permission to remove some 10,000 cubic yards of silt
from the reservoir to create the swimming area. Present were
Chairman Robert C. Buscher, Dr. Peter Laband, and M. Sanford Weil,
Jr.
Ch. Buscher opened the Public Hearing by reading the Application
for a Variance, the legal Notice as published twice in the Daily
Hampshire Gazette, and a memorandum from the Northampton Planning
Board stating they unanimously support the granting of the
Variance. He also reviewed the original application.
The Department of Public Works was represented by its Assistant
Director, Peter McNulty, who opened the meeting by presenting the
Board with a site plan of the locus where the dredged silt will be
deposited, a site off Sylvester Road about one mile from the
dredging site.
Coun. Brooks rose to oppose the entire project "for the express
purpose of avoiding an accident. I went through the entire budget,
and there's no money to man the facility. The city can be sued if
someone's hurt because of no lifeguards. If there's no facility,
we can't be sued."
There followed a general discussion of liabilities, approving the
applications with a condition requiring funding, and approving with
the condition the lower reservoir be kept empty until funding was
in place. Coun. LaBarge voiced his support for the project,
assured the Board that the City Council would fund the proper
manning of the facility, and said that at the end of the swimming
season "this must be drained. That's written into the Wetlands
Permit, for flood storage and ease of maintenance."
Mr. Weil then reviewed all the requests before the Board. 1) A
Variance to dredge, 2) A Special Permit to transport it, 3) a
Special Permit to store the fill at the Sylvester Road site, and
4) A Special Permit to construct a public restroom at the
facility.Dr. Laband moved the Public Hearing be closed. Mr. Weil
seconded, and the motion passed unanimously.
Dr. Laband, looking to the Section 10.10 criteria for granting
Special Permits, found, for all three of the Permit applications,

that the requested uses are listed in the Table of Use Regulation,
the uses do bear a positive relationship to the public convenience
in that it offers a needed facility that the public will enjoy,
there will be no undue traffic congestion as long as the plan calls
for off - street parking, no overload of any municipal systems, and
no impairment of the character or integrity of the district. Dr.
Laband said he found conjointly that all criteria had been met and
moved the Special Permits be granted Mr. Weil seconded. Ch.
Buscher said he too concurred, and commented on the public safety
issue, "Any recreational facility not carefully monitored, can
create safety and liability problems. I'm sure the City will
operate this in a responsible manner." The Motion passed
unanimously.
As to the Variance, Dr. Laband looked to Section 10 of Chapter 40A,
the variance - granting criteria, and found 1) The Variance is
requested for a specific parcel of land. 2) The soil conditions
and topography of the reservoir are unique in the district. 3)

The Zoning Board of Appeals of the City of Northampton met at 7 :30
p. m. on Wednesday, February 1, 1989 in Council Chambers, Wallace
J. Puchalski Municipal Building, to continue the Public Hearing on
the several applications of the City of Northampton Department of
Public Works relative to their proposed recreation area at Lower
Roberts Meadow Reservoir in Leeds. Present were Chairman Robert
C. Buscher, Dr. Peter Laband and M. Sanford Weil, Jr.
Ch. Buscher opened the Hearing by reading a letter dated February
1, 1989 from Paul O. Hadsel, Director of the DPW, requesting that
the Public Hearing be continued to February 15, 1989, since the
DPW, at the Board's request, filed a new Application on January
24th seeking a Variance to allow dredging and removal of earth
material from within the Watershed Protection District, and it
needed review by the Planning Board. With the continuance, all the
issues could be heard together on February 15th.
Mr. Weil moved to continue the Public Hearing to February 15, 1989.
Dr. Laband seconded, and the motion passed unanimously.

Wednesday, January 4, 1989 in Council Chambers, Wallace J.
Puchalski Municipal Building, to conduct a Public Hearing on the
Application of the City of Northampton Department of Public Works
for Special Permits under the Provisions of Sections 14, 11.1(16)
and 11.3 of the Northampton Zoning Ordinance, all for the purpose
of dredging approximately 10,000 cubic yards of silt from Lower
Roberts Meadow Reservoir to create a public beach, with a swimming
area, and to construct a public restroom and parking lots within
a new city recreation area. Present and voting were Chairman
Robert C. Buscher, Dr. Peter Laband, and M. Sanford Weil, Jr.
Ch. Buscher opened the meeting by reading the Application, the
Legal Notice as published twice in the Daily Hampshire Gazette, and

Road. He related how the City applied for grant money in 1983,
1985 and 1986 for the project. The project went out to bid, and
at the bid opening in late June, 1987, only one bidder presented
a proposal, which was over - budget, and the bid was rejected by the
DPW. In September, 1988, the DPW rebid the project after getting
an Urban Self -Help grant from the Land Water Conservation Fund. R.
A. C. Builders, Inc. of Chicopee, MA were awarded the contract in
October, 1988. In December, R. A. C. applied for Building Permits,
which the Building Inspector refused to issue because Zoning Board
approvals were required.
Mr. McNulty went into some reasons why the Special Permit
applications had not been made in a more timely fashion. He
' pointed out that some 10,000 cy of silt would be dredged from the
reservoir and taken to an old gravel bank owned by the City off
Chesterfield Road, where it would be stored until needed for sundry
DPW projects. He said some site work has already been done, with
utilities trenched but not connected, and the foundation for the
restroom in place.
The Chair asked for proponents, and only one person, Coun. LaBarge,
responded, announcing, "I support this request 100 %!"
When the Chair called for opponents, Dr. Morris B. Liebowitz, a
resident of Fairway Village, objected on several counts. He
stated, "This project has been in planning for five years - -I can't

believe they have gone forward without permits. The locus is only
a half -mile from the center of Leeds. There'll be 55 parking
spaces. Bringing more people to this location needs to be
discussed. People will do more littering on Chesterfield Road than
they do now. The last residence in Leeds is only a quarter to a
half mile from here. This will change the character of the
neighborhood irrevocably. And how about wildlife and septic
runoff? I'd like to object on all those grounds."
Coun. Brooks, citing the "Health and Safety" concerns from Section
14.1, said he was , concerned about when the city or state can /t
provide the $42,000 a year for lifeguards, supervisors and
conservation workers. The city can't afford this. Ellerbrook
thought the city could do this for $17,000. It's OK to build, but
the first day there can be no lifeguards, the pool must be drained
completely. Make sure of this!" Dr. Liebowitz's response was, "I
don't want a mudflat. I'd rather stop the project now." Mr.
Brooks' response was, "I'd rather have an unsightly scar than the
liability."
Dr. Laband asked Mr. McNulty about staffing, and was told that Mr.
Ellerbrook "is drawing up a plan to staff and maintain the place,
and that plan must be approved by the urban self -help agency before
we can open."
Coun. LaBarge stated that Sen. Olver and the UMass Physical
Education people "will come up with a plan. I support this 1000.
There was no swimming allowed at Cooke's Dam, but there were still
two serious accidents. If the kids come here, we reduce the risk
of accidents at dangerous swimming holes. It will be resolved by
the time the project's ready."
Mr. Brooks countered with, "Look at the UMass budget cuts. If
they're laying off professors, how are they going to supply
lifeguards? If we can't get money from the state for the landfill,
how will we get it for a swimming pool ?"
Ch. Buscher asked Mr. McNulty about utilities, and was told that
the city sanitary sewer and water lines would be extended to the
site prior to its opening. He added, in reference to Dr.
Liebowitz' comments, that several public meetings were held "with
the Leeds neighbors."
Ch. Buscher added that the Planning Board was very concerned about
parking at the edge of the road, and the number of people that
would be allowed to use the facility at any one time. Mr. McNulty
replied, "We had to design in the parallel parking off Reservoir
Road - -it's not on the travelled way. If the filtration plant is
not built across the road, that space could be used for additional
parking."

Mr. Weil and Mr. McNulty entered into a colloquy about what agency
was responsible for public safety and funding for the lifeguards.
Mr. McNulty said he didn't know, but thought it was the City
Council. Mr. Weil retorted, "Liability is a serious issue. Should
we hold this in abeyance ?" Mr. McNulty replied, "If the Council
has funded the construction, I assume they will fund the
lifeguards." Mr. LaBarge injected, "The Funding agency must have
a plan for this, or else drain it if it's unmanned."
Dr. Laband opined, "This facility is a plus for the city. If the
Council has gone this far, are we to believe they will 'POOP Out'?"
Ch. Buscher ended that discussion by stating, "They are here for
Special Permits to do a physical job We must see that the
requirements are met. The liabilities exist now as a reservoir."
He then read from the Zoning Ordinance, specifically Section
11.1(2 ) which specifically prohibits the removal of soil, etc. from
land in any district which falls within the Watershed Protection
District, and said, "They need a Variance. Can we not vote
tonight? This is confusing and technical, and I think we need
Kathleen Fallon's opinion."
Dr. Laband said that section was "unequivocal," and agreed that a
Variance was necessary. Mr. McNulty protested that he had sat with
the Building Inspector to be sure they applied for all the proper
permits, but Ch. Buscher stated, "Let's get all the chips on the
table and make sure everything's done right."
Dr. Laband moved for a continuance of the Public Hearing until
February 1. Mr. Weil seconded, and the motion passed unanimously.

Re: Roberts Reservoir Recreation Facility
Dear Bob:
The Zoning Board has requested an opinion as to the types of
zoning relief that the Department of Public Works needs for the
above project. My understanding is that the project consists of
the following: the construction of a bathhouse with sanitary
facilities and a parking lot; the dredging of the reservoir
itself - to create a swimming area; the removal of the material
dredged from the reservoir to another city owned site. The area
is located within a Rural Residential zone and a Watershed
Protection District.
The use itself, a municipal facility, is allowed in the RR zone.
However, since the area is within a Watershed Protection
District, any structure built within said district requires a
special permit from the board of appeals under Section 14.3 (1)
of the zoning district. Please note that Section 14.4 requires
copies of the application for the special permit to be sent to
the Building Inspector, the Board of Health, the Conservation
Commission, and the Planning Board upon filing. Section 14.7
states that the Board of Appeals cannot take final action on any
such special permit until it has received a report on the
proposed construction from the above parties or thirty days has
elapsed from the date of submission of the application, whichever
is sooner. Failure to transmit the application to any of the
named parties and /or premature action by the Board of Appeals
will be a fatal procedural flaw if the Board's decision is
challenged in court.
Next, Section 11.1(2) prohibits the removal of soil, etc. from
land within a Watershed Protection District. Therefore, the
dredging of the reservoir would require a variance from said
Section 11.1(2) Apparently there was, at some time, discussion
with the Department of Public Works as to whether the dredging
might be exempted from the variance requirement under Section
11.1(16)(b). The reasoning used was that the swimming area was
an "appurtenance" under that section and, since the recreation
area is allowed by right in an RR district, the dredging should
be exempt from Section 11.1(2). I do not really believe that a
swimming area was the type of construction contemplated as being
an "appurtenance ". The qualification in this paragraph that soil
may be removed "below finished grade" makes the interpretation of
a swimming area as an "appurtenance" rather strained. What is to
be considered the "finished grade" of a swimming area?
Finally, the material removed during the dredging is to be placed
on other city property. This filling operation will require a
special permit under Section 11.3 of the Zoning ordinance.
In summary, the Department of Public Works requires:
1. a special permit under Section 14.3(1) for the
bathhouse;
2. a variance from Section 11.1(2) for the dredging;
3. a special permit under Section 11.3 for the placing of
the dredged material on other city property.

improvement will be very expensive. There will be blasting and a
terrific impact on the neighborhood. He can't afford to do the
road and neither can the city."
Mr. Miranda read a memo from Kathleen Fallon indicating that a
height Variance and a use Variance for the maintenance building
have been granted. Mr. Andrikidis asked that the City Solicitor
be queried as to 'what this application means.' He said, "All
criteria of the Site Review Plan should be strictly adhered to."
Mr. Crystal stated, "I move we turn down everything we can turn
down - -the original application that we didn't act on back on
September 22 for the scale house and batching plant, because both
uses would increase traffic on Turkey Hill Road and make it more
detrimental to the neighborhood. In addition, I propose we reject
the sign variance because he has shown no hardship. I move we
reject the Site Plan because it is incomplete - -it's not stamped,
and because it has not been shown that the increased traffic will
not be more detrimental. It does not meet the criteria of the Site
Plan Review ordinance." Mr. Gare seconded. Ch. Duseau commented
that "he hasn't checked the Special Permit box." Mr. Crystal
asked, "How can they be asking for Site Plan Review for buildings
that we don't have a Special Permit for ?" Mr. Gare called the
motion which passed 6 -1 ( Duseau). Alfreda Robinson of 6 Sylvester
Road rose and questioned the existence of a Special Permit to run
a quarry bank. She stated, "The permit has never been renewed.';

At 9:50, the Application of the City of Northampton DPW to dredge
at the Lower Roberts Meadow Reservoir came up for review. Mr.
Gare moved that we recommend approval of their request. Mr.
Crystal secon ded, and the motion passed unanimo
The Appeal of Thomas Hanley of the Building Inspector's refusal to
issue a Building Permit for a lot on Park Hill Road was the next
matter for review. Atty. Roger Lynch, representing Mr. Hanley (who
was also present) appeared. Mr. Smith reviewed the history of the
matter, pointing out that the denial of the permit was based
essentially on the fact that the road where the lot has its
frontage is not adequate by the definition of the ordinance. Mr.
Lynch said that his client has agreed to "fix the road to DPW
standards. We built the road before the plans were complete. We
will do the road to DPW standards, and ask that you issue a
Building Permit to be in effect as soon as the engineering plan is
approved." Mr. SMith countered that, "These are not legal lots.
The Zoning changed to 80,000 square feet because there is no city
water and sewer to them." Mr. Lynch said that it is unfair to
change the zoning while the matter is in litigation. He said,
"We're at issue that the original lots deeded out weren't legal."

The next case involved the Application of the City of Northampton
Department of Public Works for Special Permits under the
Provisions of Sections 11 and 14 to allow the dredging of some
10,000 cubic yards of silt from the Lower Roberts Meadow
Reservoir to create a public beach, and to construct parking lots
and a restroom within the Watershed Protection District. - -Mr.
Greg Nichol of Huntley Associates explained the project, which

would include 39 parking spaces in two lots, and 16 more at the
edge of Reservoir Road. When it became clear that the work for
which permission was being sought was well underway, Ch. Duseau
asked Mr. Nichol, "Why are you here now ?" He replied, "The
Building Inspector would not issue a Building Permit until 44e got
a Special Permit." Mr. Smith pointed out that the DPW was
informed a long time ago that they needed Special Permits. Paul
O. Hadsel, Director of the DPW, said, "We have Conservation
Commission approval, we have the funding, we are just tfying to
tie up the loose ends. There is a time constraint on the grant."
Mr. Nichol added, "If we can't dredge now we can't dredge until
next July or August."
Mr. Smith pointed out, "Basically, we're looking at a structure
in the flood plain, and a site plan review." Mr. Crystal said he
had a major concern with traffic and parking. Mr. Holeva, upset
at the tardiness of the Applicant in coming before the Board,
said, "I move we postpone this." Dr. Arnould seconded. Mr.
Nichol protested, "A contract has been awarded -- construction has
begun. If you shut this down, it will cost the city more money."
Mr. Crystal added, "It's unfortunate we didn't see this before,
but it's going to happen. There are weather constraints and
funding constraints, but it would be a mistake to postpone it."
Dr. Arnould asked Mr. Crystal what he proposed. Mr. Crystal
asked it we could restrict cars from parking along Reservoir
Road. Mr. Hadsel asked that the Board act tonight adding as
many conditions as they wanted. Dr. Beauregard stated, "I resent
being made a 'rubber - stamper.' I see there's no alternative- -
it's already done." The vote on Mr. Holeva's motion to postpone
was three in favor, four opposed ( Duseau, Mendelson, Beauregard
and Crystal). Dr. Beauregard then moved that the Board recommend
approval to the ZBA, with serious reservations on parking on
Reservoir Road, and a limit on the number of people who could use
the area at any one time. Mr. Crystal seconded. The motion
passed 4 -3 (Holeva, Arnould and Hale).

Findings
The Conservation Commission has reviewed the above - referenced Notice of
Intent and plans and has held a public hearing on the project. Based on the information available to the

the area on which the proposed work is to be done is significant to the following interests in accordance with
the Presumptions of Significance set forth in the regulations for each Area Subject to Protection Under the
Act (check as appropriate):

Therefore, the Commission hereby finds that the following conditions are
necessary, in accordance with the Performance Standards set forth in the regulations, to protect those inter-
ests checked above. The Cnmmi ; a i nn orders that all work shall be performed
in accordance with said conditions and with the Notice of Intent referenced above. To the extent that the fol-
lowing conditions modify or differ from the plans, specifications or other proposals submitted with the Notice
of Intent, the conditions shall control.
General Conditions
1. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory meas-
ures, shall be deemed cause to revoke or modify this Order.
2. This Order does not grant any property rights or any exclusive privileges; it does not authorize any injury
to private property or invasion of private rights.
3. This Order does not relieve the permittee or any other person of the necessity of complying with all
other applicable federal, state or local statutes, ordinances, by -laws or regulations.
4. The work authorized hereunder shall be completed within three years from the date of this Order unless
either of the following apply:
(a) the work is a maintenance dredging project as provided for in the Act; or
(b) the time for completion has been extended to a specified date more than three years, but less than
five years, from the date of issuance and both that date and the special circumstances warranting
the extended time period are set forth in this Order.
5. This Order may be extended by the issuing authority for one or more periods of up to three years each
upon application to the issuing authority at least 30 days prior to the expiration date of the Order.
6. Any fill used in connection with this project shall be clean fill, containing no trash, refuse, rubbish or de- : z
- bris, including but not limited to lumber, bricks, plaster, wire, lath, paper, cardboard, pipe, tires, ashes,
refrigerators, motor vehicles or parts of any of the foregoing.
7. No work shall be undertaken until all administrative appeal periods from this Order have elapsed or, if
such an appeal has been filed, until all proceedings before the Department have been completed.
8. No work shall be undertaken until the Final Order has been recorded in the Registry of Deeds or the Land
Court for the district in which the land is located, within the chain of title of the affected property. In the
case of recorded land, the Final Order shall also be noted in the Registry's Grantor Index under the name
of the owner of the land upon which the proposed work is to be done. In the case of registered land, the
Final Order shall also be noted on the Land Court Certificate of Title of the owner of the land upon which
the proposed work is to be done. The recording information shall be submitted to the Commission
on the form at the end of this Order prior to commencement of the work.
9. A sign shall be displayed at the site not less than two square feet or more than three square feet in size
bearing the words, "Massachusetts Department of Environmental Quality Engineering,
File Number 246 -169
10. Where the Department of Environmental Quality Engineering is requested to make a determination and
to issue a Superseding Order, the Conservation Commission shall be a party to all proceedings
and hearings before the Department.

§ 330.4 Public notice.
(a) Chief of Engineers. Upon proposed
issuance of new nationwide permits,
modification to, or reissuance of,
existing nationwide permits, the Chief of
Engineers will publish a notice in the
Federal Register seeking public
comments and including the opportunity
for a public hearing. This notice will
state the availability of information at
the Office of the Chief of Engineers and
at all district offices which reveals the
Corps' provisional determination that
the proposed activities comply with the
s requirements for issuance under general

(b) District engineers. Concurrent
with publication in the Federal Register

§ 330.5 Nationwide permits.
(a) Authorized activities. The
following activities are hereby permitted
provided they meet the conditions listed

(1) The placement of aids to
navigation and regulatory markers
which are approved by and installed in
accordance with the requirements of the
U.S. Coast Guard (33 CFR Part 66,

United States has been previously

recording devices, water quality testing
and improvement devices, and similar
scientific structures. (Section 10)
(6) Survey activities including core
sampling, seismic exploratory
operations, and plugging of seismic shot
holes and other exploratory-type bore
holes. Drilling of exploration -type bore
holes for oil and gas exploration is not
authorized by this nationwide permit;
the plugging of such holes is authorized.

(7) Outfall structures and associated
intake structures where the effluent from
that outfall has been permitted under
the National Pollutant Discharge
Elimination System program (Section
402 of the Clean Water Act) (see 40 CFR
Part 122) provided that the district or
division engineer makes a determination
that the individual and cumulative
adverse environmental effects of the
structure itself are minimal in
accordance with § 330.7 (c)(2) and (d).
Intake structures per se are not
included —only those directly associated
with an outfall structure are covered by
this nationwide permit. This permit
includes minor excavation, filling and
other work associated with installation
of the intake and outfall structures.

(8) Structures for the exploration,
production, and transportation of oil,
gas, and minerals on the outer
continental shelf within areas leased for
such purposes by the Department of
Interior, Mineral Management Service,
provided those structures are not placed
within the limits of any designated
shipping safety fairway or traffic
separation scheme (where such limits
have not been designated or where
changes are anticipated. district
engineers will consider recommending
the discretionary authority provided by
330.8 of this Part, and further subject to
the provisions of the fairway regulations
in 33 CFR 322.5(1) (Section 10).
(9) Structures placed within anchorage
or fleeting areas to facilitate moorage of
vessels where such areas have been
established for that purpose by the U.S.
Coast Guard. (Section 10)
(10) Non - commercial, sin -boat,
mooring buoys. (Section 10)
(11) Temporary buoys and markers
placed for recreational use such as
water skiing and boat racing provided
that the buoy or marker is removed
within 30 days after its use has been
discontinued. At Corps of Engineers
reservoirs, the reservoir manager must
approve each buoy or marker
individually. (Section 10)
(12) Discharge of material for backfill
or bedding for utility lines, including
outfall and intake structures, provided
there is no change in preconstruction
bottom contours (excess material must
be removed to an upland disposal area).
A "utility line" is defined as any pipe or
pipeline for the transportation of any
gaseous, liquid, liquifiable, or slurry
substance, for any purpose, and any
cable, line, or wire for the transmission
for any purpose of electrical energy,
telephone and telegraph messages, and
radio and television communication.
(The utility line and outfall and intake
structures will require a Section 10
permit if in navigable waters of the
United States. See 33 CFR Part 322. See
also paragraph (a)(7) of this section).
(Section 404)
(13) Bank stabilization activities
provided:
(i) The bank stabilization activity is
less than 500 feet in length;
(ii) The activity is necessary for
erosion prevention;
(iii) The activity is limited to less than
an average of one cubic yard per
running foot placed along the bank
within waters of the United States:
(iv) No material is placed in excess of
the minimum needed for erosion
protection;
(v) No material is placed in any
wetland area;
(vi) No material is placed in any
location or in any manner so as to
impair surface water flow into or out of
any wetland area;
(vii) Only clean material free of waste
metal products, organic materials,
unsightly debris, etc. is used; and
(viii) The activity is a single and

13, 1985 as conforming with Condition #18 of Permit 4246 -101, with the following

in accordance with said conditions and with the Notice of Intent referenced above. To the extent that the fol-
lowing conditions modify or differ from the plans, specifications or other proposals submitted with the Notice
of Intent, the conditions shall control.
General Conditions
1. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory meas-
ures, shall be deemed cause to revoke or modify this Order.
2. This Order does not grant any property rights or any exclusive privileges; it does not authorize any injury
to private property or invasion of private rights.
3. This Order does not relieve the permittee or any other person of the necessity of complying with ad
other applicable federal, state or local statutes, ordinances, by -laws or regulations.
4. The work authorized hereunder shall be completed within three years from the date of this Order unless
either of the following apply:
(a) the work is a maintenance dredging project as provided for in the Act; or
(b) the time for completion has been extended to a specified date more than three years, but less than
five years, from the date of issuance and both that date and the special circumstances warranting
the extended time period are set forth in this Order.
5. This Order may be extended by the issuing authority for one or more periods of up to three years each
upon application to the issuing authority at least 30 days prior to the expiration date of the Order.
6. Any fill used in connection with this project shall be clean fill, containing no trash, refuse, rubbish or de-
bris, including but not limited to lumber, bricks, plaster, wire, lath, paper, cardboard, pipe, tires, ashes,
refrigerators, motor vdhicles or parts of any of the foregoing.
7. No work shall be undertaken until all administrative appeal periods from this Order have elapsed or, if
such an appeal has been filed, until all proceedings before the Department have been completed.
8. No work shall be undertaken until the Final Order has been recorded in the Registry of Deeds or the Land
Court for the district in which the land is located, within the chain of title of the affected property. In the
case of recorded land, the Final Order shall also be noted in the Registry's Grantor Index under the name
of the owner of the land upon which the proposed work is to be done. In the case of registered land, the
Final Order shall also be noted on the Land Court Certificate of Title of the owner of the land upon which
the proposed work is to be done. The recording information shad be submitted to the r,,,,,.,,; c c; nzL

9. A sign shall be displayed at the site not less than two square feet or more than three square feet in size

Preconstruction Conference
Dear Commissioners:
This letter is in response to the discussion which occurred at the
preconstruction conference for the Leeds Reservoir project. Attending the
meeting were representatives of Almer Huntley Jr. & Associates, Inc., State
Department of Environmental Management, Warner Bros. Construction, City of
Northampton, Department of Public Works and City of Northampton Conserva-
tion Commission representative Larry Smith.
At the meeting, Mr. Smith was given the "Erosion, Siltration, and
Sedimentation Control Plan" from Warner Bros. Construction, as required
under Article 18 of the Order of Conditions.
Addressed at the meeting by Mr. Smith were the questions of approved
disposal areas, as required under Article 19, dredging of any silt material
from the lower reservoir as a result of the proposed work (Article 24), and
the question of work not being done in the reservoir under high flow condi-
tions (Article 25).
On December 19, 1984, the Board of Public Works, at their regular
meeting, voted unanimously to store excavated materials which are to be
taken from the Roberts Meadow Middle Reservoir at the existing gravel bank
off of Sylvester Road, and the existing storage area on City owned land off
of Florence Street.
Regarding the dredging of the Lower Reservoir, (Article 24), it is
anticipated that within the next year the "Roberts Meadow Recreation Area
Project" in the Lower Reservoir will be completed. Dredging of the Lower
Reservoir will be performed in conjunction with this project, thus removing
any material which may find its way from the Middle Reservoir to the Lower
Reservoir as a result of the present project.
The question was raised as to the high and low flow condition which
exists in the Roberts Meadow watershed, and the intent of the wording of
Article 25. The hydrology of the watershed is one of extreme fluctuation.
Historically, the seasonal flow variations in the Roberts Meadow Brook and
its watershed are negligible. The watershed's hydrology is primarily a
function of surface runoff due to rainfall. The response time in periods

of high precipitation is exhibited with the quickness with which the
reservoir fills. This is due to the steepness of the watershed. The
contractors dredging operations will be shutdown and removed from the
confines of the reservoir under periods when these conditions exist. We
therefore request that Article 25 be interpreted in a way not to limit the
contractor to work during or excluding any particular months of the year
since historically, the high flow conditions have and can occur at almost
any time.

ROBERTS MEADOW MIDDLE RESERVOIR
EROSION CONTROL PLAN
In general our plan for erosion control is to utilize standard methods
such as hay bales and silt barriers in those areas of the project
subject to erosion and siltation.
One such area is the reservoir basin, in which we will be removing
earth, crossing streams, and disturbing existing vegetation.
Equipment used during the earth removal operation will be inspected
daily for oil leaks, and faulty equipment will be repaired or
removed. No fuel or lubricants will be stored at the site
Where it is necessary to cross a stream, culvert will be installed
and upstream and downstream slopes will be covered with rock to
prevent erosion. Where necessary, silt barriers will be constructed
to control siltation from the excavated areas. Excavated areas in
the reservoir basin will not be seeded because of later flooding.
However, areas above Elevation 400 that are disturbed will be loamed
and seeded as per specifications.
At the dam site the area most subject to erosion will be the new
spillway. To prevent sediment from this area from reaching the brook,
a barrier of hay bales will be placed at the foot of slopes.
Topsoil will be removed and replaced as the excavation progresses
so that no more than one acre will be exposed to erosion during
construction. Seeding will follow immediately, the seed being
that specified in the job specifications.
To gain access to the spillway area, we will build a bridge rather
than install culverts in order to lessen the chance of siltation
and maintain sufficient waterway area in the event of a heavy runoff.
A sketch of our erosion control methods in this area is attached along
which a sheet showing typical siltation control devices which we will
use to prevent siltation and sedimentation throughout the project.
Our methods and efforts will not be limited to this plan. We
will adapt or install whatever is required as the job progresses in
accordance with the procedure outlined here.

Dear Commissioners:
We are requesting the following for the referenced project:
1. Time extension for one year from March 15, 1985, for the project work. The
project will be advertised for bidding on November 20, 1984; Bid opening on
December 11, 1984; Contract award 45 to 60 days later. Construction period
allowed in the Contract is 365 days.
2. Installation of a 48” sluice gate to take the place of the 30" opening and
gate valve for draining the reservoir. The sluice gate will provide a
better means of draw -down of the pond when maintenance is required. The
present value is approximately 50 years old and is difficult to open and
close. It will allow the 36" drain to reach its designed capacity.
3. If funds allow, the City would like to dredge the additional area shown on
the plans as "Area B ". We estimate that 26,000 c.y. will be removed from
Area B.
Due to additional topography of the areas to be dredged, the estimate for
"Area A" has been revised to approximately 31,000 c.y. The total dredging
estimate is now 57,000 c.y., only 2000 c.y. more than the original estimate
of 50,000 c.y.
4. The retaining wall downstream of the dam is undetermined. We wish to use
surplus dam blocks to protect the base of the wall and to grout under the
wall to fill the void. If this work is not done, the retaining wall is in
danger of collapse.

The Commission hereby orders that the following conditions are
necessary to protect said interests and all work shall be performed in strict accordance
with them and with the Notice of Intent and plans Identified above except where such
plans are modified by said conditions.

CONDITIONS
1. Failure to comply with all conditions statld herein, and with all related statutes
and other regulatory measures, shall be deemed cause to revoke or modify this order.
2. This order does not grant any property rights or any exclusive privileges; it does
not authorize any injury to private property or invasion of private rights.
3. This order does not relieve the permittee or any other person of the necessity of
complying with all other applicable federal, state or local statutes, ordinances,
by -lawa and /or regulations.
4. The work authorized hereunder shall be completed within one (1) year from the date
of this order unless it is for a maintenance dredging project subject to Section
5(9). '!'h" order may be extended by the issuing authority for one or more additional
one -year periocr per application to the said issuing authority at least thirty (30!
days prior to the expiration date of the order ex its extension.

5. Any fill used in connection with this project shall be clean fill, containing no
trash, refuse, rubbish or debris,_ including. without limiting the generality of the
foregoing, lumber. bricks, plaster, wire, lath, paper. cardboard. pipe, tires. ashes.
refrigerators. motor vehicles or parts of any of the foregoing.
6. No work may be commenced until all appeal periods have elapsed from the order of the
Conservation Commission or from a final order by the Department of Environmental
Quality Engineering.
7. No work shall be undertaken until the final order. with respect to the proposed
project. has been recorded in the Registry of Deeds for the district in which the
land is located within the chain of title of the affected property. The Document
member indicating such recording shall be submitted on the form at the end of this
order to the issuer of this order prior to commencement of work.
Further, if the Order of Conditions is not recorded within 7 days
after the end of the ten day appeal period, the Conservation
Commission will impose a twenty- five dollar ($ 25.00 ) service
charge for recording by an agent of the Commission....

three square feet bearing the words, "Massachusetts Department of Environmental

9. Inhere the Department of Environmental Quality Engineering is requested to make a
determination and to issue a superseding order, the Conservation Commission shall
be a party to all agency proceedings and hearings before the Department.
10. Upon completion of the work described herein, the applicant shall forthwith request,
in writing, that a Certificate of Compliance be issued stating that the work has
been satisfactorily completed.
11. The work shall conform to the following described plans and, additional conditions:

18. Prior to any construction or dredging operations the Applicant shall submit an
Erosion, Siltation & Sedimentation Control Plan,showing how the Applicant will
prevent, minimize and /or control any erosion, siltation and sedimentation caused
by the project, to the Conservation Commission. Said Plan must be approved by the
Commission before any work may commence.
19. Prior to any dredging the Applicant, or its Contractor, shall notify the Commission,
in writing, where materials excavated will be stored and disposed of,
20. The non - riprapped portion of the 330 foot long X 70 -100 foot wide channel over which
water will flow from the Emergency Spillway shall be planted with a vegetative cover
material (and maintained) which must be specifically approved by the U.S Soil
Conservation Service, sufficient to prevent erosion when in use.
21. A minimum flow of water, equal to 95% of the average low flows of the streams durin}
July /August or, if greater, a flow acceptable to the Massachusetts Division of Fisher
and Wildlife, must pass over, around or through the dam during all phases of the
project.
22. The flashboards in the spillway shall be so designed that they will callapse (be re-
leased) when the water passing over them reaches a height of 405.0 feet in elevation.
23. All trees along access roads, including that required for dredging, shall be protected
from damage. After the construction and dredging operations have been completed a l
damaged trees shall be replaced and the area(s) shall be restored to their original
conditions.
24. Any silt, sediment and /or eroded materials deposited in the lower reservoir below
the dam as a result of this project must be removed from said reservoir upon com-
pletion.of the project.
25. Phases of the project which could cause turbidity in t1-e water's flows shall take
place when the streams are at their lowest flows and, during times of the
year so as not to interfere with the spawning habits of downstream fisheries.

The applicant, any person aggrieved by this order, any owner of land abutting
the land upon Which the proposed work is to be done, or any ten residents of the
city or town in which such land is located, are hereby notified of their right to

(10) days from the issuance of this order.

has requested a Corps of Engineers permit under:
( ) Section 10 of the River and Harbor Act of 1899.
(X) Section 404 of the Clean Water Act.
( ) Section 103 of the Marine Protection, Research and Sanctuaries
Act of 1972.
to: Place fill in the Roberts Meadow Reservoir in Northampton, Massachusetts
in conjunction with the repair and restoration of the dam and reservoir. The
work involves constructing an emergency spillway and exit channel. Excavation
material from the channel construction will be used as embankment material along
the downstream face of the dam for stability and to prevent freezing. Existing
debris will be removed from the downstream raceway. The downstream raceway will
require filling with a gravel base and granite blocks to reduce erosion effects
on the toe of the dam. A concrete training wall will be erected on the north
side of the down stream raceway to prevent erosion of the bank. A temporary
access road will be required to facilitate this construction.

The total amount of material to be placed below ordinary high water
will be:
- 120 cubic yards of granite blocks
- 25 cubic yards of sand bags
- 35 cubic yards of riprap
- 80 cubic yards of bank -run gravel
- 75 cubic yards of common borrow backfill
- 25 cubic yards of concrete
In addition, approximately 50,000 cubic yards of material will be dredged
from within the basin area of the reservoir and disposed of in upland areas.
This area was previously used as a water supply system for the City of
Northampton and the proposed work is intended to refurbish the reservoir and
dam.

The decision whether to issue a permit will be besed on an evaluation of the probable impact of the proposed activity on
the public interest. That decision will reflect the national concern for both protection and utilization of important
resources. The benefit which reasonably may be expected to accrue from the proposal must be balanced against its
reasonably foreseeable detriments. All factors which may be relevant to the proposal will be considered including the
cumulative effects thereof; among those are conservation, economics, aesthetics, general environmental concerns,
wetlands, cultural values, fish and wildlife values, flood hazards, flood plain values, land use, navigation, shoreline
erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food production
and, in general, the needs and welfare of the people.
Where the activity involves the discharge of dredged or fill material into waters of the United States or the transpor-
tation of dredged material for the purpose of disposing of it in ocean waters. The evaluation of the impact of the
activity on the public interest will also include application of the guidelines promulgated by the Administrator U.S.
Environmental Protection Agency, under authority of Section 404(b) of the Clean Water Act, and /or Section 102(a) of the
Marine Protection Research and Sanctuaries Act of 1972 as amended.
Based on his initial review, the Division Engineer has determined that little likelihood exists for the proposed work to
impinge upon properties listed in or eligible for listing in the National Register of Historic Places and no further
consideration of the requirements of the Preservation of Historical and Archaeological Data Act of 1974 is necessary.
This determination is based on one or more of the following:
a. The permit area has been extensively modified by previous work.
b. The permit area has been recently created.
C. The proposed activity is of limited nature and scope.
d. Review of the latest published version of the National Register shows that no presence of registered properties
or properties listed as being eligible for inclusion therein are in the permit area or general vicinity.
Presently unknown archeological, scientific, pre - historic or historical data may be lost or destroyed by work to be
accomplished under the requested permit.
The 7ivLsion Engineer has also consulted the latest published list of threatened or endangered species and has made a
preliminary determination that the proposed activity will not affect those species listed or their critical habitat.
The initial determinations made herein will be reviewed in light of facts submitted in response to this notice.
Elie following authorizations have been applied for or have been or will be obtained:
(X) Permit, License or Assent from State. Massachusetts
(X) Permit from Local Wetlands Agency or Conservation Commission.
(X) Uater Quality Certification in accordance with Section 401 of the Clean Water Act.
The States of Connecticut, Maine, Massachusetts, New Hampshire, and Rhode Island have approved Coastal Zone Management
Programs. Where applicable, the applicant states that the proposed activity complies with and will be conducted in a
manner that is consistent with this approved Coastal Zone Management Program. Issuance of a State permit from the
appropriate State agency will indicate concurrence with this Statement of Consistency.
All comments will be considered a matter of public record. Copies of letters of objection will be forwarded to the
applicant who will normally be requested to contact objectors directly in an effort to reach an understanding.

The Roberts Meadow Reservoir Dam is a concrete, stone dam located adjacent to
Reservoir Road in the Village of Leeds, Northampton, MA.
The project involves repairs to the existing dam and the installation of an emergency
spillway Northwest of the existing dam. A 330 + foot long x 70 to 100 foot wide
channel will be excavated to allow flow from the.emergency spillway to be directed
to the existing stream below the Dam. The entire project area consists of about
nine acres, all of which is on land owned by the City of Northampton.
The purpose of the repairs is to refurbish the dam to its original storage capacity
for use in the Northampton Water Supply System for which it was originally designed.
The dam was intentionally breached in 1979 for safety reasons. The new design will
provide a much safer situation with the utilization of the emergency spillway and
flash boards on the principal spillway to carry 100% more flow than the original
design.
Excavation of about 50,000 cubic yards of soil from the basin area of the Reservoir
will allow additional storage. All excavated material will be disposed of in
upland areas.
