This letter will certify that the inspections revealed violations, listed below, which are serious enough as to endanger or materially impair the health, safety, and well-being of the occupants. Under authority of Chapter 111, Section 127 of the Mass. General Laws, and Chapter II of The State Sanitary Code, you are hereby ordered to make a good (24) hours faith effort to correct the following violations within twenty-four from the date of receipt of this order. REGULATION VIOLATION 4410-190 Hot water temperature reading of 160°F. Reading was taken in Room #58 , bathroom tub faucet , at 2: 15 p .m. on Jan . 15 , 1986 . Regulation requires hot water tempera- ture of not less that 110° farenheit ( 43°C) nor in excess of 130° farenheit (54°C) . REMEDY Adjust hot water heating facilities to maintain tem- perature within approved range . If you should have any questions regarding the order , please contact me at the Board of Health Office. Any person upon whom this order has been served or any person aggrieved by the failure of the inspector to perform as enumerated above has the right to be represented at a hearing and any adverse party has a right to appear at said hearing. Remedies and Penalties Part of the Inspection Report contains a brief summary of some legal remedies tenants may use in order to get Housing Code violations corrected. Failure to comply with this order also subjects the person ordered to a criminal fine of not less than ten ($10.00) dollars, nor more than five hundred ($500) dollars for each day's failure to comply with this order. We stayed in the Days Inn on Conz Street and the enclosed letter attests to the unpleasant two days. Reason for my letter to you is in regard to the failure of Days Inn on posting the room rates in room 70. And, I am requesting your assistance by either advising me who is responsible inspector or your going direct to the proper authorities and advising them of this negligence. First, I was at fault for not asking for a quote on room rates when I made the reservation for the nights of 11 and 12 November. Upon arrival I checked in and was charged $75 per night plus tax. (Copy of bill enclosed. ) On Monda■ , 14 November I called your advance reserva- tion number and was advised that the rate for two persons was $45 per night. A refund of $60 would appear to be in order. Here are some of the problems we experienced. We are passing them on to you as constructive criticism: ( 1 )No heat in room upon arrival. Turned on all the necessary controls - still no heat. Called office - no answer. Visited office and was told "Give me five minutes." Returned to room and within a few minutes the heat came on. Tried to phone front desk to thank them for the heat - no answer. Saturday we returned to room about 1 :30 PM - no heat. Tried calling the office - no answer. Went to office and a very young man, who could sneak very little English, did not know how to help me. I saw a man working outside on some cement work and I asked his assistance, but he did not understand my problem - language barrier. I returned to our room and then my wife took up the cause by going to the office. She inquired the whereabouts of the manager and was told he was out to lunch. My wife saw a housekeeper. She asked the housekeeper if she could help us with the problem. She did resolve the heat situation and came to our room to be sure her actions had brought about results. I asked if the heat was turned off periodically and she said, "Yes, because gas costs so much." (2)The front office not answering the phone could be a very serious problem in case of an emergency. (3)Returning to room on Saturday about 1 :30 PM there were no towels available. The soiled one's had been removed. No reply cements. The room was not placed in order until late Saturday afternoon. (4)No paper or pencil available in room. (A minor complaint) ,5)I do believe it is a state law in Massachusetts, as in many other states that room rates must be posted in each room. The forms were there but no entries had been made in regard to rates. I intend to bring this to the attention of the proper authorities in Northampton. (6)We are a retired couple wo do considerable travelling and have used many motels. Days Inn in Northampton was the first one where it took twenty-five cents to get ice. The machine was not working properly and it took considerable banging and shaking to get the ice cubes. Just another frustrating experience. We feel certain that you would want to know of our unpleasant experience in Northampton as it reflects adversely on the Days Inn of America, Inc. chain. Kochan, Sanitary Inspector, Northampton Board of Health, and Nick P. Nardacci , Jr. , Plumbing S. Gas Inspector , on November 17 , 1988 . Five ( 5 ) additional bathtub units in other rooms were also selected at random and check for health and plumbing code com- pliance . All six ( 6 ) bathtub units checked were found to be in com- pliance with applicable State health , building , and plumbing codes at this time. It should be noted that all tubs were provided with safety "non-slip" strips in the tub bottoms . Although these strips provide an added safety feature for occupant( s ) , they are not a specific requirement under any known health , building , or plumb- ing regulation . Peter McEarlin Northampton Hoard of Health 210 Main Street Northampton, MA 01060 Re : Pramukh Cor_poration, d/b/a Town House Motor Lodge c4tza eod& 473 ¶C 788-8916 Dear Mr . McEarlin : I represent Mr . Leo Daniele, of Springfield, Massachusetts, who has filed civil litigation against the Pramukh Corporation, d/b/a Town House Motor Lodge, which owns a motel at 117 Conz Street in Northampton . On Friday evening, February 12, 1988, and Saturday morning, February 13, 1988, Mr . Daniele rented a room at that premises and, while taking a shower in the bathtub of the room, slipped and fell in the tub, causing severe injuries to his lower back . His injuries are the subject of current litigation by him against Pramukh Corporation in Northampton Superior Court, Civil. Action No . 88-130 . At my suggestion, Mr . Daniele returned to Town House Motor Lodge in April and took photographs of the bathtub where he fell . The photographs confirmed his statements to me that the bathtub was inadequately equipped to ensure that an accident hazard would not exist . Specifically, the tub lacked any form of safety bars for persons, such as Mr . Daniele, to hold onto while showering and/or slipping and falling . In addition, the tub lacked safety strips or non- slip material at the rear half of the tub, where Mr . Daniele stood while showering and where, probably, most persons stand while showering . Although the tub possessed purport- edly non-slip strips on the bottom of the front half of the tub, those strips were visibly worn and old and lacked any non-slip qualities . The result of these deficiencies was my client ' s fall and injuries . Mr . Peter MrEarlin November 14, 1988 Page 2 I have reviewed the provisions of M.G .L . Chapter 140, Section 5, requiring that innholders provide "suitable" rooms for their lodging quests; 105 CMR Section 4 . 10 . 150 (D) , requiring that bathtubs or showers in bathroom facilities be "free from defects which . . . create an accident hazard"; and 105 CMR Section 4 . 10 . 750 (L ) requiring that plumbing facilities ( presumably including bathtubs and showers ) be installed in accordance with accepted plumbing standards so as to avoid exposure to users thereof to the possibility of accidents or other dangerous impairments to health or safety. It is evident to me that the bathtub which my client used did not comply with the above standards, and may subject other users thereof to serious injury. It appears to he a serious health risk , and may exist in many of the rooms at that motel . In the interest of confirming whether the bathtub facilities at the above motel are in compliance with appli- cable state health and plumbing industry standards for the purpose of my client ' s litigation, and in the corresponding interest of enabling your office to investigate and order appropriate remedial measures to be taken by the owner of the motel, if necessary, so as to prevent similar injuries to other persons in the future, you are requested to conduct an inspection of the bathtubs at that motel in accordance with the above and related statutory and regulatory provisions .
