VUISANCES:
DESCRIPTION OF VIOLATION(S):
Illegal dumping of solid waste consisting of trash bags,cardboard boxes,wood, cans, plastic,metal, as
well as unclean fill such as brush, leaves,grass clippings,tree stumps,tree limbs,other debris and
materials deposited/dumped on 2 Conz Street,Maplewood Shops,which is near a wetland area.This
illegal dumping,storage,or depositing of such solid waste material is in violation of one or more laws
listed above.

You are also in violation of Section 150A of Chapter I 1 l of the Massachusetts General
Laws(Establishment and Operation of Refuse Disposal Facilities)which states in part"No
place,in any city or town shall be established or maintained or operated by any person as a
site for a Landfill Facility,unless such place or site has either been assigned by the Board of
Health of such city or town as a site for a facility atter a public hearing". "A Facility shall
not be constructed or operated unless the proposed use and plans or design thereof have
been approved by the Department". The Department's Regulations for the Disposal of
Solid Waste by Sanitary Landfill(310 CMR 19.00)defines Rubbish as combustible or
noncombustible solid waste material,including but not limited to such material,as wood,
tree branches,yard trimmings,grass clippings,metals,construction wastes, street sweeping
and any unwanted or discarded materials.
YOU ARE HEREBY ORDERED TO TAKE THE FOLLOWING COURSE OF
ACTION TO CORRECT THE VIOLATION(S):
(1). Cease and desist and prevent of any further dumping, storage,or depositing of any
solid waste or liquid material(s)immediately upon receipt of this letter. Develop and plan
to monitor the area,keep it clean at all times,and to prevent future dumping.
(2). Remove all dumped and deposited materials and items that are on the ground around
the dumpster area,including what is on the embankment leading to the stream no latter
than May 4,2007..
If you fail to take any action of the above items 1 and 2 and/or fail to remain in compliance in the
any future requirements applicable to you, you may be subject to the Board of Health taking legal
action against you in order to gain compliance.

Thanks....
After out conversation, I have called the plumber to dispatch him to determine the issue again with the
hot water. I am dispatching a man to the property tomorrow, who will perform the water clean up again,
remove the small carpet to be cleaned and dried, and dry up the floor again.
One of my workers was at the property yesterday, after she initially called me at 9:30AM to alert me
that there was a problem at her unit. He arrived, with me, about 12:30, and worked to dry out her unit
completely, till 4:00.
When he left, it was dry.
That being said, I will send him back out in the morning to clean up what you are now telling me is
standing water along the back wall.

as promised, I had my men there at Unit#42 Maplewood Shops yesterday.
the man wiped up the water again(we think came up under the floor due to the hot water tank bursting),
and brought her carpet to be cleaned. It should be ready today. The only odor in the unit is cat urine
(her cat). She is away for the weekend, so we will bring her little area carpet back on Tuesday. She
should be all set.

I hope all is well with you, and that you are still enjoying your
apartment as much as initially!
We seem to be having an issue with someone lowering the window at
the front of the Laundromat, to a completely closed position. We have
renailed it into the "open" position a number of times.
The window is kept open for replacement air for the dryers in the unit
downstairs from you. This is needed for proper ventilation of the
dryers. Frankly, I thought it might be you, closing that window to
capitalize on the heat rising from the unit below you, not realizing that
it is open for a really good reason!
If you see anyone else closing that window, could you please let me
know who it is?

MINIMUM HEATING GUIDELINES
STATE SANITARY CODE, CHAPTER II: DEPARTMENT OF
PUBLIC HEALTH: 105 CMR 410.000: MINIMUM STANDARDS
OF FITNESS FOR HUMAN HABITATION
410.201: Temperature Requirements
The owner shall provide heat in every habitable room and every room
containing a toilet, shower, or bathtub to at least 68°F (20°C) between 7:00
A.M. and 11:00 P.M. and at least 64°F (17°C) between 11:01 P.M. and 6:59
A.M. every day other than during the period from June 15th to September 151h,
both inclusive, in each year except and to the extent the occupant is required to
provide the fuel under a written letting agreement. The temperature shall at no
time exceed 78°F (25°C) during the heating season. The temperature may be
read and the requirement shall be met at a height of five feet above floor level
on a wall any point more than five feet from the exterior wall. The number of
days per year during which heat must be provided in accordance with 105
CMR 410.000 may be increased or decreased through a variance granted in
accordance with the provisions of 105 CMR 410.840 not withstanding the
prohibitions of the first clause of the first sentence of 105 CMR 410.840(A).

REQUIRES THAT ADEQUATE HEAT BE PROVIDED FROM
OCTOBER 15 THROUGH MAY 15:
"Every factory, workshop, manufacturing,mechanical and mercantile establishment,
railroad freight house, railway express terminal, public garages and premises used by
express, trucking and transportation companies, and any other building in which a
person is employed, other than a building under construction, shall be well lighted,
well ventilated and kept free from unsanitary conditions. The work rooms therein in
actual use shall be properly heated during the period from October 15 to May 15,
according to reasonable rules and regulations adopted by the Department establishing
minimum requirements with reference thereto;"

Occupational Safety.
