The Northampton Board of Health has inspected the premises at
Apt . #1 , 23 Center Street , Northampton ( assessor ' s map 31B
parcel 284 . ) , for compliance with Chapter II of The State
Sanitary Code .
This letter will certify that the inspections revealed violations
listed below, which are serious enough as to endanger or
materially impair the health, safety, and well-being of the
occupants .
Under authority of Chapter III , Section 127 of the )Massachusetts
General Laws , and Chapter II of the State Sanitary Code , you are
hereby ordered to make a good faith effort to correct the
following violations within SEVEN DAYS of the receipt
of this order:

The Northampton Board of Health has inspected the premises at
23 Center Street, #3, Northampton, MA (assessor's map 31 B parcel 284 .),
for compliance with Chapter II of the State Sanitary Code.
This letter will certify that the inspections revealed violations listed below,
which are serious enough as to endanger or materially impair the
health, safety, and well-being of the occupants.
Under authority of Chapter III, Section 127 of the Massachusetts General
Laws, and Chapter II of the State Sanitary Code, you are hereby ordered to

Dear David;
I am writing to provide you with the details of the repairs to 23 Center Street, Apt.#3,
Northampton, MA., currently occupied by Michael Lynch and managed by our firm for Eric
Suher. Using the"Order to Correct Violations"as a guide:
1. Kitchen stove is connected;tenant has failed to have the gas turned on in his name. Gas for
cooking and electricity for lights are the tenants' utility obligations in this building.
2. Toilet has been secured to the floor.
3. Front door locking and electric striker system -we are currently getting proposals from
electricians to re-do the front door system.
4. On November 1, 1996 we installed four(4)new battery-operated smoke detectors in this
unit. On 11/06/96, when our staff went to finish painting the bathroom, all the batteries had
been removed from the detectors.
5. Cracked apartment entry door wooden panel has been replaced.
6. All windows in this unit and on the entire floor were replaced today.
7. Bathroom walls and ceiling have been scraped,compounded and are being painted today.
8. Entire bathroom floor has been sealed.

The Department of Environmental Protection, Bureau of Waste Site Cleanup, (the Department), has
received a request on your behalf from Environmental Compliance Services, Inc. (ECS) dated
January 22, 1998 to modify an Interim Deadline set forth in the Department's Notice of Audit
Findings dated December 27, 1996 and modified in the Department's letter to you dated March 7,
1997. This request follows a verbal extension request made on your behalf by ECS and granted by
the Department on October 28, 1997.
The Department is of the opinion that the requested modification to the Interim Deadline previously
established is reasonable. Therefore, pursuant to 310 CMR 40.0167 the Department modifies the
Interim Deadline of October 30, 1997 to June 1, 1998 for the submittal of a Response Action
Outcome Statement that complies with the requirements of the Massachusetts Contingency Plan.
Furthermore, based on a telephone conversation with Ms. Alexandra Riddle of ECS on January 29,
1998 the Department anticipates the submittal of a Release Abatement Measure Plan during this
month.

Dear Mayor Ford:
The purpose of this letter is to provide notification according to 310 CMR
40.1403(3)(d) of the implementation of a Release Abatement Measure (RAM) at the location
referenced above. The purpose of this Release Abatement Measure is to excavate and remove
petroleum contaminated soils at the site referenced above.
The Release Abatement Measure is tentatively scheduled to commence the week of
March 23, 1998. Soil excavation, off-site transport, backfilling, and re-grading of the
excavation area may take up to three (3) days to complete. Other actions conducted on the
site as part of this Release Abatement Measure will not involve excavations or other intrusive
procedures.

On June 17, 1999 at 1:20 PM, Brian Snow of Cyn Environmental (Cyn)provided notification to the
Department of a release and/or threat of#2 fuel oil from a leaking underground storage tank located
at the above property. In addition to oral notification, 310 CMR 40.0333 further requires that a
completed Release Notification Form (RNF) be submitted to the Department within 60 calendar
days of the date of the oral notification.
The Department has reason to believe that the release/threat of release reported is or may be a
disposal site as defined in the MCP. The Department also has reason to believe that you(as used in
this letter "you" refers to City of Northampton) are a potentially responsible party (PRP) with
liability under Section 5A of M.G.L. c. 21E.
This liability is "strict", meaning that it is not based on fault, but solely on your status as owner,
operator, generator,transporter, disposer or other person specified in said Section 5A. This liability
is also "joint and several", meaning that you are liable for all response costs incurred at a disposal
site even if there are other liable parties.

The Department encourages PRPs to take prompt and appropriate actions in response to releases
and threats of release of oil and/or hazardous materials. By taking the necessary response actions,
you may significantly lower your assessment and cleanup costs and/or avoid liability for costs
incurred by the Department in taking such actions. You may also avoid or reduce certain permit or
annual compliance fees payable under 310 CMR 4.00. Please refer to M.G.L. c. 21E for a complete
description of potential liability. For your convenience, a summary of liability under M.G.L. c. 21E
is attached.
You should be aware that you might have claims against third parties for damages, including claims
for contribution or reimbursement for the costs of cleanup. Such claims do not exist indefinitely
but are governed by laws, which establish the time allowed for bringing litigation. The Department
encourages you to take any actions necessary to protect any such claims you may have against third
parties.
At the time of oral notification to the Department,the Department approved the following response
actions as Immediate Response Actions (IRA): excavation of up to 200 cubic yards of oil-
contaminated soil, and removal of free phase product from the tank pit with absorbent pads
and/or vacuum truck.
Specific approval is required from the Department for the implementation of an IRA with the
exception of assessment activities, the construction of a fence and/or posting of signs. Additional
submittals are necessary with regard to this notification including,but not limited to, the filing of an
IRA Completion Statement and/or Response Action Outcome (RAO) statement. The MCP
requires that a fee of$750.00 be submitted to the Department when an RAO Statement is filed
greater than 120 days from the date of initial notification.
It is important to note that you must dispose of any Remediation Waste generated at the subject
location in accordance with 310 CMR 40.0030 including, without limitation, contaminated soil
and/or debris. Any Bill of Lading accompanying such waste must bear the seal and signature of a
Licensed Site Professional (LSP). You may contact the LSP Board of Registration at 617/556-
1145 to obtain the current LSP list.

regarding this release must reference the Release Tracking Number (RTN) contained in the subject

Municipal Officer and Board of Health in the community(ies)in which a disposal site is located and any
other communities which are,or are likely to be,affected by the disposal site shall be notified of the
availability of any Response Action Outcome(RAO) Statements filed pursuant to 310 CMR 40.1000.
Cyn Environmental Services has recently filed an RAO Statement report package with the Massachusetts
Department of Environmental Protection for the above referenced location. The package was filed in
response to a release/threat of release of oil and/or hazardous material,and outlined that a level of No
Significant Risk and a Permanent Solution was ultimately achieved at the disposal site as a result of
remedial activities. Additionally,pursuant to 310 CMR 40.0960, a level of No Significant Risk to safety
has also been achieved at the disposal site,and will not in the foreseeable future pose a threat of physical
harm or bodily injury to people.

DEP Requests Additional Information
The Department needs additional infomration to clarify the actions taken at the site and/or to
verify the site's compliance with the MCP. A Request for Information is enclosed as Attachment
C. You must prepare written responses to each question and/or request listed and submit them to
the Department within fourteen calendar days of your receipt of this notice. Your response

The deadline given for a response to this Request for Information is an Interim Deadline

DEP Requests a Site Inspection
The Department requests an appointment to inspect the site on April 2,2000 at 1:30 PM. The
inspection wil! be conducted by Scott Smith. You or a representative familiar with the site are
requested to attend. The Licensed Site Professional (LSP) of Record for the site may also attend.
Please call Scott Smith within five days of receipt of this notice at 413-755-2149 to confirm the
appointment or to arrange an alternative date or time. The purpose of the inspection will be to
evaluate the site conditions in relation to the information received by the Department, screen
groundwater samples and indoor air for the presence of volatile organic compounds (if
warranted), and to discuss the following issue identified during the Department's initial file
review:
1. The amount of soil excavated and the selection of sample location.
Preliminary audit findings based on the Department's file review may also be discussed during
the site inspection.
At the Conclusion of DEP's Audit
After the site inspection and review of your responses to the Request for Information,the
Department will evaluate whether the actions taken at the site are in compliance with the
regulations and meet the performance standards needed to protect public health and the
environment. The Department's determination of compliance will be based on the work
performed as of the date of this letter. You will receive a Notice of Audit Findings summarizing
the results of the audit. If the Department finds that response actions were not conducted in
compliance with the MCP, the Department will notify you of the actions you must take to return
to compliance. The Department may set Interim Deadlines by which you will be expected to
complete the actions needed to return to compliance, issue a Notice of Noncompliance with
associated deadlines, or pursue higher level enforcement which may include consent agreements
and/or the imposition of administrative penalties, if warranted.

at 23 Center Street in Northampton, MA.
Pursuant to M.G.L. Chapter 21E § 8, 310 CMR 40.0165, and 310 CMR 40.1120(1), the
Department requires you to provide the information requested below. You must prepare
written responses to each item and deliver the responses to the Department within
fourteen calendar days of your receipt of this notice.

I.RESPONSE ACTIONS AUDITED
The audit of RTN 1-12979 included a review of the following actions:
• A Response Action Outcome(RAO), Charles E. Klingler, LSP(#9435)
II. AUDIT ACTIVITIES
The audit consisted of the following activities:
• A Notice of Audit and Request for Information(RFI) letter sent to the City of Northampton on
March 16, 2000.
• A review of the documents listed in the Notice of Audit.
• A review of the written responses to the RFI, received on March 30,2000.
• A site inspection on April 3, 2000.
III. SITE SUMMARY
The site is located at 23 Center Street in a commercial area of Northampton, MA.The release occurred
beneath the northern end of an asphalt-paved alleyway situated between the police station and an adjacent
restaurant,that abut the site to the west and east, respectively. Extensive paved areas exist to the north
and south of these two buildings.
Geology at the site consists predominantly of sandy soils overlying day at a depth of approximately 7
feet.Topography in the vicinity of the site is flat,except for the alleyway,which has a moderate slope.
Groundwater was encountered at approximately 11 feet below grade during IRA activities,and was
determined to flow to the north/northeast.
The release was confirmed on June 17, 1999,when Cyn Environmental Services(Cyn)was on site to
clean and remove a 2000-gallon#2 fuel oil underground storage tank(UST).The release was suspected
because the building's oil-burner kept cutting out and water was subsequently discovered in the tank.The
Department issued a Notice of Responsibility to the City of Northampton on June 29, 1999. A Release
Notification Form and Class A-2 RAO Statement for the above-referenced release were prepared by Cyn,
on behalf of the City of Northampton and received by the Department on July 7 and August 23, 1999,
respectively.Groundwater was classified as GW-1, GW-2, and GW-3;soil was classified as S-2 and S-3.

Soil headspace readings of 2500 parts per million by volume(ppmv) were detected in soils surrounding
the tank during removal,using a photoionization detector(PID), indicating a 72-Hour Reporting
condition existed. Cyn also noted holes in the tank,confirming it as the source of the release. Cyn
provided the Department with notification of the release on June 17. In response to this notification,the
Department approved the removal of one-half inch of free-phase product located atop two small pools of
water in the tank grave, using sorbent materials.Cyn noted the pools appeared to be ponded on the clay
layer at about 7 feet below surface grade. In addition, as part of the IRA,the Department approved the
removal of up to 200 cubic yards of impacted soil.
Soil excavation activities were conducted on June 30,July I, and July 2, 1999. Select soil samples were
obtained from various locations and depths within the excavation for on-site headspace screening of total
organic vapors. Final PID readings from the limits of excavation ranged from below detection limits to
1.4 ppmv. The resulting excavation measured approximately 30 feet long by 18 feet wide by I 1 feet deep
(groundwater depth). A total of 227.97 tons of soil was transported under Bill of Lading for asphalt hatch
recycling. Fuel oil and sludge purged from the tank were disposed of under a Uniform Hazardous Waste
Manifest.
Based on PID readings,confirmatory samples were collected from the sidewalls and bottom of the
excavation and submitted to Cyn Environmental Services Laboratory for analysis of Extractable and
Volatile Petroleum Hydrocarbons(EPHNPH) and target analytes.Three borings were advanced and
completed as monitoring wells(MW-I, MW-2, and MW-3)on August 2, 1999. Groundwater samples
were collected from the monitoring wells on August 6, 1999, and submitted to Cyn's laboratory for
analysis of EPH/VPH and target analytes.
Cyn conducted a Method 1 Risk Characterization in which Exposure Point Concentrations, based on
remaining contaminant concentrations in soil and groundwater, were compared to the generally more
conservative GW-I groundwater and S-1 soil standards. Sample concentrations were below
Massachusetts Contingency Plan Groundwater GW-1 standards,though acenapthene was detected in
MW-2 at a concentration of 16 ug/L. The GW-1 standard for this contaminant is 20 ug/L.
Based on these results, Cyn concluded that a condition of No Significant Risk existed at the site. Cyn also
stated in the RAO Report that the excavation had been backfilled to grade and no remediation waste
remained at the site.
IV. SITE INSPECTION
An inspection of the site was conducted by Scott Smith of the Department on April 3, 2000. Also present
at the inspection were Brett Jacobus, representing the City of Northampton and Brian Snow of Cyn. The
site inspection was conducted for the purpose of documenting site conditions in conjunction with the
Department's audit of certain response actions performed at the site. Activities conducted on this date
included a general overview of the site and surrounding properties and a discussion of excavation and site
investigation activities conducted at the site. Mr.Jacobus and Mr. Snow were also informed that,
although GW-I cleanup standards are generally more conservative, only GW-2 and GW-3 are applicable
to this site. Although the site and downtown area of Northampton are underlain by a medium to high
yield aquifer, it has been designated as a Non-Potential Drinking Water Source Area because it is an
urban area.

V. DETERMINATIONS
No violations were identified during the audit.On the basis of the information reviewed during the
audit and in reliance upon the accuracy of that information,the Department did not identify any
noncompliance of MCP requirements during the course of the audit that warrant further action.
