Mr. Mathieu,
My wife and I have had offices at 16 Center St.for the past 6 years. About a year ago we expanded our space by
including a room on the back side of the building on the third floor above the Iron Horse. Because of the cooking
smells that come from the Iron Horse we are unable to keep our window open in the afternoon. Not only is this
inconvenient, but it also costs us money since we need to run our air conditioner into the winter months due to
neat buildup owning to the southern exposure.
The general level of cooking smells generally runs from unpleasant to sickening, but occasionally there are times
when there is a serious problem with the air quality.A recent example of this was October 19. Usually we only
iotice the smells when we open a window in the afternoon. But on this day there was a pervasive noxious smell
hat was noticeable in all parts of the building when we arrived in the morning and that lasted all day. It had a
;light food like quality to it, but it mostly contained a strong chemical quality. It was not merely unpleasant, it was
sickening. Both my wife and I went home that night with severe migraines. Many other tenants reported similar
eactions. Some closed their offices and went home early. This incident was a major problem for many of the
enants in the building and I do not believe that the Iron Horse has acted in a responsible manner in regard to this
rroblem.
Throughout the morning we attempted to learn the source of the smell without success. Eventually the resident
nanager of the building reported that the smell had come from the Iron Horse kitchen. The explanation was that
ley had come in early and cooked up a large amount of bacon and forgot to turn on the ventilators. I have a hard
me believing this explanation for a number of reasons It did not smell like bacon, but had a chemical quality. It
id not come from the outside and back of the building where food smells generally come from. We have never
oticed a food smell at that time of day before in our six years of tenancy. The Iron Horse staff did not let anyone
now that they had done something to cause this smell until long after it had happened. And the manager of the
on Horse has not responded to a letter that I wrote to him over a month ago expressing my concerns.

ecause of this incident, and more importantly the constant problems experienced by the tenants on the back of
e building, it seems only reasonable that the Iron Horse should find a way to ventilate their kitchen that does not

My name is Mary Grace Farley. I am a massage and Shiatsu therapist my practice,Grace
Bodywork,is located at 16 Center Street,Suite 311. I am writing in support of the complaint filed by
Janice Luzzi against the Iron Horse Music Hall for the smoke and odors from its kitchen,as I am
also negatively affected by this situation.
My office is located at the back of the building,across the hall from Janice's on the third floor. My
two windows,the only ventilation for my office,face the alley behind the building into which the Iron
Horse vents its kitchen. On any day the iron Horse is open,there are strong smells of grease and
smoke,and there is often smoke visible outside my windows.The smells are persistent even with
both windows closed,and the smoke thickens the air in my office.The problem can start as early
as noon,and is consistent from 3 p.m.on,peaking about 5 p.m.-9.p.m.,and worst on busy nights
such as Friday.There are also odors and sometimes smoky air in the hallway outside the office.A
contractor working in my office described the smells and smoke as"brutal."I cannot open the
windows(again,my only ventilation)without being fully exposed to them.

Shiatsu specifically for the relief of asthma and sinus problems, and this creates an unhealthy and
unnecessanly challenging environment for them.

Dear Mr. Mathieu,
Once again, thank you for your on site visit to my office at 16 Center Street, Suite
309, Northampton, Ma. 01060, on Monday evening March 21. As you requested, I am
sending you a chronology of events from the Fall of 2004 to the present.
As you know, pervasive smells of smoke, grease and often a strong burning smell as
well as visible smoke in my office, from the first floor business of the Iron Horse Music Hall
are the subject of this letter, and the detremental effect this is having on my office, my
business and the health of myself and the clients that I see. Some of my clients suffer from
environmental illness and are affected by these smells.
I am a sole proprietor and owner of Therapeutic Massage, and have been a tenant of
16 Center Street,Suite 309 since March of 1994. This problem has progressively
worsened over the last 3 years. I have been speaking with Carol Heon, Manager of affairs
for Central Chambers regularly over the last 2 years, informing her of the ventilation
problem in my office, as well as the effect it is having on my business.
As you know, two other tenants on the third floor of the Central Chambers building
have contacted your office over the last 6 months to file similar complaints. As I understand
it, Mr. Eric Suher, owner of the Iron Horse, is also a tenant of Central Chambers. Carol
Heon has reported to me on several occasions that she has spoken with Mr. Suher
regarding these complaints and urged him to install a vent exiting from his first floor alley
kitchen to exit smoke and cooking fumes over the top of the building. No vent has been
installed to date.
My two office windows face the southwest alley that is shared by the Iron Horse
kitchen fan, and when cooking begins, sometimes as early as noon but most often
between 4:00 -7:00 PM. for weekly (M-Sat) evening shows, the fumes, smoke, and
grease smells exit The kitchen via a large fan and drift easily up the two stories to and into
my office.
The nature of my work is Therapeutic Massage and Clinincal Bodywork. I work in my
office 3-4 evenings a week, as well as daytime hours and when the smell is pervasive in
the office, it is impossible to open one of the two windows, even an inch or two for
ventilation. This is especially a problem in the fall and spring, since the office becomes very
warm with south facing walls, and heats up quickly throughout the day. The problem
persists even in the summer with A/C, and in the winter, as the fumes are present in the
hallway outside my office and do enter through incorrectly sealed windows, into my work
space
The following is recent chronology regarding this problem: All these smells were detected in
my office treatment room:
October 13, 2004 7:00 PM left message for Carol Heon regading smoke smell.
October 27, 2004 5:00 PM left same message with Carol Heon
October 28, 2004 5:10 PM Detected a strong chemical smell Called Iron Horse Music Hall
Hall, spoke to Stu'who informed me there had been a"fire/smoke problem" that was
"handled"
October 29, 2004 5:15 PM Visible smoke in my office
November 2, 2004 Filed a Complaint at the Board of Health Office, Northampton, with
Richard Meczywor
November 4, 2004 3:30- 6:00 PM Smoke, grease and food smells in the office
November 18, 2004 aprox 6:00 PM Called Ernie Mathieu. He was unable to come to
office
November 22, 2004 6:30 PM Call to Ernie Mathieu. Mr. Mathieu came to my office
location and did detect strong cooking smoke smell in the hall outsidre my office. I could not
allow him entry into my treatment room as I had a client.
November 31, 2004 approx. 5:50 PM called Ernie Mathieu. He was unable to come to
the office
December 31, 2004 6:00 PM Called Ernie Mathieu. He was not working at that time.
January 29, 2005 12:00 noon Very strong cooking smell and visible smoke in the office.
Unable to vent the office or open a window.
March 18, 2005.4:45 PM Called Ernie Mathieu. Very strong smoke smell in office. Left
VM.
March 18, 2005 11:50 AM Filed an in person Complaint at the Building Commissioner
Office, Northampton, Ma. Linda LaPointe, secretary, said she would route to Anthony
Patillo, CBO
March 21,2005 4:00 PM Called Ernie Mathieu, he did come to office and entered my
treatment room; reporting that he could smell fumes with my window opened 2 inches.
March 22 2005 telephone call to City Councilor Rita Bleiman complaining of the above.
Your attention to this matter is greatly appreciated. Please forward to me a written
copy of action being taken. I will follow up by the end of next week and be in touch with
you.
