27 Police Report 2012 11/19/2012 09:02 4135871137 NORTHAMPTON MA PD PAGE 02/03 Northampton Police Department Page: 1 • NARRATIVE FOR PATROL OFFICER PAUL J MAR6[JET- 4756 Ref: 12-1056-AR Entered: 11/11/2012 @ 1456 Entry ID: 215 Modified: 11/11/2012 @ 2024 Modified ID: 215 Approved: 11/13/2012 @ 2240 Approval ID: 150 On 11111.112 at approximately 1328 hrs Officer Sotolotto and I, Officer Marguet,went to 27 Clark St.for a warrant service on Ronald Lieberwirth who was said to live at that residence. Upon arrival,Officer's knocked on the front and back door and heard no response. Through windows, Officer's observed the inside of that home to be in complete disarray. Clothes were thrown about the floor,it appeared as if the home had been broken into and everything had been gone through in the house and emptied onto the floor. When officers knocked again at the front door,a male yelled from the room just next to the front door to get away from his house. We advised him that it was the police and he needed to come to the door. He was asked if he was Ronald Lieberwirth and he advised that he was. We could clearly hear him since the living room bay window was missing and in its place was a sheet of plastic. We could not observe anyone inside but he continued to yell at us to leave him alone and that he was not coming outside. At this time,Officers were given permission to make entry into the home from the Officer in Charge,Lt. Clayton. The front door was locked and the back door was open. In order to get to the back door,officers had to walk over trash and other items just through the mud room to the doorway. The door was unlocked and entry was made into the kitchen. It did not appear as if there was any food in the home and there was trash and debris strewn throughout the kitchen. A litter box was located in front of the fridge and it was full and did not appear to have been emptied in months. There were no animals seen inside the home. Lieberwirth was found sitting in his chair in the living room watching television. He was advised that he needed to get up and come with us as there was a warrant for his arrest Lieberwirth advised us that he was not going to be coming with us. Officer's asked again for him to stand up and come outside with us and he yelled at us, "get the fuck out of my house". I then grabbed a hold of his right arm to affect an arrest and he pulled away from.me and began to swing punches in my direction. He did not hit me but was resisting arrest. Officer Sotolotto sprayed Lieberwirth with pepper spray and grabbed a hold of his left arm- I grabbed a hold of his right arm and we pulled him up and out of his chair. Officer's then did a double arm bar take down and brought Lieberwirth to the floor. While attempting to handcuff him, he continued to resist arrest. During the struggle and him being taken down to the floor,Lieberwirth suffered an abrasion to his forehead, left knee,and after getting him into handcuffs,he continued to straggle which caused a cut on his left wrist. Licberwirth appeared disheveled and as if he had not bathed in months. He was asked if when the last shower he had or the last time he left the house and he advised he had not left the house or showered in over a month. Lieberwirth was transported back to the station where an ambulance met with us in the booking room to care for his injuries. Lieberwirth was compliant with officers at this point and was able to wash his eyes and face of the pepper spray. Lieberwirth refused any medical treatment and pictures were taken of his injuries. He also was wearing a medical boot on his right foot which was for a bunion that be had. Lieberwirth was read his tights per Miranda,rights to a telephone and bail. Lieberwirth was photographed, fingerprinted and placed securely into cell M6. Bail was set at personal recognizance plus a$45.00 fee by Bail Clerk Morin. 11/19/2012 09:02 4135871137 NORTHAMPTON MA PD Northampton Police Department NARRATIVE FOR PATROL OFFICER ANTHONY C SOTOLOTTO - 4B60 Ref: 12-1056—AR Entered: 11/11/2012 @ 1535 Entry TD: 218 Modified: 11/13/2012 @ 1412 Modified ID: 139 Approved: 11/13/2012 @ 2240 Approval ID: 150 On Sunday,November 11,2012,at approximately 1:30 PM, Officer Marguet and 1 responded to 27 Clark Street,to attempt to serve a warrant. Officer Marguet had a warrant in hand for Ronald Lieberwirth,(1298CR002332)which was :onfirmed by Desk Officer Duso. We arrived and knocked at the door,which received no answer. I continued to knock at the door, and 1 heard a male yelling from inside"get the fuck out of here!"I identified myself and asked him to come to the door.He continued to yell 'fuck you! I'm not going anywhere with you guys!" and other assorted epithets from inside the house. From my vantage point in the front of the residence,the windows were obscured with plastic or blinds so I could not see inside the residence.It appeared that the house had fallen in quite a state of disrepair;there were piles of trash outside,high shrubs and high weeds surrounding the residence,and large amounts of cobwebs around the door and windows. Officer Marguet and I proceeded to the back door,where we found it to be opened.We entered the house,which was in a state of extreme squalor;filth and trash covered almost every inch of the floor.There was a cat litter box in the corner that was overflowing with feces,and other animal feces were strewn all over the house.There were empty food boxes,dirty dishes,dirty clothes and other soiled household items everywhere.There was so much clutter that we could not walk in any sort of a clear path in the house. As we entered the living area of the house, I noticed a male sitting in a recliner in the Irving room.He was speaking to Oftirer Marguet,and he again identified himself as Ronald Lieberwirth.We asked him why he wouldn't come to the door,and he told us that it was his house and we were not welcome there. Officer Marguet advised him that he was under arrest. His reply was recorded as"Fuck you,I'm not going anywhere with you guys!"Officer Marguet again told him that there was a warrant for him,and that he was under arrest. Officer Marguet attempted to escort Mr.Lieberwirth out of the chair,and he immediately pulled away from him.At this time he Benched his fists and took a fighting position. I removed my OC spray from my belt and deployed a one second burst into Mr. Lieberwirth's face.Mr. Lieberwirth continued to resist,and Officer Marguet and I performed an arm bar takedown of Mr. Lieberwirth onto the kitchen floor. He struck his face on some items that were on the floor,causing a superficial laceration to his forehead.After escorting Mr.Lieberwirth to the floor,the OC spray had its desired effects,and Mr. Lieberwirth ceased resisting. I secured Mr. Lieberwirth in handcuffs,and we escorted him outside to a cruiser. Officer Marguet transported Mr.Lieberwirth back to the police station and I followed in my cruiser.We requested that an ambulance from the Northampton Fire Department meet us at the booking room to evaluate the injuries to Mr. Lieberwirth.The paramedics irrigated and bandaged the laceration on Mr. Lieberwirth's forehead,as well as a laceration to his wrist from his resisting against the handcuffs,and an abrasion on his knee,which was likely caused by his resisting arrest inside of the house. He refused transportation to the hospital.Mr. Lieberwirth was also allowed to flush out his eyes of the OC spray after being evaluated by the fire crew.
