I am writing to kindly request Health Agent, Mr. Peter McErlain, of
City of Northampton, County of Hampshire. To kindly conduct an inspection
at Hampshire County Jail, and House of Correction, located at 205 Rocky Hill
Road, in City of Northampton, County of Hampshire, Commonwealth of
Massachusetts, 01060. For violation of: CODE MASS. REGS. 105 C.M.R. 451.102
[Pillows and Linens], in conjunction with Section 5, Section 21, of Chapter
Ill, of Annotated General Laws of Massachusetts.
From on or about, 12, day of Octpber, 1999, to on or about, 3, day of
June, 1996. I was a lawfully committed inmate in lawful care and custody
of Hampshire County Jail & House of Correction, which is supervised by:
Sheriff Robert J. Garvey, Where I was only issued [1] towel, no wash
cloth, and the pillow I was issued was not laundered in between use by
different persons' .
My reasons' , for hot having made complaint to this matter at an
earlier date and time is that I was not aware of the doctorine of CODE MASS.
REGS. 105 CMR 451.000, et. seq. - [Minimum Health and Sanitation Standards
and Inspection Procedures for Correctional g Facilities]
Will you kindly please investigate my alleged claims, and kindly make
a written response to me with in thitty days from the date of mailing hereof

In accordance with Chapter 111, Sections 5 and 20 of the General Laws and Department of
Public Health Regulations 105 CMR 451.000: Minimum Health and Sanitation Standards and Inspection
Procedures for Correctional Facilities,an inspection was made of the Hampshire County Jail &House of
Correction on October 13, 1999. The inspection was conducted by Charles Rudnik R.S., accompanied by
Will Larese.
There appear to be some problems with the ambient air temperature and backflow of sewage.
In accordance with Section 451.404 of the previously mentioned regulations,please indicate next
to each entry on the enclosed Report of Condition,a plan of correction. Said plan of correction should
detail the specific steps that will be taken and the date by which compliance should be expected.

in cell # 57 appeared in the toilet in cell 58 when the
toilet in 57 was flushed.

into the toilet in cell# 51 and flushed, this material
appeared in the toilet in cell# 52.

.126 Hot water temperature dropped to 80°F. for
approximately 7 seconds then increased to 110°F.

In reference to the memo of November 3, 1999,about the problem of backflow of sewage in certain
cells,on October 28, 1999,the problem was taken care of by Engineering services.
This happens to be a problem that is due to the increase and decrease of water pressure being fed by the
City of Northampton
As far as the ambient air temperature,it once again is due to the fluctuation of the outside air pressure.
This problem should be taken care of with the colder air temperture.

The Department of Public Health has received and reviewed a set of plans and
specifications for the construction of a new Hampshire County Holding Facility. The plans are

and E-5. These plans have been reviewed for the purpose of compliance with the requirements of
Massachusetts General Law, Chapter 111, Sections 21 and 22 and the regulations entitled 105
CMR 470.000: Maintenance and Construction of Lockup Facilities. This review included the
provisions for lighting,heating,ventilation,bedding, disposal of sewage and the dimensions and
form of construction of the cells.

Based upon this review, the department approves the plans as presented with the
following requirements and recommendations:
1. A building permit must be obtained from the appropriate building official;
2. Written approval is obtained from the Department of Youth Services prior to the detention of
any juveniles;
3. Juvenile detainees shall be located so that they are apart from adult detainees and juvenile
females must separated by sight from juvenile males;
4. The interior of the cells must be painted a light color;
5. If mattresses are provided they shall be fire retardant and non-toxic;
6. There must be at least 2ocfm of fresh air provided to each occupied cell at all times (these
cells are to be ventilated as would a bathroom)with exhaust directly to the outside. and
7. Occupancy is for short term only.
Please provide this office with a copy of the plans which are noted as having been
reviewed so that we may maintain a copy. A signed approved copy will be forwarded to you at
that time. Please note that approval is given only for those building components covered by the
regulations of the Department of Public Health and then only if they are present and/or meet the
Department's standards. An approved signed copy of the plans must be kept at the construction
site. All construction must comply with the plans as approved.

In accordance with Chapter 111, Sections 5 and 20 of the General Laws and Department of Public
Health Regulations 105 CMR 451.000:Minimum Health and Sanitation Standards and Inspection Procedures
for Correctional Facilities,an inspection was made of the Hampshire County Jail&House of Correction
Facility on April 10,2000. The inspection was conducted by Charles Rudnik,R.S.,accompanied by Will
Larese, Environmental Health&Safety Officer.
There appears to be a problem with sewage from toilets in some cells flowing into toilets in other
cells. This cause of this condition needs to be determined and corrected.
In accordance with Section 451.404 of the previously mentioned regulations,please indicate next to
each entry on the enclosed Report of Condition,a plan of correction. Said plan of correction should detail the
specific steps that will be taken and the date by which compliance should be expected.

In accordance with Chapter 111, Sections 5 and 20 of the General Laws and Department
of Public Health Regulations 105 CMR 451.000: Minimum Health and Sanitation Standards and
Inspection Procedures for Correctional Facilities,an inspection was made of the Hampshire
County Jail & HOC Facility on October 18, 2000. The inspection was conducted by Charles
Rudnik, R.S., accompanied by Will Larese,Environmental Health and Safety Officer.
The primary facility continues to be maintained in good condition. There is a problem
with backflow from toilet to toilet when certain toilets are flushed. It was also noted that the hot
water temperature in House Block Units 1 and 5 showers, and the Modular North Side Bathroom
is too low.
The condition of the Modular Unit shower and toilet areas raise significant concern. The
physical facilities are deteriorating,the dryers are not ducted to the exterior and there is
inadequate ventilation. These conditions have resulted in a heavy mold growth. This mold
growth could be hazardous to individuals who have respiratory problems or may be
immunocompromised. Immediate repair of the cause of mold along with remediation and
removal of the moldy building materials is necessary.
In accordance with Section 451.404 of the previously mentioned regulations,please
indicate next to each entry on the enclosed Report of Condition, a plan of correction.

Additionally, I have been in contact with the Department of Capital and Asset
Management in the hope of resolving the issue with the Modular Unit. The building that
is referred to as the Modular Unit, is not a state-owned building. It is leased from a third
party and the lease agreement has lapsed since the end of 1998. The leasing company,
which owns the building, will not provide the necessary funds to make repairs to any area
of the building including the areas listed in your report. We are prohibited from spending
state money on a building that is not the property of the Commonwealth of
Massachusetts.

Dear Mr. Garvey:
In accordance with Chapter 111, Sections 5 and 20 of the General Laws and Department
of Public Health Regulations 105 CMR 451.000: Minimum Health and Sanitation Standards and
Inspection Procedures for Correctional Facilities,an inspection was made of the Hampshire
County Jail & House of Correction Facility on April 24, 2001. Charles Rudnik,R.S.,
accompanied by Safety Officer Lt. Hodgen and Environmental Health and Safety Officer Todd
Turek conducted the inspection.
The main facility was found to be in compliance with the applicable regulations with the
exception of some problems with blackflow of sewage from one toilet to another. The modular
units,however, are in an advance state of disrepair and need to be repaired or replaced. It is our
understanding that these units are under the jurisdiction of DCAM and you need their assistance
in getting them replaced.
In accordance with Section 451.404 of the previously mentioned regulations,please
indicate next to each entry on the enclosed Report of Condition, a plan of correction.
Hot water at hand sink is 138 degrees F. Proper range should
be 110— 130 degrees F.

Dear Mr. Wensley:
In the past several months this office has been communicating with the
Commonwealth's Division of Capital Asset Management in an effort to resolve some of
the public health and public safety problems relating to the modular construction at this
location.
I will attempt to give you a brief description of the progress to date. The
Commonwealth intends to expend Capital funds to rehabilitate the present building to
bring it into conformity to all the existing health and safety standards. The construction
will be done in two phases. Each phase will be addressing issues on both sides of the
building. We will vacate the side of the building being rehabbed and then repeat the
process for the second phase.
Hopefully, construction will commence in the near future.
Further, the plan is to replace the present building with new construction two
years from now. I am guardedly optimistic.

In response to the D.P.H. letter of November 6,2000,back flow from one toilet to the other toilets.
After getting the information from Croft& Smith Co. on a fully baffled 90°in let we have come to the
conclusion that by installing these units it will create a bigger problem.

Our system is an upper tier/lower tier design. When the baffled inlets are installed and upper toilets are
flushed the waste going down through the lower tier hitting the baffled inlet will create a build up. This
build up will result in a plugged line.(See cut sheet on 90°baffled inlets). The unbaffled inlets at our
facility are designed to work by water pressure adjustments. When we get a complaint we rectify the
situation by a simple waster adjustment.
Approximate cost per upper/lower unit is$1,000.00 plus three(3)days of labor plus the loss of 4 housing
cells for 3 days.

and ventilation system. Renovations to the Southside are scheduled
In additions, the north side sleeping quarters are closed and are
being renovated. The south side sleeping rooms will be closed and
remodeled starting in 2 weeks.
