In accordance with Chapter 111 Sections 5 and 20 of the General Laws
and Department of Public Health Regulations 105 CMR 451.000: Minimum Health
and Sanitation Standards and Inspection Procedures for Correctional
Facilities, an inspection was made of the Hampshire County Jail and House of
Correction on May 11, 1993. The inspection was conducted by Charles Rudnik
accompanied by Captain Burt.
It is important that strict attention be paid to the chemical sanitizer
concentrations. Concentrations which are too high could be toxic.
In accordance with Section 451.404 of the previously mentioned
regulations please indicate next to each entry on the enclosed Report of
Condition, a plan of correction. Said plan of correction should detail the
specific steps that will be taken and the date by which compliance should be
expected

HOMES:
15 Minutes before conducting an inspection of the kitchen, the electric
breaker controlling the supply of electricity to the dairy walk-in cooler, the
preparation walk-in cooler, the walk-in freezer, a hot holding unit, an upright
cooler and the walk-in freezer located in the warehouse, tripped: rusing a loss
of power to this equipment. Electricians were immediately notified and
corrective work started in several minutes. Food in hot holding unit was
immediately transferred to working hot holding units at the rear of the
kitchen. At 2:45 P.M. staff checked the internal temperatures of the food
products in both walk-ins and checked the air temperature in the walk-in
freezers. The following temperature were recorded:
Dairy Walk-in - milk product recorded at 37°F.
"Prep" Walk-in - sliced meat recorded as 34°F.
- Log of meat recorded as 36°F.
Walk-In Freezer - Air temperature recorded as 21°F. , product frozen solid
Warehouse Walk-In Freezer - Outside gage - read - 4°F. below zero, product
frozen solid
At 3:50 Y.M. the electrical problem was corrected by replacing a fuse.
The temperatures of the walk-in freezers and coolers were checked again at
4:00 P.M. The following results were obtained:
"Prep" Walk-In - 38°F. recorded for sliced meat and log of meat
Walk,In Freezer - Air temperature recorded as 10°F. , product was frozen solid
Warehouse Walk-In Freezer - Air temperature - 0°F. , product frozen solid
Electricity to the hot holding unit and to the upright cooler, was also restored
at 3:50 P.M.

Lear Sheriff Garvey:
In accordance with Chapter 111, Sections 5 and 20 of the General Laws
and Department of Public Health Regulations 105 CMR 451.000: Minimum Health
and Sanitation Standards and Inspection Ptr`-edures for Couectional
Facilities, an inspection was made of the Hampshire County Jail and House of
Correction on October 3, 1994. The inspection was conducted by Charles
Rudnik accapanied by Lt. Hodgen.
The hot water within mast hand wash sinks is delivered at less than the
required 110° - 130°F. The hot water, however, at the hand wash sink
in the kitchen of the nodular unit is 152°F. This presents a severe scald
injury.
There is no exhaust ventilation within the shower
forwarding a copy of aslnoted
in the previous report and was responded by
flume Reinhardt Assriates dated August 29, 1986. That letter, however, did
not address the issue. Apparently the statement ' Circulation of outside air
or recirculated filtered air per human occupant is in the facility" logs
intended to do so. We continue to be confused as to the meaning of that
statement as it does not address the issue of no exhaust ventilation serving
the shower facilities.
In accordance with Section 451.404 of the previously mentioned
regulations please indicate next to each entry on the enclosed Report of

Please be advised that this office is in receipt of your letter and report of a
Department of Public Health inspection of this facility in accordance with Chapter 111,
Sections 5 and 20 of the General Laws and Department of Public Health Regulations 105
CMR 451000: Minimum Health and Sanitation Standards and Inspection Procedures for
Correctional Facilities.
I am confident that we have corrected those violations over which we have
control. However, I shared your confusion in regard to the shower ventilation system.
This structure was built under the supervision of the Massachusetts Division of
Capital Planning and Operation. We have had semi-annual inspections by your agency
since our opening in 1984 and this issue did not surface until this past year. It appears to
me that either someone has been missing something or someone is making a non-issue an
issue.
In the spirit of cooperation,I contacted the building architect Reinhardt Associates
to explain the situation and the construction. It would seem reasonable to me that you
could resolve any problem with Reinhardt, D.C.P.O. or someone that was involved with
the design and construction of this building.
I am simply trying to administer a government function in a building that was
constructed under the supervision of one of your sister State-agencies. I am neither an
architect nor a building contractor.

Sheriffs' Association,I have the opportunity to meet periodically with Governor Weld.
The Governor is continually encouraging all government units to cooperate with one

Community Sanitation to initiate a spirit of cooperation with the Massachusetts
Sheriffs' Association and the facilities they manage.

The following response to the deficiencies cited by the Inspector are in chronological
order of the way they were listed on the "Report of Conditions" submitted by Charles
Rudnik. Where designated, **, refers to standard 451.200, and after it is the 590
standard that applies to the particular condition cited.
451.200** As noted below, dishwasher was not up to temperature, under normal

Establishments, and the condition cited by the inspector refers to living units.

451.140 Due to the continued confusion in regards to Adequate Ventilation in the
shower stalls: This was reported by the Inspector in the previous Inspection
of 12/9/93. However, the standard listed was 451.141 which pertains to
screens, not showers, so that was what was responded to in the Plan of
Correction. We then received a letter on 1/18/94 requesting clarification on
our response to the ventilation issue. The response that we gave was the
same response that we received from the architect. The next communication
received was 2/17/94 and raised concern as to the statements made by the
architectural firm. We have no control on the statements made by the
architectural firm.
The inspection report received 10/12/94 now has the correct standard
listed for adequate ventilation. However, the standard does not reflect the
showers stalls, that we have at this facility. The standard states "Each inmate
shall have adequate ventilation at all times. Each facility shall have ventilation
of each cell and each habitable or occupiable space, bathroom, and toilet
compartment in compliance with 780 CMR, State Building Code. Natural
ventilation through a window in each cell is recommended." All of the criteria
of this standard is met by the facility, and if there is any question of
compliance with 780 CMR, then it should be addressed to DCPO, who was
responsible for overseeing of construction of the facility.
Attached is our most recent correspondence with Reinhardt Associates,
which gives definition to Shower Stall Ventilation.

Dear Mr. Supernaut:
In response to our telcon regarding the State Inspectors report noticing a deficiency of no
ventilation in the Shower Rooms and after reviewing the original drawings, it was/is our
interpretation of the State Building Code that the space in question is not a "room" as it is merely
a shower stall directly off of, and open to the Day Room. The Day Room is properly ventilated and
hence with the shower stall open to the Day Room becomes a part of the Day Room space and
does not require separate ventilation provisions.
We hope that our explanation dears op this question, however, If there Is something more specific
that we are not aware of, please provide a copy.of the code section for our review.

Dear Sheriff Garvey:
In accordance with Chapter 111, Sections 5 and 20 of the
General Laws and Department of Public Health Regulations 105 CMR
451 . 000 : Minimum Health and Sanitation Standards and Inspection
Procedures for Correctional Facilities, an inspection was made of
the Hampshire County Jail and House of Correction on March 24 ,
1995 . The inspection was conducted by Charles Rudnick accompanied
by Lt . Hodgen.
The inspection revealed that improvements have been made since
the previous inspection. It is our understanding that the
ventilation problem in the shower areas is being investigated by
DCPO.
Problems were noted in several areas of the institution with
inadequate hot water temperatures in some instances the temperature
was as low as 82°F. The appropriate temperature for showers and
handwash sinks is between 110°F and 180°F. Inadequate temperatures
were also noted at the mechanical dishwasher in the modular unit .
Until proper temperatures can be reached, manual sanitation
practices or single services must be used.
In accordance with Section 451.404 . of the previously
mentioned regulations please indicate next to each entry on the
enclosed Report of Condition, a plan of correction.
Said plan of correction should detail the specific steps that
will be taken and the date by which compliance should be expected.

however,was found to be too hot in some areas and too cool in others. It must be maintained so
that hot water is delivered between 110°F - 130°F at all hand wash sinks and showers.

During the inspection, Mr. Rudnick took an inmates chair, stepped
up to the vent and placed a piece of paper over the vent. As Mr.
Rudnick let go of the paper, it was sucked up in to the flux. In my
opinion the exhaust is working.

After speaking with C. Rudnik on 9/27/95 I informed him that I
had not received the study that was being conducted by DCPO.
After the receipt of this Report of Conditions I spoke with our
Director of Engineering Services who informed me that he had
received the report.
The report, Project No. DCP909-HD3 Job I, was prepared by
ASE Corporation of Quincy MA for the DCPO Office of Project
Management.
The standard that is listed is incorrect. The correct standard for the
violation is 451.383. The violation was corrected at the time of the
inspection. Ashtrays have been disseminated to the inmates and
all inmates are reminded to only use proper smoking receptacles.

Dear Sheriff Garvey:
In accordance with Chapter 111, Sections 5 and 20 of the General Laws and Department
of Public Health Regulations 105 CMR 451.000: Minimum Health and Sanitation Standards and
Inspection Procedures for Correctional Facilities, an inspection was made of the Hampshire
County Jail and House of Correction on January 7 and 9, 1997. The inspection was made by
Charles Rudnik, R.S., of this Department, accompanied by Lieutenant Hodgen.
The hot water temperature throughout the building is uneven providing temperatures both
above and below the required range of 110 to 130 degrees F.
Although the room temperatures were adequate at the time of the inspection, several
inmates complained that the rooms are cold at night. The temperatures must be maintained at
least at 64 degrees F.
It was noted that a product known as Maintainer DIS is being used on the floors. The
Material Safety Data Sheet lists this material as having a high health hazard. It is a severe eye
irritant as well as an initant to the skin and through inhalation. It is suggested that you may wish
to explore other less toxic materials. In the interim,the user of this material should be provided
with protective eyeware and gloves.

At the time of inspection it was stated to the inspector that a RFS had been
submitted on 1/2/97 to repair the deficiency. The contracted chemical
company came to adjust the concentration of liquid sanitizer it on 1/7/97.

Unfortunately our facility, like most others in the state and nation, is above our
rated capacity. We do, however have a contingency plan on overcrowding
currently in place. Also, the facility, together with local court officials has
developed an Overcrowding Action Council in order to better manage the
increased population at the HCJHC. As noted by the inspector, inmates were
housed in the dayroom areas at the time of inspection. Although the conditions
are crowded, we do at all times, upon the inmates request escort the inmate(s)
to the area noted by the inspector for use of toilet and handwashing facilities

The area is cleaned by inmate staff daily.
We will be fabricating a way to affix the scoops to the ice chests to make sure
the ice is handled in a sanitary manner and the scoop is not a security risk.

In accordance with Chapter 111, Sections 5 and 20 of the General Laws and Department
of Public Health Regulations 105 CMR 451.000: Minimum Health and Sanitation Standards and
Inspection Procedures for Correctional Facilities, an inspection was made of the Hampshire
County Jail and House of Correction on January 14, 1998.
Excessive hot water temperatures were noted at the kitchen handwash sink. There also
appears to be a ventilation problem at the shower area. No are movement was detected and there
is mold growth on the ceiling.
In accordance with Section 451.404 of the previously mentioned regulations, please
indicate next to each entry on the enclosed Report of Condition,a plan of correction. Said plan
of correction should detail the specific steps that will be taken and the date by which compliance
should be expected.

In accordance with Chapter 111, Sections 5 and 20 of the General Laws and Department of
Public Health Regulations 105 CMR 451.000: Minimum Health and Sanitation Standards and Inspection
Procedures for Correctional Facilities, an inspection was made of the Hampshire County Jail and House
of Correction on September 23, 1998. The inspection was conducted by Charles Rudnik. R. S.,
accompanied by Dennis Bishop and Lt. Shea.
The ventilation problem previously noted in the South Side Shower and Toilet area still appears
to be a problem. Inadequate ventilation along with an improperly vented clothes dryers will significantly
add to the moisture level in the indoor air, resulting in mold growth and possible respiratory problems.
There also appears to be a problem with the sewage system. It was observed(Jail/A)that when
the toilet is flushed, the contents of cell 11 flowed into the toilet of cell 12. This was also alleged to
occur in another area of the institution.
In accordance with Section 451.404 of the previously mentioned regulations, please indicate next
to each entry on the enclosed Report of Condition, a plan of correction. Said plan of correction should
detail the specific steps that will be taken and the date by which compliance should be expected.

.200 Baseboard tiles missing in front of walk-in cooler. Mold growing on the baseboard.

.200 Not testing concentration of sanitizing solution used to store the wiping cloths. The results of this testing must
also be recorded into the log book.

Staff stated that an inmate informed him that when he put a white cloth on the end of the sink faucet,the cloth

One inmate living in each of the day rooms. Inmates are escorted to the hallway bathrooms upon request.

C-55 Inmate said that sewage flows into his toilet when the toilet in the next cell is flushed.
.353 Inmate using"Maintainer," a floor buffing compound, to wash the wall in the cell. A proper cleaner or
disinfectant must be provided.
