chusetts State Police Station and Lockup in Northampton by
a representative of the Massachusetts Department of Public
Health on March 6, 1979.
The general sanitary and physical conditions were found to
be satisfactory at the time of inspection.

In accordance with Chapter 111, Sections 5 and 20 of the General Laws
id Department of Public Health Regulations "105 CMR 450.000: Minimum

icilities and Detention Centers," the Department of Public Health caused
i inspection to be made of the Hampshire County House of Correction and
al on October 19, 1979. The inspection revealed that for the most
in the staff and inmates have been able to maintain a relatively good
vel of sanitation despite the antiquity of the institution. Many of
e conditions noted in the kitchen were the same on those noted in the
evious inspection of October 18, 1978. These problems apparently were
rrected at the time but have again deteriorated. It is suggested that
routine maintenance list be developed listing those maintenance chores
at should be accomplished on a daily,weekly and monthly basis. Robert
shop, District Sanitarian at our regional office in Amherst is available
assist with this.
Assistance also continues to be offered in plan review of the proposed
facility, especially in the food storage and preparation areas.
In accordance with Section 450,404 of the here-to-fore mentioned regulations
ease indicate next to each entry the proposed plan of correction detailing
corrective steps for such action and the date by which compliance will be
sieved.

Dear Sheriff Boyle:
In accordance with Chapter 111 , Sections 5 and 20 of the General
Laws and Department of Public Health Regulation 105 CMR 450.000:
Minimum Health and Sanitation Standards and Inspection Procedures for
Correctional Facilities and Detention Centers, the Department of Public
Health caused an inspection to be made of the Hampshire County House of
Correction and Jail on November 4, 1980. While many of the conditions
noted are problems related to the antiquity of the current facility, many
are also related to poor housekeeping practices. It is again suggested
that a routine maintenance schedule be developed and followed. Depart-
ment staff is available to assist in this process.
Please indicate next to each entry on the enclosed Report of Condi-
tions a plan of correction detailing the specific steps that will be
taken to eliminate the conditions as noted.

Procedures for Correctional Facilities and Detention Centers, a repre-
sentative of this Department made and inspection of the Hampshire County
House of Correction and Jail on May 14, 1981.
The inspections revealed that the housekeeping has improved since
previous inspections. The physical components of the facility continue
however to be substandard. The previous Report of Corrections from you
notes that "Plans for new construction are in final stages and out for
bid". Subsequent information has led this Department to believe that
due to costs new construction may not take place.
In accordance with Regulation 450.404 of the here-to-fore mentioned
regulations please indicate next to each entry on this enclosed Report
of Conditions a plan of correction detailing the specific steps that will

In accordance with Chapter 111 , Sections 5 and 20 of the Massachusetts
General Laws and Department of Public Health Regulation " 105 CMR 450.000:
Minimum Health and Sanitation Facilities and Detention Centers", an inspection
was made of the Hampshire County House of Correction and Jail on January 5,
1984. The inspection was conducted by Robert Bishop, R.S. of this Department.
While it is understood that a new facility is under construction and is
expected to be occupied this summer it is essential that a high level of
housekeeping and sanitation practices be maintained. The inspection revealed
that there is a very heavy cockroach infestation in the main institution and
work release kitchen. In addition the use of common towels must be
discontinued and sanitation practices in the kitchen improved.
It is strongly suggested that a housekeeping maintenance plan be
developed for the new building prior to moving in. If you wish any
assistance in this please feel free to contact Mr. Bishop at the Amherst
office.
In accordance with regulation 450.404 of the here—to—fore noted
regulations please indicate next to each entry on the enclosed Report of
Conditions a plan of correction detailing the specific steps that will be
taken to correct the violations and the date by which complaince can be
expected.

are being inappropriately utilized as living areas for inmates.

of these facilities is prohibited. Furthermore, the
Massachusetts Supreme Judicial Court has determined their use to
be unconstitutional.
The basement area does not meet the minimum living standards
whereas it does not provide natural light, adequate emergency
egress , proper ventilation, nor properly located toilet/handwash
facilities. Use of these rooms for habitation must be
terminated.

The food service and preparation areas continue to be very
clean and well maintained. There is need however to make a few
small changes in your sanitation practices.
In accordance with Section 450 .404 of the previously

off the "big block room" does not have toilet,
handwashing or drinking water facilities within
it.
450. 119 Night soil pots are in use in the conference
room cell. These are not allowed.
450.350 The lower tier shower ceilings generally all
show varying degrees of problems such as peeling
plaster or paint. It is recommended that a
permanent solution for the moisture be
investigated.
The basement storage area off the gym is not acceptable as living
space due to the following violations:
410.341 Natural light is not available to the room.
410.342 The room is not equipped with or does not face
a window through which each inmate can see the
outside of the building.
450.380 Immediate access to at least two exits from the
room in the event of a fire is not provided.
450. 140 Adequate ventilation is not provided. The room
was completely engulfed in cigarette smoke
creating a health hazard for non-smokers.
450.321 The room was overcrowded. At least 80 square
feet of floor space for the first occupant and
60 square feet for each additional occupant
is not provided.
450.116 The location of the toilet and handwashing
facilities is greater than 75 feet from the room.

service disposable eating utensils are mixed
in display trays. Single service utensils
should be used only once and then discarded.
590.019(C) The soap and paper towel dispensers at the hand-
wash sink near the vegetable prep area are
empty. It is recommended that employees be
encouraged to use this handwash sink, along with
the more commonly used sink near the door.
Removal of this sink is not recommended.
590.014(B) (3) The knives, forks and spoons are stored in bins.
This presents possible contamination from
handling. Only the handle end of the utensil
should be presented to the employee/consumer.
It is recommended that round dishwasher baskets
be used for washing, storage and display.
*590.013(0) (10) A test kit for measuring the concentration of
the sanitizing solution is not provided. The
concentration of the santizing solution shall
be measured at least daily and any other time
it is changed. The measurement of the solution
shall be recorded and kept on file for 30 days.

a sanitizing solution between uses. They are
not cleaned and rinsed frequently in a sanitizing
solution while in use.

The inspection revealed an overcrowded facility which has
resulted in inmates being housed in inappropriate locations such
as conference rooms and a basement storage room. It is our
understanding that Reinhardt Associates is in the process of
developing the design plans to convert the basement storage area
into a living facility that meets the requirements of the
above-cited regulations.
Of additional concern is the failure of the facility to comply
with regulations titled 105 CMR 205.000: Minimum Standards
Governing Medical Records and the Conduct of Physical Examinations
in Correctional Facilities. In particular, the required
diagnostic tests are not done as part of the physical examination,
as are not Pap and pregnancy tests on female inmates.
In accordance with Section 450.404 of the previously mentioned
regulation please indicate next to each entry on the enclosed
Report of Condition a plan of correction. Said plan of correction
should detail the specific steps that will be taken and the date

It was also stated that the violations associated with the shower
stalls will be resolved and are included in the overall plan of
` correction. A tentative date for accepting bids is planned for
March, 1987. Submit architectural plans for basement storage
renovation to M.D.P.H. for written approval prior to starting
construction. This is in conformity with M.G.L. Chapter 111 ,
Section 22.

In accordance with M.G.L. , Chapter 111 , Sections 5, 20, and 21 , and 105
CMR 470.000, an inspection was made of the Northampton Police Department
Lockup by a representative of this Department on October 21 , 1987. The in-
spection revealed the following violations :
Female Cell Block
470.310 No hot water in female cell block.
470.305 The hot water supply in this area was previously turned off.
The hot water supply was turned on during the inspection.
Brown colored water was observed flowing from several hand
wash sinks when initially turned on. However, this condition
vanished after the water ran for several seconds. It is recommended
that these water lines be routinely flushed to prevent this condition.
All plumbing should be properly maintained in order to provide a
sanitary water supply in sufficient quantity and pressure to meet
the ordinary needs of the detainees.
470.102(D) Blankets kept on beds in several cells when unoccupied. Each
blanket shall be stored out of the cell in closed storage when not
in use.
470.100 FF=1 : Mattress worn and cracked.
Male Cell Block
470.305 M-1 : Hot water temperature is 166°F. Each handwash sink shall
470.309 have hot water provided within a range of 110° and 130°F.
470.405 M-2: Walls unclean.
470.100 Bed is rusty.
470.430 No automatic smoke detector system in accordance with Massachusetts
State Building Code 780 C.M.R. It is recommended that lockup
personnel confer with the local building inspector and Fire Marshall
in this matter.
We wish to call to your attention the following conditions in the cells
which could contribute to the suicide of a detainee.
1 . Toilet paper holders may provide a place for attaching a foreign object.
2. The legs of the beds may provide a spot for tying a foreign object.

3. In several cells, there are burrs on the perforated lexan which covers
the wall vents. It is recommended that these burrs be eliminated.
While these conditions are not a violation of statute or regulation, you should
be aware of their existence.
In accordance with the above-cited regulation, please provide this office
with a plan of correction within twenty-one days of receipt of this letter.
Failure to do so, or receipt of an unacceptable plan, could result in a hearing
and the closing of the subject facility.

In accordance with M.G.L. , Chapter 111 , Sections 5, 20, and 21 , and 105
CMR 470.000, an inspection was made of the Northampton State Police Lockup by
a representative of this Department on December 4, 1987. The inspection
revealed the following violations:
470.305 Hot water temperature at handsink in men's room is 144°F.
Handwash sinks shall have hot water provided within a range
of 110°F and 130°F.
Cells #1 and 2
470.407 The lower left section of the bar structures below the level
of the bed are not covered with a protective covering of high
impact transparent plastic. All cells shall have, in accordance
with Massachusetts law (M.G.L. C. 40, S. 36B) a protective
covering of high impact, transparent plastic over all bar structures
accessible to persons detained in a cell .
470.406 & Walls and floors are dirty.
470.405
470.307 Toilets are dirty. Each toilet and the surrounding area shall
be cleaned daily, when in use, with hot water and an effective
detergent disinfectant. It is recommended that a chlorine
solution of 0.5 percent free chlorine residual be used.
470.102(3) Blankets kept in unoccupied cells. Supplied blankets shall
be stored out of the cell in closed storage when not in use.
Could not ascertain if these blankets were fire retardant.
All supplied blankets shall be fire retardant.
470.430 No smoke detector system. Each lockup shall have an automatic
smoke detector system in accordance with the Massachusetts
State Building Code, 780 CMR. It is recommended that lockup
personnel confer with the local Fire Chief in this matter.

It was noted that the electronic security device to record the
times of cell checks was inoperative. Trooper Kennedy stated
during the inspection that State Police personnel are presently
recording the times of cell checks into the daily log book.
Could not determine if a written evacuation plan exists. Each
lockup should have a written evacuation plan which specifies
the route of evacuation and subsequent disposition and housing
of detainees.
We wish to call to your attention the following conditions in the cells
which could contribute to the suicide of a detainee.
Cell 1 & 2: The sharp edges on the lexan surrounding the serving opening
could possibly be used to produce lacerations . These edges should be beveled.
It is also recommended that the burrs surrounding the drilled holes on the
lexan in Cell #1 be removed.
The following structures could be used to tie a foreign object:
Cell #2: ceiling angle iron bracket.
There is a space between the stationary bar door frame and the
sliding bar door frame. A knotted foreign object could be anchored
to this area.
The 6" x 6" opening in the bar door and lexan used to serve the detainees
could contribute to the suicide of a detainee in the following ways :
a) The ledge at the bottom of this serving opening could be used to attach
a foreign object.
b) The lexan surrounding this serving opening is not tight fitting in one
corner creating a gap. This gap could be used for tying a foreign object.
c) A detainee could reach through the serving opening and attach a foreign
object to the cell bars on the opposite side of the lexan. Several of
these bars are not flush with the lexan.
d) This opening could be used to anchor a knotted object such as a blanket.
While these conditions are not a violation of statute or regulation, you
should be aware of their existence.
In accordance with the above-cited regulation, please provide this office
with a plan of correction within twenty-one days of receipt of this letter.
Failure to do so, or receipt of an unacceptable plan, could result in a hearing
and the closing of the subject facility.

Correctional Facilities and Detention Centers, an inspection was
conducted at the Hampshire County Jail and House of Correction on

taking place in these units. There must also be greater attention

forks and spoons which are designed for single use are being reused. If
plastic utensils are going to be reused they must be specifically
designed for that purpose.

The Hampshire County Jail is a regular water sampling site
for the City of Northampton. Samples are collected bimonthly and
routinely analyzed by the Board of Health for bacteriological
quality.
Over the past twelve months , twenty four (24) water samples
were collected from the Jail for analysis with the following re-
sult:
Average coliform bacteria count for this period was 0 coli
per 100 ml water sample . Therefore , the water at the jail meets
all State and Federal standards with regard to bacteriological
quality.

In accordance with Chapter 111, Sections 5 and 20 of the General Laws
and Department of Public Health Regulations 105 CMR 451 .000 : Minimum
Health and Sanitation Standards and Inspection Procedures for Correctional
Facilities, an inspection was made of the Hampshire County Jail and House
of Correction, Northampton on March 15 , 1989. The inspection was
conducted by Charles Rudnik, R.S. , accompanied by Richard Suprenant,
Director of Engineering.
General housekeeping and sanitation is good. There is need, however,
to eliminate mold growth in several shower rooms and to provide utensils
for the handling of ice. ' It is also necessary that the problem with
sewage backing up in adjoining cells within Jail Block A be investigated
and repaired.
In accordance with Section 451. 404 of the previously mentioned
regulations please indicate next to each entry on the enclosed Report of
Condition, a plan of correction. Said plan of correction should detail
the specific steps that will be taken and the date by which compliance
should be expected.

470.000, an inspection was made of the Northampton Police Department Lockup
by a representative of this Department on September 28, 1989. The inspection
revealed the following violations:
470.305 Male cell #6. 158° F. recorded for hot water at handsink. This
represents a potential for scald injuries. The proper range is
110°-130° F.
Could not ascertain if a written evacuation plan exists. Each
lockup should have a written evacuation plan which specifies the
route of evacuation and subsequent disposition and housing of
the detainees.
470.102(3) Blanket kept in the following unoccupied cells: Female #2, Male
#2 and Juvenile cell.
Notes: Male #8: Three lag bolts with nuts installed to replace three
original lexan anthor bolts.
Male #4. Four lag bolts with nuts installed to replace four
original lexan anchor bolts.
Male #6: Three lag bolts with nuts installed to replace three
original lexan anchor bolts.
The above-mentioned lag bolts have been installed to replace
several original lexan anchor bolts which would not stay in
because the drilled holes through which these original anchor
bolts passed have become oversized.
Female #1: It is recommended that the burrs around the drilled
holes in the lexan covering the fan be removed.
470.352 Juvenile cell: One corner of the grill covering the heating
unit located on the ceiling is not firmly attached to the
ceiling. Four screws are missing from this area of the grill.

Failure to do so, or receipt of an unacceptable plan, could result in a

In accordance with M.G.L. , Chapter 111, Section 5, 20 and 21 and 105 CMR 470.
000, an inspection was made of the Northampton State Police Lockup by a repre-
sentative of this Department on November 8,
1989. The inspection revealed the
following violations:
470.305 Hot water temperature at handsink in bathroom off hallway is 136°F.
To prevent scald injuries, the hot water must be provided within a
range of 110°-130°F.
CELLS #1 and #2
470.407 The lower left section of the bar structures below the level of the
bed are not covered with a protective covering of high impact trans-
parent plastic. These bar structures are accessible to the detainees.
6" x 6" Serving Window Opening
470.407 6" x 6'I opening in bar door and lexan halfway up on sliding door bar
structure. A detainee could reach through this opening and attach a
piece of clothing to the bar structures on the exterior side of the
cell on the stationary side. These bars are not flush to the lexan
and are accessible to the detainee. This 6" x 6" opening can also
allow a detainee to reach through this area and attach a piece of
clothing to the ledge just below the serving window. This opening
could also be used to attach a knotted object such as a blanket.
All cells shall have in accordance with (M.G.L. C.40, S.36B) a pro-
tective covering of high impact, transparent plastic over all bar
structures accessible to persons detained in a cell.

In accordance with Chapter 111, Sections 5 and 20 of the General Laws
ad Department of Public Health Regulations 105 CMR 451.000: Minimum
Dalth and Sanitation Standards and Inspection Procedures for Correctional
scilities, an inspection was made of the Hampshire County Jail and House
E Correction on March 31, 1990. The inspection was conducted by Charles
adnik, accompanied by Lt. Haskell.
The inspection revealed that there continues to be misuse of the
everal ice chests throughout the facility in that ice is removed without
he required scoop and food products are inappropriately stored in some of
he chests. Other conditions which continue to exist that have been
reviously cited include inadequate hot water and mold growth in the
hower facilities. Also of concern is the inadequate temperatures of the
ood in the styrofoam containers in the hot holding unit. Potentially
azardous food for serving must be maintained at 140°F. or greater.
In accordance with Section 451 . 404 of the previously mentioned
regulations please indicate next to each entry on the enclosed Report of
tradition, - plan of correction. Said plan of correction should detail
he specific steps that will be taken and the date by which compliance
hould be expected.

In accordance with Chapter 111, Sections 5 and 20 of the General laws and
Department of Public Health Regulations 105 C[d!R 451.000: Minim= Health and
Sanitation Standards and Inspection Procedures for Correctional Facilities, an
inspection was made of the Hampshire County Jail and House of Correction on November
13, 1992. The inspection was conducted by Charles Rudnik, acocapanied by Charles
Rudnik, acoapanied by Robert Hcdgen
This is a need to improve sanitation and food handling practirPS in the kitchen
area. It was also noted that there is inadequate hot water temperatures in the
House Block.
In accordance with Section 451.404 of the previously mentioned regulations
please indicate next to each entry on the enclosed Report of Condition, a plan of
correction. Said plan of correction should detail the spe.ific steps that will be
taken and the date by which compliance should be expected.

cooling period shall not exceed four
(4) hours.
It is unlikely that due to the volume of sauce and
that the sauce would have cooled to 45°F. or below
within 4 hours given the volume of sauce and size of
pane.

The discharge end of the hose
terminates in the mop sink. Tb prevent
any mixing of the phosphoric acid with
the bleach, it is reccxmnended that a
separate line be provided for the
trough under the bleach and run
directly to the mop sink drain. Mixing
of these chemicals will create a toxic
gas.
