This letter will certify that the inspections revealed violations listed below, which are serious enough as to endanger or materially impair the health, safety, and well-being of the occupants Under authority of Chapter III, Section 127 of the Massachusetts General Laws, and Chapter II of the State Sanitary Code, you are hereby ordered to make a good faith effort to correct the following violations within TWENTY FOUR HOURS of the receipt of this order. JLATION 01, 00, & 01 VIOLATION REMEDY Inadequate heat throughout the apartment, largely due to missing or defective heat facilities and very poor primary windows which are not weathertight and through which there is excessive heat loss. The following areas either lacked heating facilities or were defective: Bedroom (off living room} Radiator cold. Not operational. Temperature 54.7° F Bedroom Right(off hallway) Radiator cold. Not operational. Temperature 58.0° F Bedroom Left(off hallway) No heating facility provided. Temperature 55.5° F Bathroom No heating facility provided. Temperature 59.0° F Provide operational heating facilities in bedroom (Left) (off hallway) and the bathroom where there currently are no heating units. Repair or replace radiators in the bedroom (off living room) and the bedroom (Right) (off hallway) which were cold at the time of inspection. Take immediate action to eliminate excessive heat loss. Repair all prime windows throughout the apartment in a manner which will render them weathertight. Of utmost importance here is to be able to seal up the air gaps between the sashes in a manner which will render them weathertight but still keep their functionality. Recommendation: If the two window sashes can be properly aligned, "half-moon" shaped locking mechanisms sometimes do an adequate job in tightening up air gaps between sashes and reducing rattle. Living room, kitchen and bedroom (off kitchen) radiators were operational at the time of investigation. However, room temperature readings were inadequate. Living room temperature 61.8° F Kitchen room temperature 57.3° F Bedroom (off Kitchen) Temp. 60° F Apartment thermostat setting was 68° F and HOLD readings ranged between 56° F to 59° F while the inspection was conducted. Prime windows throughout the apartment were not weathertight as there was considerable rattle and a large air gap between each window's two sashes. Most locking mechanisms were either not operational or ineffective in stopping the rattle or sealing up the gap between sashes These air gaps alone can account for tremendous heat loss throughout the apartment. This letter will certify that the inspections revealed ons listed below, which are serious enough as to endanger or materially impair the health, safety, .t.11-being of the occupants. rCLE H 410.000 VIOLATIONS MINIMUM STANDARDS OF FITNESS FOR HUMAN [TATION, AND/OR CHAPTER 111, SECTION 122-127, ABATEMENT OF iANCES,AND SECTION 127L, OF THE MASSACHUSETTS GENERAL LAWS: The ambient air temperature in the apartment on this date at 2:00a.m.was 44 degrees Fahrenheit.According to the tenant the furnace in the cellar is not on or operating. A caretaker who lives in the apartment below tried to restart it, but to know avail. This is a very serious situation since the outdoor temperatures will be getting in the double digits this evening. ORDER: Restore the heat in the apartment WITHIN IN 24 HOURS (by 4:00a.m., Thursday, 02/24/05) in order to provide heart as required by this section of the code.NOTE: Ambient room temperature must at least 68°F (20°C) between 7:00 A.M. and 11:00P.M. and at least 64°F (17°C) between 11:01 P.M. and 6:59 A.M. every day other than during the period from June 15th to September 151h, both inclusive, in each year except and to the extent the occupant is required to provide the fuel under a written letting agreement. The temperature shall at no time exceed 78°F (25°C) during the heating season. State Code requires: )L: Temperature Requirements The owner shall provide heat in every habitable room and every room containing a toilet,shower.or bathtub to at least 68°F (20°C)between 7:00 A.M.and 11:00 P.M.and at least 64°F(17°C)between 11:01 P.M.and 6:59 A.M.every day other than during the period from lune 15s to September 15th,both inclusive,in each year except and to the extent the occupant is required to provide the fuel under a written letting agreement. The temperature shall at no time exceed 78°F (25°C) during the heating season. The temperature may be read and the requirement shall be met at a height of five feet above floor level on a wall any point more than five feet from the exterior wall. The number of days per year during which heat must be provided in accordance with 105 CMR 410.000 may be increased or decreased through a variance granted in accordance with the provisions of 105 CMR 410.840 not withstanding the prohibitions of the first clause of the first sentence of 105 CMR 410.840(A). 91: Weather tight Elements (A) A window shall be considered weather tight only if: (I) all panes of glass are in place,unbroken and properly caulked;and (2) the window opens and closes fully without excessive effort;and 13 (4) one of the following conditions is met: (a) a storm window is affixed to the prime window frame, with caulking installed so as to fill exterior cracks between the storm window frame and the prime window frame;or (b) weather stripping is applied such that the space between the window sash and the prime window frame is no larger than 1/16 inch at any point on the perimeter of the sash, in the case of double hung windows and 1/32 inch in the case of double hung windows and 1/32 inch in the case of casement windows. (c) the window sash is sufficiently well-fitted such that, without weatherstripping, the space between the window sash and the prime window frame is no larger than 1/16 inch at any point on the perimeter of the sash in the case of double hung windows and 1/32 inch in the case of casement windows. 11: Weather tight Elements (Can't) (B) An exterior door or a door leading from a dwelling unit to a common passageway shall be considered be weathertight only if: (1) all panes of glass are in place, unbroken and properly caulked; and (2) the door opens and closes fully without excessive effort; and (3) exterior cracks between the prime door frame and the exterior wall are caulked, and (4) one of the following conditions is met: (a) a storm door is affixed to the prime door frame,with caulking installed so as to fill exterior cracks between the storm door frame and the prime door frame;or (b) weather stripping is applied such that the space between the door and the prime door frame is no larger than 1/16 inch at any point on the perimeter of the door or (c) the door is sufficiently well-fitted such that,without weather-stripping, the space between the door and the prime door frame is no larger than 1/16 inch at any point on the sides of the door or 1/8 inch at any point on the top or bottom of the door. (C) a wall, floor, ceiling or other structural element shall he considered weather tight only if all cracks and spaces not part of heating, ventilating or air conditioning systems are caulked or filled in as to prevent infiltration of exterior air or moisture. The ceiling has water stains. There appears to be a water leak. The bricks on the wall have black mold growth. ORDER: Find and repair leak. Paint water stain on ceiling. Sanitize and eliminate mold growth on wall. (Correct by March 15, 2005.)
