This letter will certify at the inspections revealed violations listed below,which are serious enough as to endanger or materially impair le health, safety, and well-being of the occupants. RTICLE II 410.000 VIOLATIONS MINIMUM STANDARDS OF FITNESS FOR HUMAN rABITATION, AND/OR CHAPTER 111, SECTION 122-127, ABATEMENT OF TUISANCES, OF THE MASSACHUSETTS GENERAL LAWS : XTERIOR OF PREMISES: i00 & 602 Several trash containers with no lids. Containers are not watertight receptacles. Garbage, trash and other debris scattered on wound. Several trash bags on the ground. This situation is an attractive area for animals and it is easy for them to get in the trash and scatter it. ORDER: Provide a sufficient amount of trash cans for tenants. ALL TRASH STORAGE CONTAINERS MUST HAVE LIDS Clean area around trash storage site. CORRECT VIOLATION IMMEDIATELY AND NOTIFY THIS OFFICE AT 587-1213 WHEN CORECCED. (Correct by August 17, 2007.)(Please read the copy of this regulation is below) 410.600: Storage of Garbage and Rubbish (A) Garbage or mixed garbage and rubbish shall be stored in watertight receptacles with tight-fitting covers. Said receptacles and covers shall be of metal or other durable, rodent-proof material. Rubbish shall be stored in receptacles of metal or other durable,rodent-proof material. Garbage and rubbish shall be put out for collection no earlier than the day of collection. (B) Plastic bags shall be used to store garbage or mixed rubbish and garbage only if used as a liner in watertight receptacles with tight-fitting covers as required in 105 CMR 410.600(A), provided that the plastic bags may be put out for collection except in those places where such practice is prohibited by local rule or ordinance or except in those cases where the Department of Public Health determines that such practice constitutes a health problem. For purposes of the preceding sentence,in making its determination the Department shall consider, among other things, evidence of strewn garbage, torn garbage bags, or evidence of rodents. (C) The owner of any dwelling that contains three or more dwelling units, the owner of any rooming house. and the occupant of any other dwelling place shall provide as many receptacles for the storage of garbage and rubbish as are sufficient to contain the accumulation before final collection or ultimate disposal, and shall locate them so as to be convenient to the tenant and so that no objectionable odors enter any dwelling. (D) The occupants of each dwelling unit,and rooming unit shall be responsible for the proper placement of his garbage and rubbish in the receptacles required in 105 CMR 410.600(C)or at the point of collection by the owner. 3E3 !(a) Overgrown vegetation along the property lines and around sides of both buildings. Board members determined That the applicant's renovations and the addition of an on-Site,experienced manager have improved conditions in the neighborhood and resulted in the cessation of previous illegal uses. Zoning Board Members present and voting were: chair M. Sanford Weil, Jr. , Alex Ghiselin and Elaine Reall. The Findings of the Board under Section 9.3 (1) (D) and 9 3 (2) (B) for an alteration of a Pre-existing non-conforming structure and for a change in use of a non-conforming structure on a non- conforming lot were as follows: 1. The Board found that the alteration and change in use will not be substantially more detrimental to the neighborhood than the existing non-conforming structure and use. Board members determined that, although many problems have resulted because of the past uses of the property, the applicant's plans to upgrade the building and convert it into four apartments will improve the conditions in the neighborhood. The applicant's proposal to subdivide the existing large second-floor apartment into two smaller apartments will result in a more orderly, controlled living arrangement. In addition, the regulated, legal use of the building as apartments will insure that illegal uses of the building will cease. 2. The Board found that the alteration and change in use of the non-conforming structure on a non-conforming lot will not create a new violation of the existing zoning requirements because the alteration will not change the footprint of the existing building, and the change in use is to a conforming use which requires the same or less minimum lot area, minimum lot width and frontage, minimum lot depth, setbacks, and parking than is required for the present use. Conditions imposed with this Finding are as follows: 1. As proposed by the applicant, an erperienced property manager shall reside on the property as a condition of this permit and have the authority to resolve problems vith abutters. 2. The name and phone numbers) of the property manager shall be submitted to the Building Department prior to the issuance of a Certificate of Occupancy. These numbers shall insure access to a "live" person rather than a machine in case of a problem. A dumpster shall be placed on the property and adequately screened. 4. The dumpster shall be in place and verified by the Building Commissioner prior to a Certificate of Occupancy being issued. 5. if the applicant chooses to provide on-site parking, a plan showing the location of parking spaces shall be submitted to the office of Planning a Development to become part of the file. 6. The permit shall expire one year from the date of issuance of the Occupancy Permit and shall be required to be renewed.
