Thanks for emailing. If you see the system overflowing, you should contact the DPW immediately d ring
business hours at 587-1570 or on weekends and nights call 413-587-1100 and have the emergency sewer
personnel called so that we can document what is going on. I inspected the property this morning and did not
notice an overflow at the time and nobody was home.
I have not heard back from the Martin Carrara yet. I noticed that the owner of the property is Michelle Carrara
whom I cannot find a phone number. I am checking with the contractors who had been working on the problem
in the past to find out if they know what the plan is. The DPW has investigated the issue in the past and
determined that the problem is outside the City's sewer system. The DPW has provided information to two
different contractors regarding where a new sewer service can be connected to the system. The Cty owns
and maintains the sewer collection system in the roadway, but it is the responsibility of the property owners to
maintain the connection on private property. If a property owner does not repair a service, I have not found any
language in the City's Sewer Use Ordinance that gives the DPW the power to enforce the correction of sewer
problems on private property.
I have copied Merridith O'Leary at the Northampton Health Department on this email since this is a public
health issue and the Health Department may have more power to enforce this.
I understand that your frustration and III let you know when I hear more.

Hi Daniel,
The DPW has responded directly to problems and investigated the situation and informed the contractors that
the City system was working and that the owner needed to fix the service. The DPW has been contacted by a
couple of different contractors since last winter to get information about the sewer system in the roadway and
they were told how they could connect. There is a sewer line directly out in Nonotuck St. We have had no
contact yet with the owner.
The history of the problem as I understand it is this:
-The sewer service from 201 Nonotuck St runs across a corner of the property of 205 Nonotuck St to the
sewer main out in Nonotuck St. I could not find an easement mentioned in the deed.
-205 Nonotuck St was recently renovated including a new driveway and perhaps a new fence along the
property line with#201.
-This past winter(and perhaps earlier)#201 had problems with backups of the sewer
-DPW investigated and found the sewer main in the roadway open and clear and communicated that the
problem was on private property
-Fletcher Sewer& Drain was involved and may have more information about what the problem is. I talked to
Dave at Fletcher this morning and he is getting back to me.
-Some repairs were completed at some point and a clean-out was installed in the grass of#201
-The repairs did not seem to work and the sewer apparently still overflows from the cleanout
4201 claims that when the renovations were done at#205, the contractor working on the driveway may have
broken the service
4205 wants#201 to fix the problem
I'll let you know if I hear more information.

Chris Bishop our department Inspector did an inspection of the property at 201 Nonotuck Street and did not
find any evidence of sewage back-up (effluent ponding, surface flow odors, etc.). Please let us know if

Alyx Akers who owns 205 Nonotuck Street has contacted the DPW at least 2 times to complain of overflowing

am aware of another incident on 4/20/16. The problems seem to occur on the weekend and have possibly
involved removal of the cap of the clean out at 201 Nonotuck allowing the sewage to flow out of the structure
and across the grass to 205 Nonotuck
The DPW can issue a violation notice if the sewage is discharged to the drain system, but we have not
witnessed this yet and therefore have no asis for a violation.
I would recommend that somebody from the Health Department talk to Alyx Akers and determine how to
proceed based on the information she can give you. Until the connection is fixed, the overflows will likely
continue and AIy?s property will be impacted. A letter to the property owner of 201 Nonotuck seems in order
and should probably come from the Health Department since the ability to enforce this is more based on impact
to public health.

I received your voice mail this morning. The Health Department will be sending out correction orders giving
them 30 days to comply.
What would be helpful is for us to actually see evidence of breakout on your property. However, because it is
only intermittent breakout this might be difficult to capture during our work hours in the near future.
Nonetheless...we will proceed with sending out orders to correct in hopes that they will not challenge them.
Please call the Health Department 587-1215 the next time you have effluent on your property so we may
document the event.

that is the case
It was indicated to me that the neighbor would be directed to move the connection to his property and the
access to the cracked line under my driveway would be capped and abandoned.

Attached are two photos that should help illustrate the issue that we've been emailing about.
In February, Mr Carrera, owner of 201 Nonotuck, came to my door and shared with me that his sewer line had
been backing up into his basement and drains since sometime last summer. He said that he was unable to run
dishwasher, shower and washer at the same time because that would cause the backup. He came over to
share this, he said, in the hope that I might be experiencing the same issue and the cost of repair could be
shared.
We bought 205 Nonotuck at the end of August 2015, after Mr. Carrera has been experiencing his backup(s).
The house we bought was renovated b the contract that we bought it from, and I understand from his that we
do not share a sewer line with Mr. Carrera. Our cleanout is in front of our house, and we have not experienced
an such issues.

In Spring of this year, I came out of my house to go to work around SAM, and I smelled the overwhelming
scent of sewage. I noticed that it was originating from the area of Mr. Carrera's cleanup, and seeping under
my fence (next to Mr. Carrera's property) and down my driveway. I called the DPW and they came out and
washed it down.
I followed up with Mr. Carrera at the time of the incident (by phone), and later that day when no action had
been taken. He finally had Fletcher Sewer and Drain come out to put a camera down the line. He called me
and put me on the phone with the technician who asked if he could mark the spot on my driveway where the
line was cracked. I said yes, not really knowing what else to do.
I have since followed up with Mr. Carrera to understand his plan of action for capping the line that goes under
my driveway, and running a new line on his property straight out from his cleanout area. He has directed me to
assistant to "deal with it," as well as indicating that it is"not his problem." I wouldn't ordinarily reach out for
assistance in this way, but I can't think that the current issue is healthy, or acceptable by City standards. I feel
like I have been patient enough in waiting for him to create a plan of action. We don't feel like it's a safe or
healthy environment. As you can imagine, we don't really want to be out in the driveway or on that side of the
yard because it seems unsanitary, and quite smelly on certain days.
Thanks for any help that you can provide. I greatly appreciate your getting back to me and addressing the
issue with Mr. Carrera.

I called Fletcher Sewer and Drain to ask if they would forward a copy of their findings from the Spring of this
year, but they said that they would have to ask for Mr. Carrera's permission to release that to me. I don't see
