Complaint Records 1978-1990 October 30, 1978 Mr. George O'Brien Northampton Housing Authority 49 Old South Street Northampton, Mass. 01060 Dear Mr, O'Briens At the request of Mr. Bruce Rule, of #16B Hampshire Heights Apartments, owned by the Housing Authority, our office conducted an inspection on October 30, 1978. Our inspection revealed that there has been sole recent water damage throughout the apartaent. The master bedroom ceiling is cracked and stained along with the living room ceiling. There are several walla where the paint and the plaster has fallen off or buckling due to excessive moisture in the walls. Since Mr. Rule stated he had not been living in the apartment and he was moving out this week, the Board of Health doss not require the repairs to be made immediately, but we do require the necessary repairs to be made before the apartment is re-occupied. This is the first time that I have encountered a cockroach in the apartment. I know what cockroaches look like, and there is no doubt in my mind that this was one. I hope that you will fumigate the building as quickly as possible before they can get a good foothold here. Incidentally, twice now I have asked that the door gasket on the refrigerator in my apartment be replaced, once on the telephone to Jay Marrone two months ago and by note enclosed with February's rent. So far these requests have been ignored. The gasket on my refrigerator is soft and mushy, as well as tearing in the upper right-hand corner. I think its time for a replacement. If this is not something you do, then please so inform me so that I can try to replace it myself. The space in question has three sides exposed, and also a floor that is over an open porch. The heat loss in this space is much greater than the heat loss in any other space in the apartment. The thermostat is located in the living room, therefore, which is a much more protected area and therefore requires less heat to satisfy the space than the upstairs bedroom does that is exposed on three sides. We recommend that an electric baseboard heater with integral thermostat be installed in this area. This would allow the tennant to select whatever temperature is required for this space independent of the central system. This will entail the installation of a new circuit for the heater. The heater should be installed under the windows. Kochan, Sanitary Inspector Northampton Board of Health Inspection of the Dwelling at 14A Hampshire Heights BOARD OF HEALTH 210 Main Street - City Halo Northampton, MA 01060 February 2 , 1989 On the afternoon of February 1 , 1989 I received a call from a Jean Irizarry, tenant at 14A Hampshire Heights . She told me that her apart- ment had been ransacked and was no longer in a habitable condition. I followed this conversation up with a call to NHA Maintenance Super- visor , Richard Chmura, and we made arrangements to inspect the premises on February 2 , 1989 . At 10 :00 a.m. , this date , I inspected the dwelling unit at 14A Hamp- shire Heights to determine the unhabitability as Jean Irizarry had suggested. I was accompanied by Mr. Chmura who took some pictures of the conditions that we encountered upon entering the unit. The apartment was found to meet minimum standards of fitness under 105 CMR 410 .000 and no violations were found which would indicate a lack of maintenance on the part of the Northampton Housing Authority. However, general sanitation and reasonable tenant care and use of the structural elements and owner-provided equipment was found to be ex- tremely poor at this time . All habitable rooms , including stairwells and the basement were found to be littered with assorted trash, mixed refuse, and soiled clothing , all of which were strewn about haphazardly. In the kitchen, soiled dishes, food waste , and leftovers were piled up in the sink and on the counters . The internal cellar door to the basement had been smashed and removed from the door frame. The remnants of the door was left on the living room floor. Shattered glass from a broken living room window still remains on the living room floor, although the NHA has already replaced the the previously shattered window. It is clear that no attempt has been made by occupant( s ) to clean up this apartment for a lengthy period of time. In light of the conditions found and the tenant' s failure to meet the requirements set forth under 410 . 352 (B) and 410. 505 of the State Sani- tary Code II , "Minimum Standards of Fitness for Human Habitation" , I strongly recommend that the Northampton Housing Authority take whatever action is required to remedy the conditions found at 14A Hampshire Heights , including tenant eviction proceedings if this is what it will take to abate said conditions . cc: Jean Irizarry Mary Lou Gerbasi TO: FROM: SUBJECT: DATE: MEMORANDUM Northampton Housing Authority ATTN: George J . Under authority of Chapter III General Laws , and Chapter II of hereby ordered to make a good following violations within of this order: REGULATION 410 .600 & 410 .602 (B) , Section 127 of the Massachusetts the State Sanitary Code, you are faith effort to correct the FOURTEEN DAYS of the receipt VIOLATION Insanitary conditions noted throughout the apartment. Heavy accumulation of assorted refuse , junk & debris strewn about making access to some areas of the apartment very difficult. Accumulated items include empty bottles, cans, waste paper, bags , rags, garbage, and soiled clothing and boxes containing unknown items . REMEDY Completely clean up all areas of your apartment by removing all refuse and unnecessary junk and debris. Clean soiled clothing and properly store them. Organize apartment in a manner which will allow easy access to all areas and which will allow for the apartment to be maintained in a sanitary condition in the future . General housekeeping and sanitation in this apartment is extremely poor and conditions are such that it is impossible at this time to properly maintain the premises . These conditions are a major reason that this apartment presently has a severe cockroach problem which has spread to neighboring apartments. Although notified well in advance by the Housing Authority to prepare the apartment for cockroach extermination, occupants did not properly do so and only a partial treatment could be applied by "Rest in Peace" Exterminators on January 31 , 1990, the day of my inspection of the premises. Said conditions are severe enough to be detrimental to both the occupants of your apartment and all other tenants in building #5 . Note also that an order to correct similar conditions was since previously (Abatement Order dated December 15, 1987 ) . At that time you were ordered to cleanup the premises and, in the future , maintain them in a sanitary condition. If upon reinspection said conditions have not been corrected, or if, in the future, said conditions occur again, the Board of Health will have no choice but to recommend to the Housing Authority that they begin eviction proceedings against you. A reinspection of the premises will be made on February 22 , 1990 to insure that these conditions have been corrected.
