If Miss Lasonde or her relatives fail to clean the premises, the
oard of Health may do so and charge the costs to Miss Lasonde. The Board
ay declare the situation an emergency or follow the standard procedures
or enforcing compliance with an order of the Board.
If the Board feels an emergency exists it may issue an order,
without notice , or hearing, to the owner to take certain action.
The order must specify a time limit for such action. If there is no
compliance, the Board will then proceed as outlined in Section C.
;, If the Board does not feel this is an emergency situation,
then it should follow the procedure outlined in Section 410.831 of
the State Sanitary Code. After notice to the owner, the finding by
the Board that the premises are unfit for human habitation, and a
public hearing, the Board may issue the order to clean the premises
by a certain date. If there is no compliance, it may proceed as
outlined in Section C.
C. If the Board undertakes the cleaning of the premises it should
proceed as follows:
1. Obtain several estimates from contractor's for the cleaning
services. The Board is technically spending the violator's money so
it should be able to show it made a reasonable effort to obtain a
competitive price. This is also a City contract and so should
follow all city procurement requirements.
2. Request an appropriation from the City Council for the cost of
the cleaning.
3. After receiving the appropriation, enter into a contract for
the services. Get itemized bills for the services rendered. Keep
the bills or copies of them in the case file.

4. After the cleaning is complete and the bill paid, a lien will
be placed on the property for the cost of the services. Time is
essential since the lien must be filed in the Registry of Deeds
within ninety (90) days of the date of completion of the services.
We will prepare and file the lien when the Board supplies us with
the final cost.
5. After the lien is filed, the Board must commit the lien to the
Tax Collector who will then add it to the next tax bill .
