McErlain, Health Agent February 8, 1982 PHONE 584-1287 AREA CODE 413 R33 I 1 I [ OHTHA MPTONao 00'HL Dear Members of the Board of Health : I am in receipt of your order to correct violations of Chapter 2 of the State Sanitary Code regarding the third floor apartment at 117 State Street, Northampton, Massachusetts. Pursuant to 105 CMR 410. 850, I hereby appeal your order, and request a hearing on the matters contained therein. However, I feel a hearing on this matter may not be necessary considering the circumstances now existing at the building. I plan extensive renovation of the building, including the third floor. The third floor apartment will be converted into three apartments and dual exits will be provided for each such apartment. When I purchased the building, there were two tenants in the third floor apartment, Robin Robatore and Mary Lewis. I started eviction proceedings against both tenants, and obtained a default judgment against Mary Lewis and execution for possession against Robin Robatore. Mrs. Lewis has appealed the Judgment of the District Court to the Superior Court; at this time, however, she is only using the apartment, pending the outcome of her appeal and no tenancy exists. Until she leaves the building, however, I cannot proceed with my plans to renovate the apartments, nor can I take the necessary steps to correct the egress problem you mentioned in your order. As soon as she does leave, construction can begin to correct this problem. As to the floor boards in the main bedroom, which you mentioned in your order, Mr. McErlain told me in my phone conversation with him of February 5, that all that was needed was to install a two by four underneath a portion of the floor. I shall see that this is done in the very near future.
