',e building is at 5-217 State St (corner of State and Finn) . This is a very busy intersection. For over 30 ars the dumpster has been on State St, which is the only place on the property where it an be, and that requires that the huge trucks back out onto State. Because of the obvious afety issues, Waste Mgtmt has always gotten there early in the morning, between 6:00 and :00. Apparently a neighbor has now complained about violation of a noise ordinance. The trance thing is that this neighbor does not even live close to the building. She lives on ce next street. People in the adjacent house, which is immediately next to the dumpster, ave never complained. But Waste Mgtmt has now apparently been told that if they pick up efore 7:00, the driver will be fined. So they have told me that they cannot any longer ervice the building because they will not subject the driver and the public to the risk f backing out onto State after 7 :00 am. So what do I do? who called the Police Dept, he dumpster obviously has to be picked up. I called the DPW, and I nd both of them. said that it was not them. They said that it is a zoning issue, heuid contact you. Hopefully common sense will prevail. As such pick up time should be after 7am as this is residential zone. The exception to zoning is that if area is zoned business or industrial they can pick up at any time. I will call Waste Managment,we gave a zoning map to the trash haulers so they should know which districts are residential or business. I did call Jim Caminiti at Waste Managment and they will correct this, please let me know if it occurs again. She is under the impression that since this is zoned residential that the dumpster should not be emptied until 7:00am. or later. She said she called Waste Management(413-374-1913)and spoke to a person by the mane of Jamie who told her that there is a state law allowing this which overrides local ordinance. Is this correct?
