Dear Mr. McErlain:
I am writing this letter on behalf of Mr. &Mrs Charles Labbee of 165 Sylvester Road in
Northampton. The Labbee's are considering adding a one-bedroom mother-in-law
apartment to the existing 3-bedroom dwelling. The proposed unit will not have a garbage
disposal.
The current sewage disposal system was designed for a 3-bedroom house (110 gals. /
bedroom) with a garbage disposal, ie: 495 gallons per day of wastewater. In actuality,the
current system was over designed and has a design load of 511.99 gallons per day.
On Sunday September 23,2001,I conducted a subsurface sewage disposal system
evaluation at this site for the purposes of determining the operating condition of the
system. This evaluation was not a complete Title-5 inspection as required for a Real
Estate transfer.
The system includes a 1500-gallon septic tank with inlet and outlet tees. There is a
distribution box and 4 leaching trenches @(36'L X 3'W X .833'H) each. Please refer to
the approved plan in your office.
Upon arrival I observed no sewage breakout nor did I detect odors emanating from the
system. As part of the evaluation the distribution box was uncovered to verify the
condition of the inside and inspect the outlet pipes. I observed no carry over of waste
solids and determined that the distribution box is in sound condition without infiltration
or exfiltration. The effluent level at each of the four outlet pipes was even with the invert
of each pipe. Therefore,I must conclude that this system is operating in a manner in
which it was designed.
Inasmuch as this disposal system has the capacity to handle a four-bedroom house
without a garbage disposal (ie: 511.99 GPD) and on behalf of Mr. and Mrs. Labbee,I am
requesting that they be allowed to construct the proposed mother-in-law apartment.
Please be aware that Mr. Labbee has assured me that he will remove the existing garbage
disposal and is also willing to place a deed restriction on the property. A copy of said
restriction will be submitted to your Board for your records. It will limit this site to a
four-bedroom house without garbage disposal.

Dear Board Members
The purpose of this letter is for you to review the original permit
for the current septic system design at 165 Sylvester Road, to be
revised to accommodate the proposed addition with a bedroom
without a garbage disposal in either the existing house or the
addition. When completed there would be 4 bedrooms total. We
would also place a restriction on the deed that a garbage despoil
could not be added when sold. Enclosed you will also find a letter
supporting this revision from Tim Maginnis. Also enclosed is a
drawing of where the proposed addition would be.

On September 24,2001,the Northampton Board of Health reviews your request for approval of the construction
of a one bedroom addition to your dwelling at 165 Sylvester Rd. while utilizing the existing subsurface sewage
disposal system.The proposed addition will bring the total number of bedrooms to four(4).
The existing septic system plan on file with the Board of Health indicates that your septic system has a design
capacity of 511 gal. of sewage per day.This system will accommodate the daily sewage flow from a four(4)
bedroom home without a garbage grinder which(daily flow would then be only 440 gpd).
The Board of Health voted to approve your request based on the inspection report from Registered Sanitarian
Timothy Maginnis and your intention to remove your existing garbage grinder.
This approval is subject to the removal of the existing garbage grinder and the filing of a restriction on your
property deed at the Hampshire County Registry of Deeds office which prohibits the future installation of
another garbage grinder.A copy of the deed restriction from the Registry of Deeds must be submitted to this
office.

Basile) and state:
WHEREAS, they are the owners of real property situate at 165 Sylvester
Road, Northampton. Hampshire County, Massachusetts, described in
Hampshire: Registry of Deeds at Book 2311, page 291; and
WHEREAS, in order to construct an addition to the existing house on the
above property it is necessary to restrict the future installation of a garbage
grinder.
NOW THEREFORE, the undersigned hereby state that without permission
from the Board of Health of the City of Northampton. no garbage grinder
may be ill/ailed onto the existing septic disposal system servicing the house
on the above property.
