Dear Occupant:
An authorized inspection was made by myself as designee of the Northampton Health Department of
your residence located at 137 High Street, Unit M111, Northampton, MA on 12/20/2012.
The landlord has been cited for a violation of the State Sanitary Code, and has been ordered to make
repairs within 30 days of the date of notice of the violation (a copy of those Orders to Correct are
enclosed). As an occupant, you are required to give access for repairs to the owner or his designee.
Here are relevant sections of the code:
410.810:Access for Repairs and Alterations
Every occupant of a dwelling, dwelling unit,or rooming unit shall give the owner thereof, or his agent or
employees, upon reasonable notice, reasonable access, if possible by appointment,to the dwelling, dwelling
unit, or rooming unit for the purpose of making such repairs or alterations as are necessary to effect
compliance with the provisions of 105 CMR 410.000.
410.900:Penalties for Interference with Inspections
Any owner,occupant, or other person who refuses, impeded, inhibits, interferes with, restricts or obstructs entry
and free access to every part of the structure, operation or premises where inspection authorized by this code
is sought after a search warrant has been obtained and presented in accordance with 105 CMR 400.100(C),
shall be fined upon conviction not less than ten nor more than$500.00.
Best practice, especially in the case of a violation involving chronic dampness, means giving the owner
an opportunity at the earliest opportunity to make repairs. My surficial inspection showed dampness of
the sheetrock surfaces but did not allow judgement about possible issues within the framing cavities. It is
important that the owner be allowed to diagnose the extent of damage so appropriate repairs can be
made.
If you have questions please call our department; otherwise it is imperative that you facilitate the repairs
to your apartment.

You have a right to request a hearing before the Board of Health. This request must be made by you, in
writing, and filed within 7 days after the violation has been corrected. If you request a hearing, all
affected parties will be informed of the date, time, and place of the hearing, and of their right to inspect
and copy all records concerning the matter to be heard. The petitioner has the right to be represented at

Every owner shall maintain the foundation,floors,walls, doors,windows, ceilings, roof, staircases, porches,
chimneys, and other structural elements of his dwelling so that the dwelling excludes wind, rain and snow, and
is rodent-proof,watertight and free from chronic dampness,weathertight, in good repair and in every way fit for
the use intended. Further, he shall maintain every structural element free from holes, cracks, loose plaster, or
other defect where such holes, cracks, loose plaster or defect renders the area difficult to keep clean or

Dear Ms.Vega:
In compliance with the Board of Health Correction Order dated
December 31,2012, a copy of which was mailed to you by the Board of Health,members
of the Maintenance staff will be at your apartment to perform the repairs needed in your
bathroom on:
Monday,January 7,2013 at 9:00 A.M.
You do not have to be home while we make these repairs. The repairs consist of
removal of any damaged sheetrock and replacement of that material,and painting. We
need to wait a day or two until the joint compound dries before we return and paint the
areas repaired.
