RE: Board of Health Order to Clean Up Hall
Dear Mr. Fabrocini:
I am the attorney for the Northampton Housing Authority(the"NHA"). The
Northampton Board of Health(the"NBOH")has issued the NI-IA an Order that requires
the removal of the accumulation of items in the hall way around the door to your
apartment.
Pursuant to that Order,on Monday morning March 2,2009,any items left in the hall will
be deemed abandoned by you,and the NHA will throw them out. In addition,you will be
billed for any time the NHA staff spends on cleaning up the hall.

In accordance with, MASSACHUSETTS GENERAL LAWS, 105 CMR 410.000: State Sanitary
Code Chapter II: Minimum Standards for Human Habitation. An inspection was conducted by Aimee
Petrosky at 137 High St, Northampton, Massachusetts, a property occupied/managed by you, on
February 13, 2009.

The Board of Health will re-inspect your unit on Wednesday, February 259"at 10:00
AM. This inspection will be to assess your progress in cleaning the unit. If we do not see
movement by Wednesday, February 25, 2009 we will pursue our right under the state
sanitary code to have you remove you from your home.
The Northampton Board of Health is acting under the authority of
MASSACHUSETTS GENERAL LAWS, 105 CMR 410.000: State Sanitary Code Chapter II:
Minimum Standards for Human Habitation. You are hereby ordered to make a good faith
effort to comply with the formal order issued to you above within the time frame
listed. Failure to do so could result in legal action taken against you to pursue compliance
with this order.
Failure to comply with any order issued pursuant to the provisions of 105 CMR 410.000-shall
upon conviction be fined not less than$10 or more than $500. Each day's failure to comply shall
constitute separate violations.
Please be advised that if you are aggrieved with this order you have the right to request a
hearing. You must submit a written petition requesting a hearing within seven(7)days from the day the
order was served

During the inspection of Mr. Fabrocini residence at 137 High st apartment
number R155 it was found to be in violation of the following codes,
Massachusetts General Law (MGL) 148 section 27A and Commonwealth of
Massachusetts Regulations (CMR) 527 chapters 1 and 10.
MGL 148 section 27a pertains to the shut off, disconnection, obstruction,
removal, or destruction of fire prevention devices.
CMR 527 section 1 pertains to an excess amount of combustibles that add
significantly to the fire load and is an obstacle to the ingress or egress of the
building.
CMR section 10 also refers to all means of egress being clear of
obstacles.

Mr. Fabrocini would need to take the following actions to make his
apartment up to code:
• Remove all obstacles for a clear means of ingress and egress
• Clear all material at landing at the top of the stairs
• Remove paper hanging around smoke detectors
• Reduce amount of combustibles from his apartment specifically
in areas of a heat source
Also a follow up and sign off needs to be done with the building
departments electrical inspector for electrical issues found in the apartment.
