dwelling named in the attached report, and found it to be in violation of the Minimum Standard of

message, So I will have to put off any repairs or work till
they move out on June 30 , 1994 ,
I have planned to extensively renovate 22 Highland Ave
since last June and the tenants were told there lease would
not be extened when they signed it on Sept 1 , 1993 ,
Because of the work tenants could not live in the apartment
at all because of Insurance Liability,
I will start the work on July 1 , 1994 which will be to,
( 1 ) Replace both exterior doors with insulated steel
door units ,
( 2 ) Sand patch and refinsh all wood floors in the Apartment,
( 3) Completely remodel the kitchen by replacing the ceiling
walls sink unit and flooring, Also moving all water gas and
steam piping,
(4 ) Remove steam boiler and oil tanks from the basement
and brick up bulkhead opening,
(5) Repair cracked and peeling ceilings and walls in

Enclosed is a letter refuting Victor Caputo ' s claims that we
have not cooperated with repairs . We want to be sure you have it
on file in case this issue arises again in the future . However ,
today we learned that Mr . Caputo has agreed to mediate with us
regarding the state sanitary code violations at our residence and
our tenancy. This meeting is scheduled to take place Monday, June
27 at 1 ; 00, at the Hampshire Community Action Commission ' s Housing
Services office in Northampton. In the interest of promoting
good will during negotiations , we would like to ask you to delay
taking any action on this matter based on information contained
in our letter , until we know the ' ohtcome , .. if such a delay is
allowable within the constraints of your responsibilities as a
Board of Health inspector . We will be in touch with you early
next week to update you on the progress of our negotiations .

Last week you received a letter from Victor Caputo
stating that we, Tiffany Slayton and Helen Harrison , have
prevented him from making the repairs you ordered at 22
Highland Avenue, Northampton . This claim, as Helen Harrison
told you in a phone conversation June 14, is absolutely
untrue. We have, as always, been answering our telephone,
and have had our answering machine on at all times that we
have not been personally available. Victor Caputo has not
left any message on our machine regarding making repairs
since he received the Board of Health report June 1 , 1994,
nor has he spoken to either of us on the phone or in person ,
nor tried to contact us in writing , regarding making
repairs. We have received the following communications from
Victor and Denise Caputo.
May 31 , 1994. Denise Caputo left a message on our
answering machine, asking us to call her "regarding
tomorrow' s rent. " Helen Harrison called her back that
evening and left a message on the Caputo' s answering
machine, and received no answer.
June 1 , 1994. Victor Caputo left a message on our
machine that he had just received a notice from the Board of
Health "about the problems over there, " and that we would be
receiving a 30-day notice to vacate. Tiffany Slayton and
Helen Harrison each found such notice that night. The
notices had been left at our house through the mail slot
while we were away . He did not say anything in his message
about wanting to make any repairs before July 1 , 1994 ( the
date by which he expects us to have moved ) .
June 8, 1994. Victor Caputo called in the morning , and
left a message for our housemate, David Butler, with a
friend of Tiffany Slayton ' s who answered the phone. David
Butler returned the call that afternoon . When Victor Caputo
called back shortly thereafter, Helen Harrison answered . He
did not attempt to speak with her regarding repairs or
anything else, but asked to speak to David Butler. He
arranged to meet with David Butler to inspect his room and
return his security deposit before David Butler moves out at
the end of June. Victor Caputo also expressed anger toward
Tiffany Slayton and Helen Harrison for calling the Board of
Health. He told David Sutler that he was going to put a
lock on the door of David Butler ' s room after he moves out
to prevent us from engaging a new tenant. Furthermore,
Victor Caputo told David Butler said that we, Helen Harrison
and Tiffany Slayton , are in for a "rude awakening come the
end of the month. "
June 14, 1994. Victor Caputo left, through the mail
slot while we were not at home, a copy of the letter he sent
to you claiming we had not cooperated with his efforts to
make repairs. Enclosed in that envelope was a xerox of a
letter dated September 1 , 1993, informing "the tenants at 22
Highland Ave. " that our lease would not be extended
September 1 , 1994 because of the extensive repairs planned .
He also included a copy of the notice to vacate which he
delivered June 1 , 1994. None of us (David Butler, Helen
Harrison, Tiffany Slayton , or Gail Rogers) had ever seen the
letter dated September 1 , 1993 before receiving this "copy. "
Helen Harrison called Victor Caputo' s home that
afternoon and said , on his answering machine, that we would
be happy to allow him to make repairs if he would make
arrangements with us. Helen Harrison also stated that we
want to resolve this matter with him through mediation , and
that the Hampshire Community Action Commission would be
calling him to arrange this ( they left a message at his home
that same day ) . We have not heard back from him regarding
either of these concerns (we understand , through HCAC, that
he will be meeting with a staff member there June 22, 1994) .
Two points become clear from Victor Caputo' s limited
communications with us since June 1 , 1994. The first is
that he has had no trouble contacting us when he has tried.
The second is that he has not made a "good faith effort" to
begin any repairs before we move out. As we understand it,
he is required by your notice to make such an effort within
14 days of receiving the Board of Health report. His only
efforts seem to have been to avoid doing so.
In addition , he never spoke with any of the tenants
here about our lease not being renewable September 1 , 1994.
Furthermore, we never received the letter dated September 1 ,
1993 that supposedly informed us of this.
Victor Caputo has not offered Tiffany Slayton or Helen
Harrison a renewed tenancy after repairs are made, nor has
he offered help with moving expenses or any compensation for
having to move due to "extensive remodelling. " Since we had
no prior agreement to move out at any point so that repairs
could be made, is it fair that we should have to move, with
no option of returning, to allow repairs that we requested?
In sum, we have written this letter to refute Victor
Caputo' s claims that we have not cooperated with his
attempts to make repairs and that we had any prior agreement
to move out at any point to allow for remodelling. We also
are informing you that we have no plans to move out July 1 ,
1994 , and will not move out until we have reached a
satisfactory agreement with Victor Caputo.
We certify that all of the above statements are true,
under pains and penalties of perjury .
