The Northampton Board of Health has inspected the premises at
22 Main Street, Northampton, MA (assessor's map 32A parcel 146-01.),
for compliance with Chapter II of the State Sanitary Code.
This letter will certify that the inspections revealed violations listed below, which
are serious enough as to endanger or materially impair the
health, safety, and well-being of the occupants.
Under authority of Chapter III, Section 127 of the Massachusetts General Laws,
and Chapter II of the State Sanitary Code, you are hereby ordered to make a good
faith effort to correct the following violations
within 7 days of the receipt of this order.

REMEDY
Must provide sufficient number of
containers for the tenants. Must inform
the tenants in writing that they can only
place trash and garbage in sealed
containers. The building manager must
constantly monitor the property in order
that this order is complied with at all
times.
Inspection of the premises was made on February 4, 2002 at approximately 9 am.

Dear Mr. Meczywor.
I was very disturbed to receive today your violation notification, especially when we hate
informed your office on more than one occasion that we have nothing to do with the trash that is
being dumped in the rear alley of our building.
Please note the following:
• We have a watertight trash container(with a padlock) at the rear of the building for the
exclusive use of our four apartment tenants. Each tenant has a key and each tenant was
informed in person and in writing that no trash may be left outside the locked container
under any circumstance. The container is more than sufficient for the amount of trash
produced by the four tenants.
• Each tenant was visited on more than one occasion to make sure that no violations were
taking place. All tenants confirmed that they are in full compliance and that no ore et-er
dumps trash outside the designated container.
• We are not a large property management company and are not absentee landlords. We are
a family business and this is the only building we own. My brother and I constantly
monitor the rear alley. We do it almost daily on our way to work(we own the bookshep
in Thames Marketplace). We often pick up the disgusting trash dumped by others and are
getting really tired of doing this. We also have jobs and are not in a position to sit in the
alley all day to try and catch the people dumping the trash.
• The trash that is being dumped in the rear alley belongs to tenants from the building next
door located on 16 Main Street. There are no trash containers for this building in he rear
alley. Instead, tenants are asked to walk at least 200 yards to an area behind the parki e
lot to dump their trash. Some tenants perhaps find this too long a walk, especially in site
cold weather, and instead they leave their trash on the ground in the alleyway.
• When we inquired about the landlord of the building on 16 Main Street we were told that
he lives in New York,but that the owner of the Chinese restaurant on Pleasant Street to
his representative and also the caretaker of the property.
• My brother visited the caretaker who promised to clean the alleyway and personally visit
every tenant(and there are many in that building) to make sure tenants of 16 Main Street
don't dump their trash in the alleyway in the future.
• My brother Gabriel called your office on February 5th and briefed you on the situation.
• This problem with the trash strewn in the alleyway will continue until the time trash
containers for the building next door are provided for their tenants right there in the rear
of the building and not situated inconveniently miles away.
In short,we are always willing to cooperate with the Northampton Board of Health. The nealth,
safety, and well-being of Northampton is important to us—we live and work here— but there is
really not much more that we can do in relation to the above problem.
