SUBJECT TO the provisions of a Declaration of Protective Covenants by
Sovereign Builders, Inc., dated July 31, 1996, and recorded in the Hampshire
County Registry of Deeds in Book 4950, Page 255.
SUBJECT TO a utility easement granted to Massachusetts Electric Company,
dated November 6, 1995 and recorded in the Hampshire County Registry of Deeds
in Book 4793, Page 271. to the extent that said easement may affect the premises.
SUBJECT TO an easement for the benefit of Lot #11, to install, maintain,
repair and replace the septic system and its components, in the area of the demised
premises shown as "PROPOSED SEPTIC AREA OF LOT 11".
SUBJECT TO the right of the owner's of Lot #11, to use for access to and
from said Lot #11, that portion of the demised premises as shown on a plan to be
recorded as "PROPOSED 20' WIDE COMMON DRIVE EASEMENT 1,500 sq. ft. +-
and as approved by and subject to any permit from the City of Northampton
Planning Board or other municipal or regulatory body or agency. The cost of
maintain this easement, including without limitation, repair, upgrade, plowing,
sanding, grading, and re-grading, shall be shared equally by the owner's of Lots
#10 and #11, but the quality of the easement area (e.g. paved versus crushed
stone) shall be in the sole discretion of the owner of Lot #10,
SUBJECT TO the right of the owner's of Lot #11, to use for access to end
