Dear Members of the Commission:
On behalf of the City of Northampton Engineering Department (City), Tighe & Bond
respectfully submits nine (9) copies of this Notice of Intent (NOI) relative to utility
replacements and roadway reconstruction in the Village of Leeds, Northampton,
Massachusetts. A copy of WPA Form 3 is provided on the next pages. Figures and plans
depicting the project location and activities are provided in Appendix A for your reference.
This NOI is being filed under the Massachusetts Wetlands Protection Act (WPA; M.G.L. c. 131
§ 40) and the City of Northampton Wetlands Protection Ordinance (Chapter 337). A portion
of the proposed work will occur within wetland resource areas associated with Day Brook,
including its 200-foot Riverfront Area and 100-foot Buffer Zone.
We look forward to discussing this project with the Commission at its July 28, 2016 public

Section 1
Introduction
The City of Northampton Department of Public Works (DPW) is undertaking the proposed
utilities and road reconstruction project as part of its continued investment in the City’s
infrastructure. The DPW is continuing its efforts to maintain the integrity of existing
roadway and associated facilities.
The proposed project entails the replacement of the drainage and water utilities along a
portion of Audubon Road and a section of cross-country water main leading to an existing
elevated water tank. The project also includes the replacement of a deteriorated concrete
box culvert and partial breach of a stone weir that serves as a barrier to stream flow and
passage on Day Brook, along with reclamation and paving of the roadway.

Section 2
Existing Conditions
This section provides a description of the general project area, as well as information
pertaining to wetland resource areas and rare species.
2.1 Project Area
The project is located along approximately 2,500 linear feet (lf) of Audubon Road between
its intersection with Reservoir Road and River Street and approximately #200 Audubon
Road in the Village of Leeds, City of Northampton, Massachusetts. The project area also
includes an easement between #112 and #122 Audubon Road, leading to an elevated
water tower on the south side of Audubon Road at #134 Audubon Road. It also includes
a small portion of Day Brook. Figures and plans showing the site location and context are
included in Appendix A. Photographs of the proposed project area are provided in Appendix
B.
2.2 Wetland Resource Areas
2.2.1 Methodology of Wetland Resource Area Delineation
DPW staff delineated jurisdictional wetland resource areas associated with Day Brook on
the north side of Audubon Road. Based on the City’s delineation and a review of available
mapping, portions of the proposed project are located within or near inland Bank, Land
Under Water (LUW), Bordering Vegetated Wetlands (BVW), and Riverfront Area associated
with Day Brook. Portions of the project are also located within the 100-foot Buffer Zone
of inland Bank.
Tighe & Bond also reviewed FEMA Flood Insurance Rate Map (FIRM) Community Panel No.
250167 0001 A (effective April 3, 1978) during the preparation of this NOI. According to
the FIRM, the proposed limits of work are outside mapped limits of 100-year flooding.
2.2.1.1 Inland Bank
The Mean Annual High Water (MAHW) line and top of inland Bank of Day Brook, which are
presumed to be coincident at this location, were delineated by DPW staff on the north side
of Audubon Road with flags B-1 through B-5, B-10 through B-13, and B-20 through B-26.
The MAHW/Bank of Day Brook on the south side of Audubon Road consists of a stone-
lined channel between the Audubon Road culvert and the next downgradient culvert at a
private driveway crossing.
2.2.1.2 Bordering Vegetated Wetlands
Bordering Vegetated Wetlands (BVW) were observed in general proximity to Day Brook
and Clark Brook. BVW associated with Day Brook appears limited to a terrestrial area
between the divided stream channels that flow at the outer edges of the filled farm pond
area.

2.2.1.3 Land Under Water Bodies and Waterways
The area below the Bank/Mean Annual High Water (MAHW) line of Day Brook is considered
Land Under Waterbodies and Waterways (LUW). LUW observed in Day Brook generally
consists of sands and gravel.
2.2.1.4 Riverfront Area
Day Brook is shown as a perennial stream on the most current USGS topographic map of
the project area (Easthampton, Mass., 1979). Within the project area, Riverfront Area
generally consists of the paved footprint of Audubon Road and gravel roadway shoulders.
The Riverfront Area of Day Brook also consists of forested land to the west on the northerly
side of Audubon Road, and maintained residential properties to the south and east. The
Riverfront Area of Clark Brook includes a wetland meadow to the east and west along the
northerly side of Audubon Road, and upland and wetland forested areas to the east and
west along the southerly side of Audubon Road.
2.3 Rare Species
The Massachusetts Natural Heritage and Endangered Species Program (NHESP) Atlas
(October 1, 2008) and MassGIS online (October 2008), were consulted during the planning
and design phases of this project. According to these sources, the project area is not
situated within the limits of mapped Priority Habitats of Rare Species and Estimated
Habitats of Rare Wildlife.

Section 3
Project Description
3.1 Proposed Activities
The proposed project consists of the following activities:
• Water main (exempt) and storm drain system replacement
• Day Brook culvert replacement
• Day Brook stone weir breach
• Roadway reclamation and repaving (exempt)
These activities are described in the following sections and shown on the project plans
provided in Appendix A. Note that some of the proposed activities are exempt from the
WPA and/or have been previously authorized by the Northampton Conservation
Commission under a Generic Order of Conditions (see Section 4.1).
3.1.1 Water and Storm Drain Utilities
The proposed project consists primarily of the replacement of the existing water line and
drainage system within the paved footprint of Audubon Road and a portion of a cross-
country right-of-way from Audubon Road west towards an existing raised water tank.
Approximately 2,300 lf of 12-inch diameter replacement water main will be installed within
the footprint of Audubon Road and along the existing 10-foot wide easement from the
roadway to the elevated water tower. Construction will involve the abandoning in place of
the existing asbestos pipe and reconfiguration of new drainage structures within the
roadway. In general, trenches will be excavated and backfilled to match adjacent grades.
Upon completion of work, the full width of each paved roadway will be reclaimed and the
street repaved. The restoration of public roadways will not result in an increase in street
width or impervious area.
3.1.1.1 New Storm Drain Outlets
The proposed project includes the extension of a storm drain line along the northerly side
of Audubon Road to a new concrete headwall and the relocation of an existing storm drain
outfall to the stone-lined channel that conveys Day Brook through the property at #30
Audubon Road. Though technically “new” point source discharges under the
Massachusetts Stormwater Standards, there is no net increase in point source discharges
within the project area.
3.1.2 Culvert Replacement and Improvement
Day Brook is conveyed from north to south at Audubon Road via a deteriorated concrete
arch culvert. Construction of the replacement culvert will require the installation of
temporary water diversions, partial breach of the deteriorated structure, installation of the
water main, and replacement of the culvert with a three-sided structure comparable in
size to the existing culvert. A comparison of existing and proposed culvert dimensions is
provided below in Table 3-1.

As noted in Table 3-1, the proposed culvert will span the stream channel and maintain a
natural bottom, and improve the openness ratio of the crossing in keeping with the goals
of Massachusetts River and Stream Crossing Standards (2011). As shown above, the
proposed culvert replacement will result in an improved openness ratio over existing
conditions.
3.1.3 Day Brook Stone Weir Breach
An approximately 4-foot high and 40-foot long stone weir (non-jurisdictional unregistered
dam) that serves as an in-stream barrier on Day Brook will be removed. The stream
barrier, which originally created a small impoundment on Day Brook that has filled in with
sediment over time, is expected to collapse due to its proximity to the culvert removal
and replacement activities. As such, the City is proactively including the controlled
demolition and proper disposal of approximately 30 linear feet of this structure in line iwht
the culvert. The remaining sections of stone weir support and protect the embankment
of Audubon Road.
Following the partial breach of the stone weir and replacement of Day Brook culvert, rip
rap armoring will be placed on the Audubon Road roadway embankment on either side of
the upstream end of the Day Brook culvert. The armoring is intended to minimize the
potential for roadway runoff and flows from Day Brook to undermine the restored roadway
surface.
3.1.3.1 Sediment Management
Based on observations of site conditions and survey, approximately 30 cubic yards of
sediment has accumulated behind the stone weir. Sediment directly behind the stone
weir will be excavated, dewatered and properly disposed at an upland location.
3.1.4 Roadway Reclamation and Repaving
The length of Audubon Road within which the water main will be replaced (approximately
2,500 linear feet), as well as the approximately 600 linear feet of Audubon Road east of
the intersection with Kennedy Road, will be reclaimed and repaved within limits of the
existing paved footprint.

Please note that the roadway reclamation and repaving activities are exempt from the
WPA and/or previously authorized by the Northampton Conservation Commission under a
Generic Order of Conditions (see Section 4.1).
3.2 Anticipated Sequence of Construction
No work will be conducted in open or flowing water. The actual sequence of construction
will be left to the discretion of the selected contractor. Based on similar projects, the
proposed construction sequence includes the following:
1. Site preparation includes, but is not limited to, the following activities:
• Post MassDEP File # sign
• Establish traffic detours
• Install erosion and sedimentation controls, including dewatering basin
• Clear and grub vegetation, as needed
2. Install temporary coffer dam and streamflow bypass
3. Replace water main
4. Replace storm drain system
5. Replace Day Brook culvert
6. Remove Day Brook stone weir
7. Armor Audubon Road embankments
8. Remove coffer dam; restore normal stream flows
9. Reclaim and repave Audubon Road
10. Remove erosion control barriers
Prior to the commencement of construction activities, minor vegetation clearing will occur
to allow access to the work locations along the northerly side of Audubon Road at Day
Brook. Trees, saplings, shrubs, stumps, roots and brush, as well as guard rails, loose
gravel, and any other objectionable material will be removed from the work areas. The
materials will be properly disposed at an appropriate upland facility. No clearing and
grubbing is anticipated to occur below the top of Bank boundary.
3.3 Construction Period Protective Measures
The following Best Management Practices (BMPs) will be implemented during construction
to minimize the potential for erosion and sedimentation of the storm drain system that
discharges to downgradient wetland resource areas. Erosion control locations are provided
on the project plans. Typical details are shown on Sheets 11 and 12 of the project plans.
Protective measures, also referred to as Best Management Practices (BMPs), will be
implemented prior to and utilized during construction activities. These measures are
shown on the project plans provided in Appendix A and described below.

3.3.1 Erosion Control Barriers
Wetland resource areas in close proximity to the proposed project area will be protected
with a row of erosion control barriers. The erosion control barriers will consist of straw
bales and siltation fence or other similarly effective devices. The proposed locations of
these barriers are shown on the project drawings. In addition:
• The Contractor will be required to maintain a reserve supply of erosion control
barriers on-site to make repairs, as necessary.
• Protective measures will be inspected after significant precipitation events.
Maintenance and repairs will be conducted, as necessary.
At the conclusion of the project, the erosion control barriers will be removed and properly
disposed off-site following the stabilization of disturbed areas and Conservation
Commission authorization.
3.3.2 Coffer Dams
A coffer dam will be installed upstream of the proposed limits of work to create an isolated
(i.e., dry) work area. The isolated work area will be dewatered by means of pumping
trapped water to a sedimentation facility (e.g. stilling basin) outside the limits of the work
area. The contractor will be required to adequately treat all water prior to its discharge
from the isolated work area. The location of the coffer dam is shown on the plans in
Appendix A.
3.3.2.1 Stream Flow Bypass
Due to the nature of the proposed project and the space constrictions of the site, it will be
necessary to completely block normal stream flows during construction. Work in open
and/or flowing waters will be conducted in accordance with the Massachusetts General
Permit. In short, the bypass will likely be accomplished from immediately above the coffer
dam to immediately downstream of the isolated work area.
3.3.2.2 Dewatering Measures
When necessary, standard dewatering measures will be employed during construction of
the culvert repairs. Excess water within the dammed area will be pumped with trash
pumps and discharged to an appropriate settling basin. A temporary sediment trap is
depicted on the project plans in Appendix A. This trap will consist of hay bales lined with
filter fabric. Upon completion of construction, the area disturbed for the temporary
sediment trap will be restored to pre-existing or improved conditions.
3.3.3 Other Protective Measures
The following general measures will be employed to minimize impacts to the resource
areas:
• Access into the stream channel will only be by foot. No vehicles will enter the
stream channel.
• Protective measures will be inspected weekly during construction and after
significant precipitation events and repaired, as necessary.
• The work will be scheduled when no precipitation events are anticipated and the
stream flow is as low as practicable. If an unanticipated rain event is predicted

which may overwhelm the temporary bypass system, all equipment and supplies,
with the exception of the stream bypass system, will be removed from the stream
prior to the rain event.
• Straw bales, and silt fence shall be removed and properly disposed following site
stabilization.
• Catch basin inlets downgradient of the project area will be protected by silt sacks
or other similar silt retention devices.

Section 4
Regulatory Compliance
The proposed project has been designed to avoid environmental impacts where possible,
minimize unavoidable impacts when practicable, and provide mitigation that is
commensurate with the proposed alterations. Descriptions of the project’s compliance with
the regulatory requirements of the WPA, Northampton Wetlands Protection Ordinance,
and other pertinent state and federal regulatory programs are provided in the following
sections.
4.1 Routine Maintenance Order of Conditions
On October 15, 2015, the Northampton Conservation Commission issued an Order of
Conditions for routine maintenance and repair activities to the DPW under both the WPA
and Northampton Wetlands Protection Ordinance. This Order (MassDEP File Number 246-
686) includes provisions that authorize the following activities.
• Water main replacement
• Roadway reclamation and repaving
• Storm drain system replacement
Though these activities are shown on the project plans provided in Appendix A and
described in this application, they are not subject to further review and approval.
4.2 Wetlands Protection Act
4.2.1 Limited Project Status
4.2.1.1 Culvert Replacement
The proposed culvert replacement at Day Brook qualifies for consideration as a Limited
Project per 310 CMR 10.53(3)(i):
“The maintenance, repair and improvement (but not substantial enlargement)
of structures, including dams and reservoirs and appurtenant works to such
dams and reservoirs…buildings, piers, towers, headwalls, bridges, and
culverts which existed on the effective date of 310 CMR 10.51 through 10.60
(April 1, 1983).
As part of the preparation of this NOI, Tighe & Bond reviewed local records, and historical
USGS maps, as well as aerial photographs dating back to late 1800s/early 1900s to
corroborate the existence of the Day Brook culvert at the project location.
As required under the Limited Project status, an alternative analysis was conducted for
the project site.
No Action - The Day Brook culvert is deteriorated and will likely fail during construction
activities associated with the water main replacement. If no action is taken and the culvert

fails, the road will be closed to vehicle traffic until a repair can be made. Therefore, this
action was not considered practicable.
Culvert Replacement - The proposed culvert replacement meets the Massachusetts
River and Stream Crossing Standards for Replacement Culverts (2011) and will provide
structurally sound infrastructure at this location. The existing culvert capacity will be
maintained. Further, this alternative’s costs are consistent with the DPW’s available
budget.
Bridged Crossing - Another alternative to the proposed culvert repair is the complete
removal of the existing culvert and construction of a bridge at its location. Though
technically an alternative when considering repairs to existing culverts, this is the costliest
option and a bridge crossing is not necessary to meet other applicable regulatory
requirements. From a design, cost and environmental benefits standpoint, this alternative
was not considered feasible.
4.2.2 Summary of Jurisdictional Activities
Portions of the proposed project will occur within manmade inland Bank, Land Under Water
Bodies and Waterways, and the 200-foot Riverfront Area of Day Brook. Work will also
occur within the 100-foot Buffer Zone to inland Bank. A summary of jurisdictional
alterations excluding the previously authorized activities noted in Section 4.1 is presented
below in Table 4-1.

A summary of how the project meets the pertinent General Performance Standards is
presented below.
4.2.3 General Performance Standards
The following sections present discussions of the proposed activities relative to the
pertinent General Performance Standards.
4.2.3.1 Inland Bank
As noted in Table 4-1, approximately 150 linear feet (lf) of inland Bank will be altered
during the course of the proposed project. Of this, 60 lf, or 40 percent, is associated with
the culvert replacement. The remaining 90 lf is associated with the stone weir breach and

relocated storm drain discharge. The Performance Standards for inland Bank are set forth
at 310 CMR 10.54(4)(a) and are addressed below.
(a) Where the presumption set forth in 310 CMR 10.54(3) is not overcome, any proposed
work on a Bank shall not impair the following:
1. The physical stability of the Bank
The physical stability of the bank in the Day Brook Culvert will be improved by the
project. The 70 linear feet of stone-lined channel altered to relocate a stormwater
discharge will improve the physical integrity of the bank.
2. The water carrying capacity of the existing channel within the bank;
The water carrying capacity of the existing culvert and Day Brook will not be
changed by the project.
3. Ground and surface water quality;
Construction period protective measures (including stream flow bypass and
erosion/sedimentation controls) have been incorporated into project design to limit
impacts to ground and surface water quality. These are described in Section 3.3
and depicted on the site plans.
4. The capacity of the Bank to provide breeding habitat, escape cover and food for
fisheries; and
The Bank at this location consists of a stone weir, concrete culvert walls, and stone-
lined channel, none of which provide breeding habitat, escape cover or food for
fisheries.
5. The capacity of the Bank to provide important wildlife habitat functions. A
project or projects on a single lot, for which Notice(s) of intent is files on or after
November 1, 1987, that (cumulatively) alter(s) up to 10% or 50 feet (whichever
is less) of land in the bank found to be significant to the protection of wildlife
habitat, shall not be deemed to impair its capacity to provide important wildlife
habitat functions. Additional alterations beyond the above threshold may be
permitted if they will have no adverse effects on wildlife habitat, as determined by
procedures established under 310 CMR 10.60.
As noted above, 150 lf of manmade Bank alteration is proposed. Though the project
impacts exceed the 50 foot threshold for performing a Wildlife Habitat Evaluation,
the DPW respectfully requests the Commission waive this requirement due to the
total absence of wildlife habitat function and value associated with these particular
manmade infrastructures.
4.2.3.2 Land Under Water Bodies and Waterways
As noted is Table 4-1, approximately 650 sf of work resulting from the installation of a
temporary coffer dam and work area dewatering activities will occur in Land Under Water
Bodies and Waterways (LUWW), culvert replacement area, and downstream stabilization.
The Performance Standards for LUWW, which are set forth at 310 CMR 10.56(4), are
described below.
(a) Where the presumption set forth in 310 CMR 10.56(3) is not overcome, any proposed
work within Land Under Water Bodies and Waterways shall not impair the following:

1. The water carrying capacity within the defined channel, which is provided by said
land in conjunction with the banks;
The placement of a coffer dam in the unnamed perennial stream is temporary to
facilitate construction activities “in the dry.” The area of fill in LUWW at the
downstream end of the pipe is in a location where a void has been created beneath
the deteriorated culvert end. As such, the water carrying capacity within the
defined channel will not be altered and this standard has been satisfied.
2. Ground and surface water quality;
The contractor will be required to install a coffer dam that does not consist of
unconsolidated soil or other material. Typically, coffer dams consist of large
sandbags or plastic-lined concrete barriers. The actual materials will be left to the
discretion of the contractor. However, the coffer dam materials and work conducted
within the isolated work areas will not affect ground or surface water quality and
this standard has been met.
3. The capacity of said land to provide breeding habitat, escape cover and food for
fisheries; and
As described in Section 3, the scope of work includes the partial breach of a stone
weir that serves as a barrier to aquatic movement. This improvement will increase
opportunities for breeding habitat, escape cover and/or food for fisheries which,
under present conditions, are minimal at best. The proposed activities will not
result in the loss of function of the area to provide breeding habitat, escape cover
and/or food for fisheries, and this standard has been satisfied.
4. The capacity of said land to provide important wildlife habitat functions. A project
or projects on a single lot, for which Notice(s) of intent is files on or after November
1, 1987, that (cumulatively) alter(s) up to 10% or 5,000 square feet (whichever is
less) of land in this resource area found to be significant to the protection of wildlife
habitat, shall not be deemed to impair its capacity to provide important wildlife
habitat functions. Additional alterations beyond the above threshold may be
permitted in they will have no adverse effects on wildlife habitat, as determined by
procedures established under 310 CMR 10.60.
The proposed impacts to LUWW are limited to 650 square feet as shown on the
project plans in Appendix A. Since the footprint is less than 5,000 square feet, this
standard does not apply.
(b) Notwithstanding the provisions of 310 CMR 10.56(4)(a), the issuing authority may
issue an Order in accordance with M.G.L. c. 131, § 40 to maintain or improve boat
channels within Land Under Water Bodies and Waterways when said work is designed
and carried out using the best practical measures so as to minimize adverse effects
such as the suspension or transport of pollutants, increases in turbidity, the
smothering of bottom organisms, the accumulation of pollutants by organisms or the
destruction of fisheries habitat or nutrient source area.
The proposed project is not related to the maintenance or improvement of boat
channels, therefore this standard does not apply.
(c) Notwithstanding the provisions of 310 CMR 10.56(4)(a) and (b), no project may be
permitted which will have any adverse effect on specified habitat sites of rare

vertebrate or invertebrate species, as identified by procedures established under 310
CMR 10.59.
As noted in Section 2.3, the proposed project is not located within mapped Priority and
Estimated Habitats of rare species. Therefore, this standard does not apply.
4.2.3.3 Riverfront Area
As described in Section 2.2.1.4 and shown on the project plans provided in Appendix A,
the Riverfront Area within the project location consists of residential properties, paved
public roadways, and naturally vegetated areas. Approximately 3,185 sf of work
associated with the relocated storm drain outfalls and roadway embankment armoring will
occur within Riverfront Area.
(a) Protection of Other Resource Areas.
As described in the previous sections, the pertinent performance standards relative to
inland Bank and LUWW have been met, therefore this standard has been satisfied.
(b) Protection of Rare Species.
As noted in Section 2.3, the proposed project is not located within mapped Priority and
Estimated Habitats of rare species, therefore this standard has been satisfied.
(c) Practicable and Substantially Equivalent Economic Alternatives. There must be no
practicable and substantially equivalent economic alternative to the proposed project with
less adverse effects on the interests identified in M.G.L. c. 131 § 40.
The alternatives available to a project of this scale are limited. Tighe & Bond evaluated
alternatives during the planning and design phase of the proposed project. A summary of
alternatives is presented below.
Maintain Existing Discharge Points – The project calls for improving existing
infrastructure. As part of the drainage improvements, the drainage structures and piping
will be replaced within the project limits. The slope between the existing north outfall and
Day Brook is not sufficiently steep, causing water to pond before reaching the brook, and
a buildup of brush at the outfall. The storm drain piping leading to the outfall downstream
of the culvert runs directly through the yard of private residence. Replacing the storm
drain piping while maintaining the existing discharge points would likely cause extensive
damage to the homeowner’s landscaping. As such, this alternative is not preferred.
Construct New Stormwater Basins/Eliminate Point-Source Discharges - Given the
extent of private residential development on the southerly side of Audubon Road and the
extensive forested area to the north near the storm drain outfall, the disturbance of land
and/or land acquisitions necessary to pursue this alternative is not commensurate with
the work proposed. As such, this alternative is not preferred.
Relocate Existing Outfalls - The storm drain piping upstream of the culvert will be
extended so that the outfall will discharge to a rip rap splash pad directly adjacent to the
brook, as opposed to sheet flowing into it. The storm drain piping downstream of the
culvert will be straightened, eliminating a bend in the pipe, and relocating the outfall
approximately 35 feet downstream. This alternative is recommended, as it will allow
replacement of the drainage utilities without requiring extensive disturbance of private
residences.

(d) No Significant Adverse Impact. The work, including proposed mitigation measures,
must have no significant adverse impact on the riverfront area to protect the interests
identified in M.G.L. c. 131, § 40.
1. Within 200 foot riverfront areas, the issuing authority may allow the alteration
of up to 5000 square feet or 10% of the riverfront area within the lot, whichever
is greater, on a lot recorded on or before October 6, 1997 or lots recorded after
October 6, 1997 subject to the restrictions of 310 CMR 10.58(4)(c)2.b.vi., or up to
10% of the riverfront area within a lot recorded after October 6, 1997, provided
that:
a. At a minimum, a 100 foot wide area of undisturbed vegetation is
provided. This area shall extend from mean annual high-water along the
river unless another location would better protect the interests identified in
M.G.L. c. 131 § 40. If there is not a 100 foot wide area of undisturbed
vegetation within the riverfront area, existing vegetative cover shall be
preserved or extended to the maximum extent feasible to approximate a
100 foot wide corridor of natural vegetation. Replication and compensatory
storage required to meet other resource area performance standards are
allowed within this area; structural stormwater management measures may
be allowed only when there is no practicable alternative. Temporary
impacts where necessary for installation of linear site-related utilities are
allowed, provided the area is restored to its natural conditions. Proposed
work which does not meet the requirement of 310 CMR 10.58(4)(d)1.a.
may be allowed only if an applicant demonstrates by a preponderance of
evidence from a competent source that an area of undisturbed vegetation
with an overall average width of 100 feet will provide equivalent protection
of the riverfront area, or that a partial rebuttal of the presumptions of
significance is sufficient to justify a lesser area of undisturbed vegetation;
b. Stormwater is managed according to standards established by the
Department in its Stormwater Policy.
c. Proposed work does not impair the capacity of the riverfront area to
provide important wildlife habitat functions. Work shall not result in an
impairment of the capacity to provide vernal pool habitat identified by
evidence from a competent source, but not yet certified. For work within
an undeveloped riverfront area which exceeds 5,000 square feet, the
issuing authority may require a wildlife habitat evaluation study under 310
CMR 10.60.
d. Proposed work shall not impair groundwater or surface water quality by
incorporating erosion and sedimentation controls and other measures to
attenuate nonpoint source pollution.
Within 25 foot riverfront areas, any proposed work shall cause no significant
adverse impact by:
The work is not occurring within a defined real estate “lot” as the regulations are
written. Work is limited to discrete footprints within the City-controlled roadway
ROW.

Though much of the project qualifies as “redevelopment” the modification of
stormwater outfalls is subject to the Stormwater Management Standards (see
Section 4.2.6). The limited footprint of work is far less than 5,000 sf and,
therefore, does not trigger a Wildlife Habitat Evaluation. Finally, as detailed in
Section 3.3 and shown on the project drawings in Appendix A, appropriate
construction period BMPs have been incorporated into the design to attenuate
nonpoint source pollution during work.
The standards set forth at 310 CMR 10.58(4)(d) 3 and 4 do not apply to the
proposed project since the scope of work does not include the construction of a
single family house or a commercial structure.
4.2.4 Abutter Notification
Abutters have been notified in accordance with 310 CMR 10.05(4). Copies of the abutter
notification form and list of abutters are provided in Appendix C.
4.2.5 Stormwater Management Standards
The proposed project will not generate additional stormwater runoff, increase impervious
area or otherwise alter hydrology. However, the activities will relocate two stormwater
outfalls and is therefore not exempt. Copies of the Checklist for Stormwater Report and a
Stormwater Report are provided in Appendix D.
4.3 Northampton Wetlands Protection Ordinance
In addition to areas subject to jurisdiction under the Massachusetts Wetlands Protection
Act and regulations, the proposed project is also subject to the provisions of
Northampton’s Wetlands Protection Ordinance (Chapter 337).
4.3.1 DPW Generic Order of Conditions
As noted in Section 4.1, the Northampton Conservation Commission issued an Order of
Conditions for routine maintenance and repair activities to the DPW under both the WPA
and Northampton Wetlands Protection Ordinance on October 15, 2015. This Order
(MassDEP File Number 246-686) includes provisions that authorize the following activities.
• Water main replacement
• Roadway reclamation and repaving
• Storm drain system replacement
Though these activities are shown on the project plans provided in Appendix A and
described in this application, they are not subject to further review and approval.
4.3.2 No Encroachment Zone
According to the City of Northampton Zoning Map Numbers 5, 10 and 10B, the project is
zoned as Urban Residential A (URA), Rural Residential (RR), Special Conservancy (SC),
and Water Supply Protection (WSP; in the vicinity of Clark Brook only). As such, per
Section 337-10 there is a 50-foot Protected Zone associated with the wetland resource
areas within the proposed project area. This area is shown on the project plans. By
necessity, work is proposed in the No Encroachment Zone to address existing
infrastructure within lands subject to the City’s ownership and/or control.

4.3.3 Abutter Notification
Abutters were notified in accordance with the Massachusetts Wetlands Protection Act (see
Section 4.1.3) and Section 337-6(A) of the City’s Wetlands Protection Ordinance. A copy
of the list of abutters, the City’s abutter notification form, and the City’s Affidavit of Service
are provided in Appendix C. The USPS Certificates of Mailing log book pages will be
submitted to the Northampton Conservation Commission.
4.4 Other Pertinent Local, State and Federal Approvals
4.4.1 Northampton Department of Public Works
The proposed project is also subject to Stormwater Permit review by the Northampton
Department of Public Works (DPW). An application will be submitted to the City for review.
4.4.2 Section 401 of the Clean Water Act
Culvert replacements and fill placed below the Mean Annual High Water (MAHW) line of
Waters of the United States within the Commonwealth are subject to Massachusetts
Department of Environmental Protection (MassDEP) jurisdiction under Section 401 of the
Clean Water Act. As summarized in Table 4-1, the proposed project will result in less than
5,000 square feet of impacts (temporary and permanent) to Land Under Water and will
dredge and/or mobilize less than 100 cubic yards of sediment. As such, the project is not
categorically required to obtain an individual 401 Water Quality Certificate.
4.4.3 NPDES Construction General Permit
Construction activities will result in the cumulative disturbance of one (1) or more acres
of land. An electronic Notice of Intent (eNOI) will be submitted to EPA for coverage under
the NPDES Construction General Permit (CGP) and a Stormwater Pollution Prevention Plan
(SWPPP) will be prepared and kept at the site during construction.
4.4.4 Section 404 of the Clean Water Act
Culvert replacements and fill placed below the Ordinary High Water (OHW) line of Waters
of the United States within the Commonwealth are subject to Corps jurisdiction under
Section 404 of the Clean Water Act. The project is subject to review under the “Pre-
Construction Notification” category of the Massachusetts General Permit (MA GP) as the
project may result in work outside the regulatory Time-of-Year (TOY) restriction for inland
waters.

Under the Massachusetts Wetlands Protection Act
and the Northampton Wetlands Ordinance
In accordance with the second paragraph of the Massachusetts General Laws Chapter 131,
Section 40, you are hereby notified of the following:
The name of the applicant is City of Northampton Department of Public Works (DPW).
The applicant has filed a Notice of Intent with the Northampton Conservation Commission that
seeks permission to remove, fill, dredge or alter an Area Subject to protection Under the
Wetlands Protection Act (General Laws Chapter 131, Section 40) and the Northampton
Wetlands Protection Ordinance (Chapter 337).
The address of the lot where the activity is proposed is Audubon Road (roadway right-of-way)
from approximately River Street west approximately 1,900 linear feet (lf), and from Kennedy
Road approximately 600 lf easterly.
The project proposes: To replace and improve the existing water and storm drain utilities,
replace the Day Brook culvert, remove a stone weir on Day Brook, and reclaim and repave the
existing footprint of Audubon Road within the limits of proposed work (refer to USGS
topographic map “Figure 1” on the opposite side of this page).
Copies of the Notice of Intent may be examined at the Office of Planning and Sustainability,
210 Main Street, Room 11, between the hours of 8:30 a.m. and 4:30 p.m., Monday – Friday,
and online at www.northamptonma.gov/opd
Copies of the Notice of Intent and more information may be obtained from either (check one)
the applicant ____, or the applicant's representative ______, by calling this telephone number
(413) 572 - 3224 between the hours of 8:00 AM and 5:00 PM on the following days of the
week: Monday through Friday.
Information regarding the date, time, and place of the public hearing may be obtained from the
Office of Planning and Sustainability by calling (413) 587- 1263. Hearing notice will be posted
online at www.northamptonma.gov/opd and www.northamptonma.gov/calendar. A ‘Public
Notice’ sign with the date of the hearing will also be posted on the property when the hearing is
scheduled.

at least five (5) days in advance of the hearing in the Daily Hampshire Gazette.

Project Description
2.1 Project Summary
The project is located along approximately 2,500 linear feet (lf) of Audubon Road between
its intersection with Reservoir Road and River Street and approximately #200 Audubon
Road in the Village of Leeds, City of Northampton, Massachusetts. The project area also
includes an easement between #112 and #122 Audubon Road, leading to an elevated
water tower on the south side of Audubon Road at #134 Audubon Road. It also includes
a small portion of Day Brook. Figures and plans showing the site location and context are
included in Attachment C. Photographs of the proposed project area are provided in
Attachment D.
The following Stormwater Management Report was prepared in support of a Notice of
Intent filing with the Northampton Conservation Commission for work within jurisdictional
areas as required under the Massachusetts Wetlands Protection Act.
2.2 Existing Conditions
An existing three-sided reinforced concrete box culvert is located at approximately 40
Audubon Road, where the road crosses Day Brook. The 29 foot long culvert has a cross-
sectional area of 18 square feet and an openness ratio of 0.19. The structure is currently
in disrepair, the reinforcing steel is exposed and corroded in several locations. The sides
of the culvert are currently supported by bags of cement concrete, which line the inside
of the culvert.
Two existing outfalls discharge stormwater from Audubon Road to Day Brook. A 12-inch
reinforced concrete pipe discharges to the brook upstream of the culvert, and a 12-inch
clay pipe discharges to the brook downstream of the culvert.
According to the NRCS soil survey, soils within the project area are mainly comprised of
medium-draining, fine sandy loam. Soils of this type have a slow infiltration rate when
thoroughly wet. The soils in the area have a moderate potential for soil-induced
electrochemical or chemical action that corrodes or weakens concrete. The NRCS soil data
is included in Appendix C.
Exploratory borings were performed in February 2016 to verify the soil conditions and the
depth to bedrock within the project area. The results of the borings indicate that the soils
within the project area are predominantly fine and coarse sand with little silt and gravel.
Boring logs are provided in Appendix C.
2.3 Proposed Improvements
The proposed project consists primarily of the replacement of the existing water line and
drainage system within the paved footprint of Audubon Road and a portion of a cross-
country right-of-way from Audubon Road west towards an existing raised water tank.

Approximately 2,300 lf of 12-inch diameter replacement water main will be installed within
the footprint of Audubon Road and along the existing 10-foot wide easement from the
roadway to the elevated water tower. Construction will involve the abandoning in place of
the existing asbestos pipe and reconfiguration of new drainage structures within the
roadway. In general, trenches will be excavated and backfilled to match adjacent grades.
Upon completion of work, the full width of each paved roadway will be reclaimed and the
street repaved. The restoration of public roadways will not result in an increase in street
width or impervious area.
Proposed improvements will replace the existing culvert with a three-sided precast
concrete culvert of equal length. The proposed culvert will have a cross-sectional area of
22 square feet, and an openness ratio of 0.23. In addition to increasing the openness
ratio, the proposed crossing will have a natural stream bottom.
Construction Period Best Management Practices
Construction period Best Management Practices (BMPs) consisting of straw bale and
siltation fence erosion control barriers, or similar devices, will be installed between the
proposed limits of work and sensitive environmental receptors (e.g. catch basins) and the
contractor(s) will be required to maintain reserve supplies of erosion control barriers on-
site to make repairs, as necessary. Upon completion of construction, disturbed unpaved
areas will be loamed and seeded and mulched with weed-free straw. Paved roadways will
be reclaimed and re-paved within their existing footprints.
At the conclusion of the project, the erosion control barriers will be removed and properly
disposed off-site following the stabilization of disturbed areas and Conservation
Commission authorization.
The two existing outfalls to Day Brook will be relocated. The storm drain piping upstream
of the culvert will be extended, so that the outfall will discharge to a rip rap splash pad
directly adjacent to the brook, as opposed to sheet flowing into it. The storm drain piping
downstream of the culvert will be straightened, eliminating a bend in the pipe, and
relocating the outfall approximately 35 feet downstream.
A coffer dam will be installed upstream of the proposed limits of work in Day Brook to
create an isolated (i.e., dry) work area. The isolated work area will be dewatered by means
of pumping trapped water to a sedimentation facility (e.g. stilling basin) outside the limits
of the work area. Installation of the coffer dam will not result in any ground disturbance.
The contractor will be required to adequately treat all water prior to its discharge from the
isolated work area.
Due to the nature of the proposed project and the space constrictions of the site, it may
be necessary to completely block normal stream flows during construction. Work in open
and/or flowing waters will be conducted in accordance with the Massachusetts General
Permit. In short, the bypass may be accomplished from immediately above the coffer dam
to immediately below (or downstream of) the work area.
Additionally, the following general measures will be employed to minimize impacts to the
resource areas:
Access into the stream channel will only be by foot. No vehicles will enter the
stream channel.

Protective measures will be inspected weekly during construction and after
significant precipitation events and repaired, as necessary.
The work will be scheduled when no precipitation events are anticipated and the
stream flow is as low as practicable. If an unanticipated rain event is predicted
which may overwhelm the temporary bypass system, all equipment and supplies,
with the exception of the stream bypass system, will be removed from the stream
prior to the rain event.
Straw bales, and silt fence shall be removed and properly disposed following site
stabilization.
Catch basin inlets downgradient of the project area will be protected by silt sacks
or other similar silt retention devises.

Regulatory Compliance
The project, due to the scope of work within Riverfront Area and the 100-foot Buffer Zone
to inland Bank, is required to comply with the ten Massachusetts Stormwater Standards
(Standards) under the Massachusetts Wetlands Protection Act. As noted in Section 3.8,
the proposed activities meet the criteria to be considered a Redevelopment project. The
Massachusetts Stormwater Checklist is provided in Appendix A.
3.1 LID Measures
MassDEP allows for reductions in structural stormwater Best Management Practice (BMP)
requirements for water quantity and quality when certain criteria are met. The applicant
is not requesting credit for LID measures for this project.
3.2 Standard 1: No New Untreated Discharges
There are no new stormwater conveyance outfalls discharging untreated stormwater
directly to waters of the Commonwealth as a result of the proposed improvements. Old
drainage systems will be removed and two storm drain outfalls will be relocated to convey
stormwater to Day Brook.
It is not anticipated that erosive stormwater velocities will be encountered post-
construction subsequently causing erosion and siltation to waters of the Commonwealth.
New stormwater discharges are proposed, however erosion and sedimentation will be
limited using properly designed straw bales and siltation fences.
3.3 Standard 2: Peak Discharge Rate Attenuation
The proposed Project will not significantly alter stormwater flow paths, nor will alterations
in ground cover result in an increase in peak discharge rates under proposed conditions.
3.4 Standard 3: Groundwater Recharge
The proposed project does not propose any new impervious area, and therefore is not
subject to groundwater recharge requirements.
3.5 Standard 4: Water Quality
The proposed project does not propose any new impervious area, and therefore is not
subject to TSS removal requirements. However, provisions for long-term source control
and pollution prevention are included in the Operation and Maintenance (O&M) Plan
provided in Appendix D.
3.6 Standard 5: Land Uses with Higher Potential
Pollutant Loads (LUHPPLs)
The project does not include any LUHPPLs, therefore the provisions of this standard do
not apply.

3.7 Standard 6: Critical Areas
The site is located within the Mill River watershed and is not located within a Zone II or
Interim Wellhead Protection Area. According to the proposed Massachusetts Year 2014
List of Integrated Waters, the Mill River, as the receiving water from Day Brook, is listed
as a Category 5 Water (MA34-28). This categorization indicates that the water body
requires a Total Maximum Daily Load be determined for particular identified pollutants.
In the case of the Mill River, the identified pollutants include Escherichia coli.
The project will not result in any new stormwater discharges to the watershed contributing
to the Assabet River. Existing drainage patterns will be maintained. Additionally,
stormwater quality will not be impacted as a result of the development. Stormwater BMPs
are not proposed as part of the project due to the nature of the project and the applicability
of Stormwater Standards 3 and 4.
3.8 Standard 7: Redevelopment Projects
The project is considered a redevelopment, as it consists of improvement of an existing
roadway and utilities within the roadway, and improvement of existing drainage systems.
3.9 Standard 8: Construction Period Pollution
Prevention, Erosion and Sedimentation Control
There will be more than one acre of land disturbed as a result of this project, therefore an
EPA NPDES Construction General Permit will be obtained before construction commences.
Prior to construction, the contractor will prepare a SWPPP identifying construction period
pollution prevention and erosion and sedimentation control measures.
3.10 Standard 9: Long-Term Operation and Maintenance
Plan
A Stormwater Operations and Maintenance Plan is included in Appendix D of this report.
The O&M plan indicates the responsible parties for the project, routine and non-routine
maintenance tasks and inspection criteria.
3.11 Standard 10: Prohibition of Illicit Discharges
The Owner is not aware of any existing illicit discharges at the Site and is not proposing
any illicit discharges as part of the project. If any illicit connections are found during
construction of the site, these connections will be abandoned and removed. A signed Illicit
Discharge Statement is provided in Appendix E.

A Stormwater Report must be submitted with the Notice of Intent permit application to document compliance with the Stormwater Management Standards. The following checklist is NOT a substitute for the Stormwater Report (which should provide more substantive and detailed information) but is offered here as a tool to help the applicant organize their Stormwater Management documentation for their Report and for the reviewer to assess this information in a consistent format. As noted in the Checklist, the Stormwater Report must contain the engineering computations and supporting information set forth in Volume 3 of the Massachusetts Stormwater Handbook. The Stormwater Report must be prepared and certified by a Registered Professional Engineer (RPE) licensed in the Commonwealth. The Stormwater Report must include:

Description

Description
Hydrologic soil groups are based on estimates of runoff potential. Soils are
assigned to one of four groups according to the rate of water infiltration when the
soils are not protected by vegetation, are thoroughly wet, and receive precipitation
from long-duration storms.
The soils in the United States are assigned to four groups (A, B, C, and D) and
three dual classes (A/D, B/D, and C/D). The groups are defined as follows:
Group A. Soils having a high infiltration rate (low runoff potential) when thoroughly
wet. These consist mainly of deep, well drained to excessively drained sands or
gravelly sands. These soils have a high rate of water transmission.
Group B. Soils having a moderate infiltration rate when thoroughly wet. These
consist chiefly of moderately deep or deep, moderately well drained or well drained
soils that have moderately fine texture to moderately coarse texture. These soils
have a moderate rate of water transmission.
Group C. Soils having a slow infiltration rate when thoroughly wet. These consist
chiefly of soils having a layer that impedes the downward movement of water or
soils of moderately fine texture or fine texture. These soils have a slow rate of water
transmission.
Group D. Soils having a very slow infiltration rate (high runoff potential) when
thoroughly wet. These consist chiefly of clays that have a high shrink-swell
potential, soils that have a high water table, soils that have a claypan or clay layer
at or near the surface, and soils that are shallow over nearly impervious material.
These soils have a very slow rate of water transmission.
If a soil is assigned to a dual hydrologic group (A/D, B/D, or C/D), the first letter is
for drained areas and the second is for undrained areas. Only the soils that in their
natural condition are in group D are assigned to dual classes.
