On July 25, 2001,tank alarm equipment indicated that a release of gasoline may have occurred from the on-site 500-gallon gasoline underground storage tank. Further investigation indicated that gasoline was present in the interstitial space between the inner and exterior walls of the fiberglass tank. In addition to oral notification, 310 CMR 40.0333 further requires that a completed Release Notification Form (attached)be submitted to the Department within 60 calendar days of the date of the oral notification. The Department has reason to believe that the reported release is or may be a disposal site as defined in the Massachusetts Contingency Plan, 310 CMR 40.0000 (the "MCP"). The Department also has reason to believe that you(as used in this letter"you"refers to Department of Veterans Affairs Medical Center)are a potentially responsible party (PRP) with liability under Section 5(a) of M.G.L. c. 21E. This liability is "strict," meaning that it is not based on fault, but solely on your status as owner, operator, generator, transporter, disposer or other person specified in said Section 5(a). This liability is also "joint and several", meaning that you are liable for all response costs incurred at a disposal site even if there are other liable parties. The Department encourages PRPs to take prompt and appropriate actions in response to releases and threats of release of oil and/or hazardous materials. By taking the necessary response actions,you may significantly lower your assessment and cleanup costs and/or avoid liability for costs incurred by the Department in taking such actions. You may also avoid or reduce certain permit or annual compliance fees payable under 310 CMR 4.00. Please refer to M.G.L.c.21E for a complete description of potential liability. For your convenience, a summary of liability under M.G.L. c. 21E is attached. You should be aware that you may have claims against third parties for damages, including claims for contribution or reimbursement for the costs of cleanup. Specific approval is required from the Department for the implementation of all IRAs with the exception of the construction of a fence and/or posting of signs. Additional submittals are necessary with regard to this notification including,but not limited to,the filing of an IRA Completion Statement and/or Response Action Outcome(RAO)statement. The MCP requires that a fee of$750.00 be submitted to the Department when an RAO statement is filed greater than 120 days from the date of initial notification. It is important to note that you must dispose of any Remediation Waste generated at the subject location in accordance with 310 CMR 40.0030 including,without limitation, contaminated soil and/or debris. Any Bill of Lading accompanying such waste must bear the seal and signature of a Licensed Site Professional (LSP). A Notice of Responsibility was issued to VA Central Western Massachusetts Healthcare System on January 9,2013. On April 2,2014,Mr. Craig Blake, LSP, of Woodard and Curran,Inc., wrote the Department on your behalf to notify of a delay for submittal of a Tier Classification Submittal. The reason for the delay was that response actions (soil excavation)have been hampered by frozen ground and snow cover at the site, and further assessment was needed at the site. Recently, Department staff spoke with both Mr.McMahon and Mr. McPherson of the Northampton VA regarding the scope of work and timelines for response actions. Mr. McPherson explained that the contract for LSP services will likely be completed in three weeks,however, the contract for the excavation firm would approximately three months to award. Initial Site Investigation Report and Tier Classification Buildings 1,4 and 8 Perimeters VA Northampton Medical Center 421 North Main Street Leeds, MA RTN 1.18961 Summary of Findings and Conclusions On behalf of the U.S. Department of Veterans Affairs (VA),Woodard &Curran (W&C) has completed a Phase I Initial Site Investigation (151)in accordance with the requirements of the Massachusetts Contingency Plan(MCP; 310 CMR 40.0000) for reported releases of oil and/or hazardous material (OHM) in the vicinity of Buildings 1, 4 and 8 of the Northampton VA Medical Center (VAMC), 421 North Main Street, Leeds, Massachusetts identified as Release Tracking Number(RTN) 1-18961. In accordance with the MCP (310 CMR 40.0480), the Phase 1 151 report documents the results of Investigations conducted to characterize the source, nature, and extent of OHM releases to the environment, describes Site hydrogeological characteristics, characterizes potential migration pathways and exposure points to human and ecological receptors, evaluates the need for Immediate Response Actions (IRA), and concludes whether further remedial response actions are necessary. In addition, the Phase 1 ISI Report supports the completion of a Tier Classification submittal in accordance with Section 40.0463 of the MCP. The Site, i.e. soil adjacent to foundations of Buildings 1, 4 and 8, is located within the developed campus of the Northampton VAMC which is comprised of approximately 50 buildings consisting of hospital facilities, residences, office buildings, facilities maintenance buildings, and storage buildings. The Northampton VAMC has 85 behavioral health beds, a 44-bed nursing home care unit, and a 16-bed substance abuse unit area. Building 1 is the main hospital building and Includes patient admissions and discharge and security. Building 4 houses the substance abuse program. Building 8 houses the Post-traumatic Stress Disorder(PTSD) unit. Open grassed fields and forested land surround the Northampton VAMC. Near surface soil sampling completed in anticipation of a roof repair project at Buildings 1, 4 and 8 at the Northampton VAMC identified lead in the soil at concentrations greater than The applicable RCS-1 reportable concentration. Upon confirmation that the lead release was not associated with the lead painted roof trim in the area of the original samples, the VA notified MassDEP of the release and RTN 1-18961 was designated for the disposal site comprised of the three buildings. The contaminant of concem is limited to lead. Site groundwater has not yet been evaluated, but will be assessed in future investigations. Potential receptors include facility workers, construction workers, utility workers,veteran patients and visitors who may be exposed to impacted soil. A Tier Classification was performed to accompany this 151. The public involvement provisions of the MCP(310 CMR 40.1403(3)(d)) require that the Chief Municipal Officer and the Board of Health in the community in which a disposal site is located be notified that a Release Abatement Measure (RAM)will be conducted. Specifically,the RAM is being conducted to excavate soils along the perimeter of Buildings 1, 4 and 8 at the property identified as the VA Central Western Massachusetts Healthcare System (VA CWM), located at 421 North Main Street in Leeds, Massachusetts (the Site), where concentrations of lead have been reported above applicable standards promulgated within the MCP. The excavated soils are to be transported off-site and disposed of in accordance with applicable local, state and federal requirements. Following the completion of the excavation activities the areas will be backfilled to grade with imported materials. Field activities associated with the RAM are expected to commence in October 2015 and be completed in approximately 3-4 weeks.
