McERLAIN, Health Agent April 12, 1996 Ms. Trudy Epstein 31 Marian St. Northampton, MA 01060 Dear Ms. Epstein: CITY OF NORTHAMTON MASSACHUSETTS 01060 OFFICE OF THE BOARD OF HEALTH 210 MAIN STREET 01060 (413)586-6950 Ext.213 Re: Sewage Disposal System Failure, 105 Marian St. As a result of a complaint, the Northampton Board of Health conducted an inspection of your property at 105 Marian Street on April 12, 1996. That inspection revealed that the sewage disposal system at that address was malfunctioning, sewage was flowing from the surface of the leaching system into the roadway. This condition is a violation of 310 CMR 15.000 of the State Environmental Code, Title 5 and a public health nuisance which must be abated. In accordance with the provisions of 310 CMR 15.000 of the State Environmental Code, Title 5, and under authority of Massachusetts General Laws, Chapter 21A, Section 13, you are hereby ordered to repair the subsurface sewage disposal system at 105 Marian Street, within Fourteen (14) days of the receipt of this notice.All work to repair/upgrade the subsurface sewage disposal system must be performed by a licensed sewage disposal system installer, in accordance with the requirements of 310 CMR 15.000, and with plans approved by the Northampton Board of Health. Please be advised that you are entitled to a hearing on this order to upgrade your subsurface sewage disposal system, provided that you file a written petition requesting such a hearing in the Board of health office within seven (7) days of the receipt of this notice.
