1. Prior to issuance of a building permit, the applicant show that the Office of Planning and
Development has determined that the following issues have been addressed:
a. the applicant shall resubmit a plan showing a revised Conservation Restriction(CR) boundary that
is aligned with the no disturbance area.
b. the applicant must record a CR on the parcel as shown. The CR shall be reviewed and approved by
the City as standard procedure prior to submission to SOFA.
c.Revised plans must be submitted for review and approval showing a low flow outlet pipe at
approximately elevation 401. Pretreatment must be provided to remove 80% TSS.
d.An operations and maintenance plan shall be submitted for approval by Department of Public
Works and recorded at the registry of deeds.
2.Prior to the issuance of a certificate of occupancy and in order to meet the traffic mitigation
requirements of this project, the applicant shall install a 5'sidewalk for traffic mitigation in the
location shown on revised plans. The sidewalk shall be constructed into the parking lot of the project
site.
3. In order to meet the traffic mitigation requirements, the homeowner's Association shall be
responsible for clearing snow for the entire stretch of sidewalk from this properly to Leonard Street.
4. The no disturb boundary should be clearly and permanently marked with boulders and signs.
The Planning Board granted the Special Permit for a 6-unit townhouse cluster open space development based on the application and the
following plans submitted with the application:

December 7, 2005 Last Revised March 17,2006.

The Planning Board found:
A. The requested use protects adjoining premises against seriously detrimental uses. Cluster open space residential developments are
allowed by special permit The overall development with the open space protection will result in a smaller footprint and will leave a buffer
between this property and other properties an Haydenville Rd. Thus, sound and sight buffers and views, light,and air will be protected
through permanetly protected open space to the rear of this site.
B. The requested use will improve pedestrian access along this section of Route 9 through the installation of a sidewalk on the Mass
Highway Right-of-Way. The installation of the off-site sidewalk along with the permanent maintenance for snow removal meets the traffic
mtigation required per section 11.6(2),
The project, including any concurrent road improvements,will not decrease the level of service(LOS)of all area roads or intersections
effected by the project below the existing conditions. Mass Highway has approved the access and has determined that there will not be a
negative effect on their system.
C. The requested use will promote a harmonious relationship of structures and open spaces to the natural landscape,existing buildings
and other community assets in the area. The project includes permanent protection through a Conservation Restriction of the rear of the
site that contains bordering vegetative wetlands that is habitat to sensitive and rare and endangered species.
D. The requested use will not overload, the City's resources including the effect on the City's water supply and distribution system,
sanitary and storm sewage collection and treatment systems,fire protection,streets and schools. Stormwater will be managed on site in
accordance with Department of Public Works standards and the site will be served by private water.
E. The requested use meets the criteria in section 10.5 for cluster open space requirements. The open space portion of the property will
provide protection to valuable wildlife/wetland habitat The boundaries will be clearly marked to ensure protection.
F. The requested use bears a positive relationship to the public convenience or welfare. The installation of the sidewalk will enable
residents to walk safely to the abutting neighborhood and schools in Leeds.
G. The requested use will promote City planning objectives identified in the City of Northampton Open Space and Recreation Plan and
Vision 2020 document The clustered townhomes will provide an alternative housing option.
H. Compliance with the following technical performance standards:
1. Curb cuts onto streets have been minimized, with only one.
2.Pedestrian,bicycle and vehicular traffic movement on site have been separated to the extent practicable.
