NORTHAMPTON BOARD OF APPEALS
Decision on Application of
Labbee/Dulong
January 13, 1982
The Board of Appeals met on January 13, 1982, to render a deci-
sion on the Labbee/Dulong application for a variance to erect a sign
within two feet of the property line at 285 North King Street.
Present and voting were Acting Chairman William Brandt, Peter Laband,
and Marianne Zurn.
On a motion made and seconded, the Board voted unanimously to
accept the minutes of the public hearing, held on December 9, 1981,
but to waive the reading.
Dr. Laband, referring to the requirements for a variance according
to the Zoning Act, found that the property is unique, in that it was
originally a much larger parcel which was reduced in size by the con-
struction of I-91 to the rear. The topography is such that the land
drops sharply toward the highway. The Realty World building, formerly
used as a dwelling, is peculiarly, located on the lot, specifically,
close to the highway, so that the 15 foot setback required for the sign
would be impossible to achieve. Since advertising is important to the
applicants ' real estate business , a literal enforcement of the Zoning
Ordinance would create a hardship for them if they were denied the
right to advertise the type of business in which they were engaged,
and its location. The proposed sign would be placed farther back from
the road than the sign now in place which was allowed by the Building
Inspector on a temporary basis. Finally, he found that there would be
no derogation from the intent of the Ordinance because the sign would
not impair visibility, and thus would pose no safety problems for
motorists leaving the property or, traveling on Rt. 5.
Mr. Brandt agreed with Dr. Laband' s findings. However, he ex-
pressed concern that the sign might impair the vision of a driver
exiting the site. He recommended that, if approved, approval be
conditioned on the sign 's compliance with standards set by the appro-
priate City agency.
Ms. turn also agreed with Dr. Laband' s findings, but with the
restriction that the sign be erected within one foot of the northerly
side of the building.
On a motion made and seconded, the Board then voted unanimously
to grant the variance, subject to the restrictions recommended by Mr.
Brandt and Ms. Zurn.
The meeting was adjourned at: 7:45 PM. Present, in addition to
the Board members, were a WHMP reporter, and Clare Fennessey, Clerk.
