renewal thereof,shall take effect until a copy of the decision bearing the certification of the City Clerk that twenty days have
elapsed after the decision has been filed,or if such an appeal has been filed that it has been dismissed or denied,is recorded in
the Hampshire County registry of Deeds or Land Court, as applicable and indexed under the name of the owner of record or
is recorded and noted on the owner's certificate of title.The fee for such recording or registering shall be paid by the owner or
applicant.It is the owner or applicant's responsibility to pick up the certified decision from the City Clerk and record it at the

seriously detrimental uses because the proposed project will significantly improve the appearance and safety of the area. The applicant
proposes to add trees along the front of the site and upgrade the existing structures,enhancing the aesthetic appearance of the property.
B. The requested use will promote the convenience and safety of vehicular and pedestrian movement within the site and on adjacent
streets,minimize traffic impacts on the streets and roads in the area because the proposed project will bring the parking and curb cuts
into compliance with zoning. The project will reduce the number of curb cuts from two to one thereby allowing traffic to enter/exit the
site at a specified point creating a more predictable traffic flow.
C. The requested use will promote a harmonious relationship of structures and open spaces to the natural landscape,existing buildings
and other community assets in the area because the dilapidated barn will be removed thus creating additional green space at the site.
Additional trees will be planted along the front of the site and the existing vegetated area to the north will remain.
D. The requested use will not overload,and will mitigate adverse impacts on the City's resources including the effect on the City's water
supply and distribution system,sanitary and storm collection and treatment systems,fire protection,streets and schools because
surface water drainage will be directed to stormwater treatment chambers and will be treated on-site.
E. The requested use meets any special regulations set forth in Section 11 of the Northampton Zoning Ordinance.
F. The requested use bears a positive relationship to the public convenience or welfare.
The use will not unduly impair the integrity of character of the district or adjoining zones,nor be detrimental to the health,morals or
general welfare because the proposed project will be in keeping with the surrounding business environment and will be an improvement
to the site.
The use shall be in harmony with the general purpose and intent of the Ordinance.
G. The requested use will promote City planning objectives to the extent possible and will not adversely effect those objectives,as
defined in City master or study plans adopted under M.G.L.Chapter 41,Section 81-C and D.
In addition,in reviewing the Site Plan submitted, the Planning Board determined that the application complied with the following
technical performance standards:
1. The proposed project will decrease the number of curb cuts on site.
2. Pedestrian,bicycle and vehicular traffic are separated on site to the extent possible.
The Planning Planning Board voted 6:0 to grant the waivers as requested in the application.

NATURE OF PROPOSED WORK:
Convert existing used car lot to transmission repair center. Renovate to create 4-5 bay facility by adding 1,800 sq. feet of space to the
existing garage.
HARDSHIP:
CONDITION OF APPROVAL:
1. Ten trees,minimum 2.5 inch caliper,shall be planted on the applicant's property within 15 feet of
the front property boundary along the 370 feet of fontage being developed prior to obtaining a
certificate of occupancy. At least half of the trees shall be native deciduous shade trees that are
expected to reach a minimum of 30 feet in height at maturity.
2. Such trees shall be maintained indefinitely and be replaced within one year if they die or are
severely diseased or damaged.
3. Prior to obtaining a building permit the applicant shall file an amended plan showing:
a. The street trees referenced in the above condition
b. All of the drainage going into a single stormwater treatment chamber(stormcepter), with the
chamber and chamber outfall located consistent with any requirements established by the
Conservation Commission in the issuance of their permit.
4. The lighting shall be limited to that shown on the plan. The lamps/light filaments shall not extend
below the fixture of said lights.
