Mr.Duca,
A routine inspection of your business located at 159 Pine Street,Northampton,MA was conducted by a Health Department
designee on June 8,2015, and revealed non-compliance with 105 CMR 590, 248 CMR State Plumbing Code and the
Northampton Board of Health Regulation of Fats, Oil and Grease Management.
Violations:
• A grease trap is required for the pot sink and commercial dishwasher
• Residential dishwasher prohibited
• The hand sink needs to be properly trapped and vented
• An indirect waste must be installed(floor sink)for the dishwasher drain
• ABS plastic pipe is not allowed to be used in a commercial kitchen
• A licensed plumber must perform plumbing work in Massachusetts
• A service sink must be available on the same floor
As addressed during the inspection,the existing mechanical ware wash unit does not meet minimum standards,however the
Health Department will allow continued use for 30 days contingent upon the following operational procedures are adhered to.
1) The two bay sink must be cleaned and sanitized previous to conducting ware wash practices. An approved sanitizer
solution(chlorine or quaternary ammonia)will be added to one or both of the compartments of the two bay sink.
The sanitizer solution shall have the correct concentration level. Chlorine 50-100ppm and quaternary ammonia 150-
200ppm. Temperature of sanitizer solution 75-100F. In addition, an appropriate sanitizer test kit will need to utilized
to ensure minimal concentration levels are obtained.
2) Following a full wash/sanitize cycle of the ware wash machine, all food contact surfaces shall be immersed in a
sanitizer solution for a duration of 30 seconds to 1 minute to ensure a proper contact time.
3) Subsequent to sanitization,food contact surfaces shall be adequately air-dried on drain board of the two bay sink.
4) The wash/sanitize cycle of the ware wash unit will be monitored using at temperature measuring device. The
recorded temperature will be documented in a daily log along with the sanitizer solution concentration levels.
The continued usage of the current mechanical ware wash unit will cease upon thirty(30) days of this notice. Compliance
with applicable provisions of the Food Code,105 CMR 590.000, sections 4-501.110 thru 4-502.11 will require a re-inspection
upon thirty(3 0)days of this notice.
All plumbing repairs and installations will require you to contact Larry Eldridge, Gas and Plumbing Inspector(413-
587-1271). The removal of the current ware wash unit and any new installations will require a permit from the Plumbing
Inspector. Please contact me with questions or concerns with this matter.

RE: ORDER to CORRECT VIOLATIONS
Dear Mr. Duca:
On August 3, 2015 you were sent a letter by our Cities Public Health Department. In that letter
a list of plumbing violations were stated and the proper code sections referenced. Both
plumbing and electrical work were performed at your 159 Pine Street, Florence, MA location
without proper permits and inspections. On June 8, 2015 an inspection by our Plumbing and
Gas inspector found the work improperly performed.
In addition to the violations regarding both plumbing and electrical it seems apparent that you
or agents hired by you have moved, rebuilt or altered the garage on the property also with no
building permits issued. This again, is another flagrant disregard to any building codes. No
work is to take place without receiving permits to do so by licensed parties. A stop work order
was issued on September 9, 2015.
These violations are of a serious nature and they need to be addressed and corrected.
This letter is to give you proper notice that if the needed permits are not obtained by
December 10, 2015. You will be fined $100.00 dollars per week for each week beyond
that date. Action will proceed within our court system at that time seeking an order to
compel corrections as needed and penalties may also be applied should the court see
fit. This is the only letter you will receive if corrective action is not taken before
December 10, 2015.
1 hope you will take steps to correct the violations and not force action on the part of the city of
Northampton.
