The common drive is approximately 450 LF in length with associated utilities and a stormwater management system. Site Terrain and Soils: The project site is located east of Water Street on the south side of Reservoir Road in Leeds. The site is situated on the northeast end of `Robert's Hill' and is characterized by steep grades that rise from north to south. The USDA Soil Survey of Hampshire County, Massachusetts, Central Part report classifies the site soils as (CrC, CrE) Charlton -Rock outcrop- Hollis complex: Deep, well drained soils on glaciated uplands. Soils formed in glacial till. Hydrologic Group: B (PcD) Paxton very stony fine sandy loam: Deep, well drained soils on glaciated uplands. Soils formed in glacial till. Hydrologic Group: C Stormwater Water Ouantity: Calculations were performed for the 2 -, 10 -, and 100 - year frequency storms under existing and proposed conditions. The results of the calculations are presented in Table 1 below. Table 1. Peak Flow and Peak Volume Summary Table As shown in Table 1, the stormwater peak flows in proposed conditions for the 2 -, 10 -, and 100 -year storms closely match those in existing conditions. Restrictive Covenant. No alteration of any "Waters of the United States within the Commonwealth" as shown on the Plan (the "Restricted Areas ") shall occur, except as set forth in the Order of Conditions. The following activity shall be prohibited in the Restricted Areas: placement of fill; placement of rubbish, garbage or debris; mechanical mowing; cutting or other disturbance of indigenous plant species; landscaping; placement of structures, pilings or impervious surfaces; any alteration of the substrate; and any other activity which would temporarily or permanently alter the Restricted Areas. This prohibition shall not be affected by the issuance of any Certificate of Compliance by the Conservation Commission. 4. Enforceability. So long as Declarant or his/her /its successors in interest shall retain record title to any of the Property, Declarant and such successors in interest shall have the sole authority and right to, and shall enforce the Declaration herein set forth. Any person having the right to enforce the provisions hereof shall have the right to bring proceedings in law or in equity against any party or parties violating or attempting to violate the terms of this Declaration, to enjoin them from so doing, and to cause any such violation to be remedied, after providing written notice to such party or parties and all mortgagees of record. 5. Severability. If any court or other tribunal determines that any provision of this instrument is invalid or unenforceable, such provision shall be deemed to have been modified automatically to conform to the requirements for validity and enforceability as determined by such court or tribunal. In the event the provision invalidated is of such a nature that it cannot be so modified, the provision shall be deemed deleted from this instrument as though it had never been included herein. In either case, the remaining provisions of this instrument shall remain in full force and effect. 6. Incorporation into Deeds, Mortgages Leases and Instruments of Transfer. Although the wetlands have been accurately. delineated, the final determination of the extent of the resource areas regulated under state law can be made only by the Northampton Conservation Commission or, upon appeal, by the Massachusetts Department of Environmental Protection (DEP). Site Description The property is located to the southwest of the junction of Reservoir Road and Water Street, and contains a single- family home. To the northwest, there is a well- defined stream channel with a relatively level fringe of wetland vegetation along it that is dominated by American elm. (Ulmus Americana), sensitive fern (Onodea sensibilis) and horsetail (Equisetum.spp.): The flat portion of thewedand is bounded by a very hillside; and numerous fingers - of-the wetland extend far b p this hill due to groundwater~ ditischarge e ll&ide. Many of these wedan`d 5iigers - werI saturated to the surface despite _the' r& - titely dry. - � of - -year iii Which the - delineation:was conducted. Flags A - 1= A =70 mark the - extent - of this °wetland. There is a second wetland area that was delineated behind.the a tstiing home. Although apparently man -made, the ditch in this area contA soils and is vegetated by wetland species including speckled alder (Alnus rugosa), sensitive fern and jewel weed (Impatiens capensis). This ditch drains in two directions. To the east, it drains into a culvert beneath the existing woods road, To the west, it joins the "A" wetland at flags A -8 and A -9. Flags B -1 to B -30 encircle this ditch. On the opposite side of the woods road, Flags C -1 to C -3 mark the outlet drainage where it meets Roberts Meadow Brook. The Mean Annual High Water (MAHW) line of Roberts Meadow Brook was marked with fl.aas HW -i to HW -16. The MAHW line was delineated an_ areas where the stream obviously overtops its banks as evidenced by sediment deposits. In these areas, the MAHW line was located to include all evidence of annual flooding. There are no fringe wetlands (other than the aforementioned C -1 to C -3 runoff channel) above the MAHW line to the west of the brook. Wetland Resource Areas The wetland delineation encloses the following resource areas as outlined in the State Wetland Regulations (310 CMR 10.00). There is a 100 -foot "buffer zone" to the resource areas. * Bank (10.54) * Land Under a Waterway (10.56) * Bordering Vegetated Wetland (10.55) The fallowing resource a e riot field delineated, and do not have any `buffer zone." • Riverfront Area (10.58) • Bordering Land Subject to Flooding (10.57) According to the USGS Easthampton Quadrangle, Roberts Meadow Brook is shown as a dark blue perennial waterway. The Regulations at 10.58 presume that such streams are rivers, and have a 200 -foot Riverfront Area associated with them. 2 It is likely that the small stream within the "A" wetland, although flowing slightly at the time of our site visit, is intermittent since it is not shown on the USGS maps and clearly drains a watershed of smaller than one -half square mile. According to Flood Insurance Rate Map 250167 0001 A, there is a 100 -year floodplain (Bordering Land Subject to Flooding) associated with Roberts Meadow brook. However, given the topography of the site, the floodplain is located very close to the brook itself and should have no effect on any proposed project on the developable portion of the site. A ` y am r � d el 3 r' Appendix One: Delineation Methodology The methodology employed in VES's wetland evaluation used both vegetation and hydrology as outlined in the Regulations at 310 CMR 10.55 and in the DEP handbook Delineating Bordering Vegetated Wetlands Linder the Massachusetts Wetlands Protection Act (1995). This is a two- parameter methodology, which requires that hydrophytic vegetation and wetland hydrology is present under normal conditions for an area to be considered a wetland. Hydrophytic vegetation was based upon the US Fish and Wildlife Service National st of Plafit Species . , r in Wetlands (19$8), _s well as all lent s _ cies that e sc� are sa e g season, water stained leaves, and hydric soils, which are often the best indicator of wetland hydrology during late summer and fall, when the water table is very low. This two- parameter methodology, since it includes hydric soils as an indicator of wetland hydrology, is also consistent with the three - parameter approach required for the delineation of federal wetlands as outlined in the Corps of Engineers Wetlands Delineation Manual (1987). The wetland boundaries as flagged in the field are the best professional opinion of the location and extent of the wetlands.
