The work authorized hereunder shall be completed within three years from the date of this Order unless either of the following apply: (a) the work is a maintenance dredging project as provided for in the Act; or (b) the time for completion has been extended to a specified date more than three years, but less than five years, from the date of issuance and both that date and the special circumstances warranting the extended time period are set forth in this Order. 5. This Order may be extended by the issuing authority for one or more periods of up to three years each upon application to the issuing authority at least 30 days prior to the expiration date of the order. 6. Any fill used in connection with this project shall be clean fill, containing no trash, refuse, rubbish or debris, including but not limited to lumber, bricks, plaster, wire, lath, paper, cardboard, pipe, tires, ashes, refrigerators, motor vehicles or parts of any of the foregoing. The applicant is prohibited from using demolition materials, asphalt, large chunks of concrete, tree stumps and limbs, and general refuse; 7. No work shall be undertaken until all administrative appeal periods from this Order have elapsed or, if such an appeal has been filed, until all proceedings, before the Department have been completed. In the case of recorded land, the Final Order shall also be noted in the Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to be done. In the case of registered land, the Final Order shall also be noted on the Land Court Certificate of Title of the owner of the land upon which the proposed work is to be done. POWERS RESERVOIR ROAD MAP #lOB LOT #41/42 NORTHAMPTON, MASSACHUSETTS INTRODUCTION: ..1 The subject parcel is a small approved building lot and is abutted by existing dwellings located to the east (Ho. #49) and west (Ho. #65). A third dwelling is also located to the northwest. Due to the location of the wetland boundary and the size of the parcel, the entire lot is within the 100 Foot Buffer Zone. One (1) single family residential dwelling is proposed for this lot. The existing wetland separates the subject parcel from the abutting parcel to the west, which is developed right up to the wetland boundary. The subject parcel is a vacant lot on which has been dumped a variety of materials ranging from sand and gravel to old blacktop and concrete slabs to automobile body parts. The construction of the proposed dwelling can be accomplished without detrimental impacts on the wetland while enhancing the appearance and maintenance of the site. Part II: SITE DESCRIPTION Natural Features: 1. Soils The US Soil Conservation Service classifies the soils in this area as Paxton series, a very stony fine sandy loam. This soil is characterized as deep and well drained with moderate permeability in the sub -soil and slow to very slow in the substratum. A seasonal perched water table is common. This perched water table is in evidence on this lot as groundwater leaches at the bottom of the sideslope thereby creating a wetland in the small gully along the western side of the lot. The actual building site, approximately fourteen (14) feet in elevation above the wetland channel, contains fill material which had been deposited on the lot over the years. Vegetation The subject site is densely vegetated along the wetland area. The upland area is predominantly open and covered with grasses. The upland canopy along the wetland dominated by staghorn sumac and poplar. The canopy in the wetland is dominated by Red Maple and American Elm. The ground cover within the wetland area is dominated by Jewelweed and Goldenrod. The shrub layer is dominated by Silky Dogwood. See Table 1 for a list of the vegetation identified. 3. Topography The site consists of a flat plateau sitting atop steep slopes. The lot slopes upward from the road (south end of lot) at a slope of 10 %± to the plateau where the house shall sit. The west side of the lot slopes downward from the house site to a small intermittent stream and bordering vegetated wetland at a slope of 35 % ±. The east side of the lot is level with the abutting lot. The existing dwelling (Ho. #49) sits slightly higher than the proposed dwelling. The north end of the lot slopes upward from the house site plateau to another, much larger plateau. 4. Open Water Bodies There are no open water bodies located on the subject parcel. The nearest open water body would be the municipal recreation area at the Roberts Meadow Reservoir, which is located approximately 750 feet upstream of the subject site. No runoff from the subject site can reach this open water body. 5. Flowing Water Bodies The bordering vegetated wetland delineated on this parcel includes a small, seasonal stream. This stream is predominantly fed by groundwater seeps from the steep slopes along the wetland, however, surface water runoff from the adjacent lots also contribute to the flow. The stream enters an existing culvert, flows under Reservoir Road, enters the outlet stream from the Roberts Meadow Reservoir, which then merges with the Mill River. 6. Public and Private Water Supplies This site shall be serviced by the City of Northampton municipal water supply. 7. Maximum Groundwater Elevations Maximum groundwater elevations on this lot have not been measured. James A. Boundaries of Resource Area(s) The wetlands on the subject property were delineated on June 14, 1993 according to the Massachusetts Wetlands Protection Act regulations which uses vegetation as the primary criteria for boundary determination. The boundary is marked in the field with orange surveyors flagging tied to vegetation. Man -made Features: 1. Structures There are currently no structures on the subject parcel. 2. Drainage and Flood Control Systems An existing 24" reinforced concrete culvert and poured concrete headwall are located within the Reservoir Road ROW at the southwest corner of the subject parcel. This culvert allows the intermittent stream to cross Reservoir Road. 3. Subsurface Sewage Disposal Systems The subject parcel shall be serviced by the City of Northampton municipal sewer system, therefore, no subsurface sewage disposal systems shall be required. 4. Underground Utilities There are no existing underground utilities on the subject parcel. 5. Roadways and Parking Areas The subject parcel contains no roadway, driveway, or parking areas. 6. Property Boundaries The subject parcel is bounded with iron pins at the corners of the lot. The property boundaries are shown on Drawing #93- 009 -2. James A. Structures The construction of a single family dwelling is proposed for the subject parcel. A small salt -box style dwelling shall be constructed. The building has been situated 15 feet off the easterly property line, the minimum sideyard setback distance, to maintain the maximum separation between the building and wetland. The building is located 35 feet from the wetland boundary at its closest point. The westerly side of the house shall include a walkout basement. The driveway shall run along this westerly side of the house. Two retaining walls shall be constructed where steep changes in grade are required. The proposed dwelling, retaining walls, and driveway has been designed to fit the topography of the lot by reducing the height of the slope along the wetland side of the building, thereby minimizing the potential for erosion. 2. Drainage and Flood Control Facilities There are no flood control structures proposed under this Notice of Intent. 3. Subsurface Sewage Disposal Systems There are no subsurface sewage disposal systems proposed under this Notice of Intent. Underground utilities shall enter /exit the dwelling through the front foundation wall and extend directly to the street. 4. Filling, Dredging, and Excavating This project does not include any Filling, Dredging, or Excavating within the wetland boundaries. Bordering Vegetated Wetland The Bordering Vegetated Wetland on this site shall be protected by the installation of a geotextile siltation fence (See Drawing #93- 009 -2). The siltation barrier shall also act as a limit of work barrier. A permanent undisturbed buffer shall be maintained between the wetland boundary and the proposed grading work. This buffer shall be 10' wide at its narrowest point while maintaining an average 20' separation the remaining length. No work has been proposed within the resource area with the exception of manual removal of the existing debris from the wetland. No machinery would be utilized. 2. Land Under Water There is no permanent Land Under Water since the stream is intermittent, however, the same siltation barrier which protects the BVW shall protect the intermittent stream. 3. Bordering Land Subject To Flooding Not Applicable. 4. 100 Foot Buffer Zone The proposed siltation barrier shall be installed before any work on this site begins. All disturbed areas upgradient of the resource area shall be graded and stabilized with vegetation immediately upon completion of said work. POWERS RESERVOIR ROAD MAP #lOB LOT #41/42 NORTHAMPTON, MASSACHUSETTS INTRODUCTION: The subject parcel is a small approved building lot and is abutted by existing dwellings located to the east (Ho. #49) and west (Ho. #65). A third dwelling is also located to the northwest. Due to the location of the wetland boundary and the size of the parcel, the entire lot is within the 100 Foot Buffer Zone. One (1) single family residential dwelling is proposed for this lot. The existing wetland separates the subject parcel from the abutting parcel to the west, which is developed right up to the wetland boundary. The subject parcel is a vacant lot on which has been dumped a variety of materials ranging from sand and gravel to old blacktop and concrete slabs to automobile body parts. An abandoned vehicle is presently stored on the lot. The construction of the proposed dwelling can be accomplished without detrimental impacts on the wetland while enhancing the appearance and maintenance of the site. Part II: SITE DESCRIPTION Natural Features: 1. Soils The US Soil Conservation Service classifies the soils in this area as Paxton series, a very stony fine sandy loam. This soil is characterized as deep and well drained with moderate permeability in the sub -soil and slow to very slow in the substratum. A seasonal perched water table is common. This perched water table is in evidence on this lot as groundwater leaches at the bottom of the sideslope thereby creating a wetland in the small gully along the western side of the lot. The actual building site, approximately fourteen (14) feet in elevation above the wetland channel, contains fill material which had been deposited on the lot over the years. Vegetation The subject site is densely vegetated along the wetland area. The upland area is predominantly open and covered with grasses. The upland canopy along the wetland dominated by staghorn sumac and poplar. The canopy in the wetland is dominated by Red Maple and American Elm. The ground cover within the wetland area is dominated by Jewelweed and Goldenrod. The shrub layer is dominated by Silky Dogwood. See Table 1 for a list of the vegetation identified. 3. Topography The site consists of a flat plateau sitting atop steep slopes. The lot slopes upward from the road (south end of lot) at a slope of 10 %± to the plateau where the house shall sit. The west side of the lot slopes downward from the house site to a small intermittent stream and bordering vegetated wetland at a slope of 35 % ±. The east side of the lot is level with the abutting lot. The existing dwelling (Ho. #49) sits slightly higher than the proposed dwelling. The north end of the lot slopes upward from the house site plateau to another, much larger plateau. 4. Open Water Bodies There are no open water bodies located on the subject parcel. The nearest open water body would be the municipal recreation area at the Roberts Meadow Reservoir, which is located approximately 750 feet upstream of the subject site. No runoff from the subject site can reach this open water body. 5. Flowing Water Bodies The bordering vegetated wetland delineated on this parcel includes a small, seasonal stream. This stream is predominantly fed by groundwater seeps from the steep slopes along the wetland, however, surface water runoff from the adjacent lots also contribute to the flow. The stream enters an existing culvert, flows under Reservoir Road, enters the outlet stream from the Roberts Meadow Reservoir, which then merges with the Mill River. 6. Public and Private Water Supplies This site shall be serviced by the City of Northampton municipal water supply. 7. This culvert allows the intermittent stream to cross Reservoir Road. 3. Subsurface Sewage Disposal Systems The subject parcel shall be serviced by the City of Northampton municipal sewer system, therefore, no subsurface sewage disposal systems shall be required. 4. Underground Utilities There are no existing underground utilities on the subject parcel. 5. Roadways and Parking Areas The subject parcel contains no roadway, driveway, or parking areas. 6. Structures The construction of a single family dwelling is proposed for the subject parcel. A split level dwelling with garage has been selected for this lot (See Figure 3). The design of this proposed dwelling shall fit the topography of the lot by minimizing filling required along the wetland side of the building. 2. Drainage and Flood Control Facilities There are no flood control structures proposed under this Notice of Intent. 3. Subsurface Sewage Disposal Systems There are no subsurface sewage disposal systems proposed under this Notice of Intent. Underground utilities shall enter /exit the dwelling through the front foundation wall and extend directly to the street. 4. Filling, Dredging, and Excavating This project does not include any Filling, Dredging, or Excavating within the wetland boundaries. The excavation and grading work proposed within the 100 Foot Buffer Zone shall be limited to the following: installation of underground utilities, construction of a paved driveway, and regrading and stabilization of the new side - slopes between the dwelling and the wetland boundary. 5. Point Source Discharge No Point Source Discharge into the resource area has been proposed under this submittal. Drainage patterns shall remain approximately the same post - development as pre - development. Bordering Vegetated Wetland The Bordering Vegetated Wetland on this site shall be protected by the installation of a geotextile siltation fence (See Drawing #93 -009). The siltation barrier shall also act as a limit of work barrier. A permanent undisturbed buffer shall be maintained between the wetland boundary and the proposed grading work. This buffer shall be 7' wide at its narrowest point while maintaining an average 15' separation the remaining length. No work has been proposed within the resource area with the exception of manual removal of the existing debris from the wetland. No machinery would be utilized. 2. Land Under Water There is no permanent Land Under Water since the stream is intermittent, however, the same siltation barrier which protects the BVW shall protect the intermittent stream. 3. Bordering Land Subject To Flooding Not Applicable. 4. 100 Foot Buffer Zone The proposed siltation barrier shall be installed before any work on this site begins. All disturbed areas upgradient of the resource area shall be graded and stabilized with vegetation immediately upon completion of said work. Mr. Harold Tacy explained his plans to relocate a driveway to the west of his house, lower the grade around the foundation of the house, cut some trees, clear some:br"h and reduce the steepness of the driveway at his property on Reservoir Road in Leeds. 2. In response to questions from the Commission, Mr. Tacy said that the driveway would be paved and that he did not expect to bring in any off -site fill for re- grading the driveway and the slope to the west of the house. He also estimated that no trees closer than 75 feet from the culvert would be removed. 3. Mr. Tacy said that he planned to loam and seed the regraded areas. Part of the standing water on the lot appears to be a result of poor maintenance of the culvert by the City. 4. Mr. William Barrett of 36 Reservoir Road spoke in favor of the project, saying he felt it would be an improvement to the neigh- borhood.
