HARDSHIP: CONDITION OF APPROVAL: 1)Prior to construction on any portion of the project, the applicant must obtain approval from the Northampton Conservation Commission. FINDINGS: The Planning Board approved the creation of the flag lot and shared driveway with conditions based upon the plans submitted with the application and comments at public hearing. In approving the special permit for the flag lot and site plan for the shared driveway the Board determined that the following items in the ordinance for special permit had been addressed. (1)The requested use protects adjoining premises against seriously detrimental uses. The site for the existing house as well as the proposed are well back behind the street beyond a stand of trees. (2) The requested use will promote the convenience and safety of vehicular and pedestrian movement within the site and on adjacent streets, minimize traffic impacts on the streets and roads in the area. If applicable, this shall include considering the location of driveway openings in relation to traffic and adjacent streets, access by emergency vehicles, the arrangement of parking and loading spaces, and provisions for persons with disabilities; The site has an existing driveway that will meet the standards in for shared driveway and (3) The requested use will promote a harmonious relationship of structures and open spaces to the natural landscape, existing buildings and other community assets in the area; No new disturbed areas will be created. and (4) The requested use will not overload, and will mitigate adverse impacts on, the City's resources including the effect on the City's water supply and distribution system, sanitary and storm sewage collection and treatment systems, fire protection, streets and schools; and (5) The requested use meets any special regulations set forth in chapter 350-6.10 for flag lots layouts and 8.8R Shared driveways for residential access : This driveway provides the only vehicular access to the lots being serviced by it, and shall be so stated in the lot deeds. The driveway is of suitable construction, grade, length and location, in the opinion of the Planning Board, for the access and turnaround of cars, trucks, ambulances, fire, and police, which will be utilizing such driveway and shall have passing turnouts providing a total width of at least 20 feet along a distance of at least 25 feet, spaced with no more than 300 feet between turnouts, and with the first such passing turnout being located within 10 feet of the driveway connection to the street, and shall conform to all other driveway requirements of this chapter. The driveway shall be described on easements and easement plans with shared maintenance responsibilities . (6) The requested use bears a positive relationship to the public convenience or welfare. The use will not unduly impair the integrity of character of the district or adjoining zones, nor be detrimental to the health, morals, or general welfare. The site for the new house will be located in an area that previously contained a structure. (7) If applicable, the requested use will promote City planning objectives to the extent possible and will not adversely affect those objectives, as defined in City master or study plans adopted under MGL c. 41, § 81C and 81D.
