In addition, the applicant has made adequate provisions for surface water drainage as depicted on plans and information submitted with the Special Permit application. B. The requested use will promote the convenience and safety of vehicular and pedestrian movement within the site and on adjacent streets, minimize traffic Impacts on the streets and roads In the area because no significant additional traffic is anticipated. C. The requested use will promote a harmonious relationship of structures and open space to the natural landscape, existing buildings and other community assests in the area because the buildings are sited for privacy and setbacks from the road. 0. The proposed use will not overland the City's resources,Including the City's water supply and distribution system, sanitary and storm sewage collection and treatment systems, fire protection, streets and schools because there will be a on-site weft and septics to service each house site.In addition, the impacts to the adjacent wetlands will be protected with erosion control barriers 6 replacement areas to be constructed in accordance with the Conservation Commission. Alf stormwater will be handled on site. E. The requested use meets the special regulations set forth in the Zoning Ordinance as listed in Sections 6.12.14.0 b 16.0(See Attachment A). F. The use will not unduly impair the integrity of character of the district or adjoining zones, nor be detrimental to the health, morals,or general welfare and the use shall be in harmony with the general purpose and Intent of the Ordinance. G.The requested use will promote City planning to the extent passible and will not adversely effect those objectives,as defined in City master or study plans adopted under M.G.L.Chapter 41,Section 81-C and D because the proposed project is very low density which is in character with rural residential setting of the area and zoning district The project maintains the character of a wooded open space. in addition, the common driveway will be constructed in accordance with requirements set forth by the Conservation Commission. [ ] When installed in the building envelope, recessed lighting fixtures shall meet one of the following requirements: 1. Type IC rated, manufactured with no penetrations between the inside of the recessed fixture and ceiling cavity and sealed or gasketed to prevent air leakage into the unconditioned space. 2. Type IC rated,in accordance with Standard ASTM E 283,with no more than 2.0 cfin(0.944 Us)air movement from the the conditioned space to the ceiling cavity. The lighting fixture shall have been tested at 75 PA or 1.57 lbs/ft2 pressure difference and shall be labeled. Vapor Retarder: [ ] Required on the warm-in-winter side of all non-vented framed ceilings, walls, and floors. Materials Identification: [ ] Materials and equipment must be identified so that compliance can be determined. [ ] Manufacturer manuals for all installed heating and cooling equipment and service water heating equipment must be provided. [ ] Insulation R-values,glazing U-factors,and heating and cooling equipment efficiency must be clearly marked on the building plans or specifications. Duct Insulation: [ ] Ducts shall be insulated per Table J4.4.7.1. Duct Construction: [ ] All accessible joints, seams, and connections of supply and return ductwork located outside conditioned space, including stud bays or joist cavities/spaces used to transport air, shall be sealed using mastic and fibrous backing tape installed according to the manufacturer's installation instructions. Mesh tape may be omitted where gaps are less than 1/8 inch. Duct tape is not permitted. [ ] The HVAC system must provide a means for balancing air and water systems. Temperature Controls: [ ] Thermostats are required for each separate HVAC system. A manual or automatic means to partially restrict or shut off the heating and/or cooling input to each zone or floor shall be provided. Heating and Cooling Equipment Sizing: [ ] Rated output capacity of the heating/cooling system is not greater than 125%of the design load as specified in Sections 780CMR 1310 and J4.4. Circulating Hot Water Systems: [ ] Insulate circulating hot water pipes to the levels in Table 1. Swimming Pools: [ ] All heated swimming pools must have an on/off heater switch and require a cover unless over 20% of the heating energy is from non-depletable sources. Pool pumps require a time clock. Heating and Cooling Piping Insulation: [ ] HVAC piping conveying fluids above 120 T or chilled fluids below 55 T must be insulated to the levels in Table 2. ATTACHMENT A Section 16.7 Water Supply Protection District. In reviewing the application for a Special Permit with Site Plan Approval for a single-family home, the Planning Board found said lot has: A. The proposed use will promote the purposes of the Water Supply Protection District, because ground water will be recharged and the low density of the project preserves open space. B. The proposed use is appropriate to the natural topography, soils and other characteristics of the site to be developed because one lot is proposed with minimal site disturbance of the area; C. The proposed use has suitable soil for on-lot sewerage and water systems because the Board of Health has conducted a valid percolation test for the construction of a septic system. D. The project will not, during construction or thereafter, have an adverse environmental impact on groundwater resources in the district because there will be minimal site disturbance and the adjacent isolated wetland will be protected and wooded open spaces will remain undisturbed as a buffer to the wetlands. E. The proposed use will not adversely affect the existing or potential quality and quantity of water in the Water Supply Protection District because clean stormwater runoff will be recharged on the site and enhance ground water. 1 a Planning Board - Decision City of Northampton File No.: PL-I -2003-0035 Date: December 20, 2002 Pursuant to Massachusetts General Laws(MGL),Chapter 40A,Section 11,no Special Permit with Site Plan,or any extension, modification or renewal thereof, shall take effect until a copy of the decision bearing the certification of the City Clerk that twenty days have elapsed after the decision has been filed,or if such an appeal has been filed that it has been dismissed or denied,is recorded in the Hampshire County registry of Deeds or Land Court,as applicable and indexed under the name of the owner of record or is recorded and noted on the owner's certificate of title. The fee for such recording or registering shall be paid by the owner or applicant. It is the owner or applicant's responsibility to pick up the certified decision from the City Clerk and record it at the Registry of Deeds.(Please call the City Clerk prior to picking up the decision.) Applicant: Sweet Meadow Properties-North Farms Road DECISION DATE: December 12,2002 DECISION FILED WITH THE CITY CLERK: December 20, 2002 Planning Board - Decision City of Northampton Hearing No.: PLN-2003-0035 Date: December 20, 2002 neighborhood. D. The proposed use will not overload the City's resources, including the City's water supply and distribution system, sanitary and storm sewage collection and treatment systems, fire protection, streets and schools because there will be an on-site well and septic to service the proposed single-family house. E. The requested use meets the special regulations set forth in the Zoning Ordinance as listed in Sections 5.2, 10, 14& 16.(See Attachment A). F. The requested use bears a positive relationship to the public convenience or welfare because the project is in context with the surrounding neighborhood and complies with zoning district, WSP overlay district and WP overlay district requirements. The use will not unduly impair the integrity of character of the district or adjoining zones, nor be detrimental to the health, morals, or general welfare and the use shall be in harmony with the general purpose and intent of the Ordinance. G. The requested use will promote City planning to the extent possible and will not adversely effect those objectives,as defined in City master or study plans adopted under M.G.L. Chapter 41,§81-C and D because the proposed project is very low density and will retain the existing wooded open space. In addition,in reviewing the Site Plan submitted with the application, the Planning Board found that the application complied with the following technical performance standards: 1. Only one new curb cut is proposed. 2. Pedestrian, bicycle and vehicular traffic area separated on site to the extent possible. The Planning Board voted 6:1 to Grant the waivers as requested in the application. In addition, the applicant has included provisions for surface water drainage, sound and sight buffers and preservation of views, light and air,as depicted in plans and information submitted with the application. B. The requested use will promote the convenience and safety of vehicular and pedestrian movement within the site and on adjacent streets, minimize traffic impacts on the streets and roads in the area because no significant traffic will be generated with the additional single-family house. C.
