32A-058 (23) DECISION OF ZONING BOARD OF APPEALS At a meeting held on April 24, 1985, the Zoning Board of Appeals of the City of Northampton voted unanimously to arm ant the Sn c;al Permit request of Theodore E. Dimauro (Carl Pagella; Frederick Pugliano), 1350 Main Street, Springfield, Massachusetts to convert the former Union Street Jail into 25 condominium units at 50 Union Street, Northampton. Present and voting were: Chairman Robert C. Buscher, William Brandt and Peter Laband. The findings were as follows: W. Brandt found that the use is listed in the Table of use Regulations or elsewhere in the Ordinance for the Special Permits requested; that the requested use bears a positive relationship to the public welfare as the applicants estimate the cost of the condominiums to be in the $65,000 - $85,000 range, which will fill a much needed demand for housing in the moderate to middle income range; that the requested use will not create undue traffic congestion or unduly impair pedestrian safety if the developer provides 50 parking spaces as opposed to the 40 requested; that the requested use will not overload any public i utilities any more than the prior use; that Article XI does not apply; and that the requested use will not impair the integrity of the area. P. Laband concurred. R. Buscher concurred, adding that if the building were not used for residential, it would be out of character with the neighborhood. The following conditions shall apply: i 1. That the traffic shall flow one-way through the parking lot from Union Street to Cherry Street. 4 2. That the applicants shall provide for the required 50 parking spaces. 3. That the stone pillar at the left of the driveway entrance jbe removed. A 4. That two sections of the existing fence be removed. 2 5. The application must be completed using a typewriter or hand printed block-type letters. All numbered items on the application must be completed. When completed and signed by the applicant, the application should be submitted to the Building Inspector for filing. Even though received, the application will not be considered "filed" with the Building Inspector until it has been-reviewed to insure proper completion. A review of the application will be made within two business days from the date received by the Building Inspector. The applicant will be notified of any additional information required. Applicants seeking a VARIANCE should note that the Zoning Board of Appeals has the power to authorize a variance from the terms of the applicable zoning ordinance where the Board determines that the applicant has met all requirements set forth in Massachusetts General Laws, Chapter 40 A, Section 15. Reference should be made to applicable Massachusetts Law and to Chapter 44 of the Revised Ordinances of the City of Northampton, Massachusetts, 1959, as amended.
