Re: Notice of Intent Filing, Proposed Driveway, Sylvester Road

Staff have reviewed the NOI filing for the above-referenced project. Staff have reviewed the NOI
and determined it to be incomplete. A Conservation Commission hearing cannot be scheduled
until the issues outlined below have been addressed. Additional comments regarding
compliance with the Wetlands Protection Act and Northampton Wetlands Ordinance will be
provided.
1) A hearing will not be scheduled until a file number is issued.
2) All involved property owners must sign the Notice of Intent.
3) All involved parcels must be used when requesting an abutters list – the abutter list
requested was only for parcel 20-011, and did not include all properties on which work is
proposed. An additional mailing will need to be provided to any abutters not included in
the first mailing.
4) Northampton’s local application must be completed.

5) The driveway crosses property that is not owned by the applicant. Site Plan Approval
from the Northampton Planning Board will Be required pursuant to §350-8.8 of the
Northampton Code; “Driveways shall not cross lot lines of adjoining properties without
Planning Board site plan approval.”
6) Total site disturbance is greater than one acre, and will require a stormwater
management permit from the Northampton Department of Public Works.
7) Pursuant to 310CMR 10.05, the permits listed in items 4 and 5 should be obtained or
applied for prior to consideration of the Notice of Intent.
8) The Notice of Intent includes delineation of wetland resource areas. Pursuant to §337-6
C (3) of the Northampton Wetlands Ordinance, staff will recommend that the hearing
not be closed until snow melts and/or ground thaws.
9) The application was submitted as both a limited project, including a replacement stream
crossing, and a riverfront redevelopment project. Please note that projects with existing
roadways are not eligible to be treated as limited projects.
