stand, platform, swimming pool, -shelters, piers, wharves, bin, fence, sign, gasoline pumps,
recreational courts, or the like.
STRUCTURE,ACCESSORY:Any structure which is incidental and subordinate to the principal
structure,but which is located on the same lot as the principal structure. Accessory structures shall
not exceed forty(40)percent of the gross floor area of the principal structure(s)and shall not contain

STRUCTURE,NONCONFORMING: A structure lawfully existing at the effective date of this
Ordinance, or any subsequent amendments thereto, which does not conform to all applicable
regulations of this Ordinance for the district in which it is located.
SUBSTANTIAL LWROVEMENT: Any repair, reconstruction, or improvement of a structure
within a five year period which either increases the building area or the original structure by
fifteen(15%) or more, or the cost of repair,reconstruction, or improvement which equals or

of the antenna above the tower or building. Such signals shall include but not be limited to radio,
television, cellular, paging, personal communication services (PCS) and microwave

costs there will be no further inspections or a certificate of occupancy issued. If the costs
exceed the 15% threshold you will be required to file for a Special Permit from the
Planning Board as per 5.2 of Northampton Zoning Ordinances.

Subject: Violation of Northampton Zoning 5.2 substantial improvement in WP
Dear Mr. Jasinski,
The building permit application you submitted on March 2, 2004 and subsequently
approved stated that the cost of renovation was to be $18,500. The scope of work that
was listed by you was "new bath, kitchen sheetrock,windows doors". The cost
breakdown that you submitted was as follows;
a. Building $15,000
b. Electrical $ 2000
c. Plumbing $ 1500
For a total of $18,500
I have talked to each of the inspectors who have been to your property as well as to the
Board of Health Inspector. The first floor was gutted, the electrical service has been
upgraded and you must install a new septic system.
The assessed value of your property land and buildings at time of your building permit
application (copy field card attached) was $143,700, 15%of this value would be
$21,555.
Since your building permit did not include septic and the scope of work you described on
your application has been exceeded it appears that you will have substantial
improvements that will exceed 15% of value of property. As such you would be in
violation of 5.2 (copy attached) and 2.0 definition of substantial improvement (copy
attached).
