A "Driveway Permit" is required in all cases where a new curb cut or an alteration to an existing curb cut is proposed on a city public way. Z. Purpose - The purpose of Residential Incentive Development (Overlay) District is to provide, by Special Permit, housing opportunities that are affordable for low and moderate income persons. This will be accomplished by allowing the development of housing at somewhat greater rate densities than are normally permitted by the zoning ordinance, under certain conditions, specified below. 2 . The Planning Board may issue a Special Permit for a development in the Residential Incentive Development (Overlay) District, permitting a density not to exceed an overall density of four (4) units per acre, whereby said development: a. Provides that a minimum of thirty-three (33) percent of the total units in the development must be sold or rented, and maintained at affordable prices, for low and moderate income families, according to the following definition. The gross floor area of an accessory apartment (including any additions) shall not be more than thirty (30) percent of the building ' s gross floor area, nor be any greater than eight hundred (800) square feet. Apartments in accessory buildings are not accessory apartments . F. Once an accessory apartment has been added to a single- family residence, the accessory apartment shall never be enlarged beyond the eight hundred (800) square feet allowed by this ordinance . G. An accessory apartment may not be occupied by more than three (3) people. H. Three off-street parking spaces must be available for use by the owner-occupant(s) and tenants . I . The design and room sizes of the apartment must conform to all applicable standards in the Health, Building, and other codes. J. Zoning Permits issued under this section must be recorded in the land records, with documentation of the recording provided to the Building Inspector, prior to the occupancy of the accessory apartment. H. When a structure which has received a Permit for an accessory apartment is sold, the new owner (s) , if they wish to continue to exercise the Permit, must, within thirty (30) days of the sale, submit a notarized letter to the Building Inspector stating that they will occupy one of the dwelling units on the premises as their primary residence. This statement shall be listed as condition on any Permits which are issued under this Section. I. Prior to issuance of a permit, the owner (s) must send a notarized letter stating that the owner will occupy one of the dwelling units on the premises as the owner ' s permanent/primary residence, except for bona fide temporary absences . J. Prior to issuance of a permit, a floor plan of one- quarter (1/4) inch to the foot must be submitted showing 02/18/93 11-29 --- shall be included in the application. Written comments, if any, by all reviewing agencies and any State agency, department, board, commission, division, or authority which has jurisdiction by law or special expertise with respect to any environmental impact involved shall be included as addenda to the Environmental Review. Section 11. 9 - Accessory Apartments An Accessory Apartment, or In-Law Apartment, is a self-contained housing unit incorporated within a single-family dwelling (not within accessory structures) which is a subordinate part of the single-family dwelling and complies with the criteria below. 1 . The intent of permitting accessory apartments is to: A. Provide older homeowners with a means of obtaining rental income, companionship, security and services, and thereby to enable them to stay more comfortably in homes and neighborhoods they might otherwise be forced to leave; B. Add moderately priced rental units to the housing stock to meet the needs of smaller households and make housing units available to moderate income households who might otherwise have difficulty finding housing; C. Develop housing units in single-family neighborhoods that are appropriate for households at a variety of stages in their life cycle; D. Protect stability, property values, and the single-family residential character of a neighborhood by ensuring that accessory apartments are installed only in owner-occupied houses; E. To provide housing units for persons with disabilities . 2 . The following conditions are requires for all accessory apartments: A. The apartment will be a complete, separate housekeeping unit containing both kitchen and bath. B. only one accessory apartment may be created within a single-family house. C. The vertical cracks at the corners of the foundation wall and the 1/2"crack up the wall between the house and garage are the result of frost heaves. Apparently,water from the roof,which was incomplete at the time, and the front porch area seeped under the footing and the slab. The wall between the house and garage is not a bearing wall with only partition dead load and not reinforced. The minimal load on this wall could not counteract the forces due to the frost heaves and resulted in a large crack. There are minor cracks at the corners of the foundation propagated from the slab cracks. At these corner locations, one side of the corner is a bearing wall with wall and floor dead load and roof snow load. On the other side of the corner,the wall is only loaded with the wall dead load,which could not counteract the frost heave action, resulting in the hairline cracks. Although there are vertical cracks in the foundation, the structural integrity of the walls are maintained. There are no cracks in the bearing walls, and the contractor has reported that this wall has reinforcing. These cracks should be repaired with the standard practice of concrete repair utilizing grout and/or epoxy. The large crack should be chiseled out so adequate primer could be applied to ensure adhesion between new concrete and old concrete. There is a hairline crack from the corner of a window well to the corner of the wall. This is a shrinkage crack and should also be repaired. 30 Industrial Drive East • P.O.
