The planning board is considering amendments to the URC zoning district regulations which will require site plan
approval for a new principal structure on a lot already occupied by a principal structure. I've attached a copy of the
proposed ordinance changes. Since the notice of the hearing was published before we issued a building permit,
the new house will be subject to the amended ordinance. This happens because of MGL chapter 40A, section 6:
"(a)...zoning ordinance shall not apply to structures or uses lawfully in existence or lawfully begun, or to a valid
building or special permit issued before the first publication of notice of the public hearing on this chapter or to
any other exemptions in accordance with MGL c. 40A, § 6. The ordinance shall apply to any change or
substantial extension of such use, to a building or special permit issued after the first notice of said public
hearing, to any reconstruction, extension or structural change of such structure, and to any alteration of a
structure begun after the first notice of said public hearing to provide for its use for a substantially different
purpose or for the same purpose in a substantially different manner or to a substantially greater extent."
The amended ordinance, if passed, would require site plan approval for the Union Street project. I don't see a
problem with approval based on the plans you submitted.
There is a public hearing with the Planning Board and the Ordinance Committee on Monday, May 12 at 6:00 in
the city council chambers.
