SUBJECT: Request of Bob Roscoe
A meeting is scheduled in my office on Monday, December 12 at 11:00 a.m. to
discuss the request of Bob Roscoe of Pine Valley Road to build a home for
his daughter on his land on Pine Valley Road across from his home.
The problem as I understand it is that Pine Valley Road is not a City-
accepted street, although it does have utilities and an access roadway.
I would like to look for ways to have this father provide housing for his
daughter who I understand is a single parent with several children.

Duclos ' assurance that it would be permissible. As You can see,
this is in fact not the case. Mr. Racicot has one of two
avenues that he can pursue:
1) apply to the ZBA for the required Variances, for which
it appears that he doesn' t meet the statutory
requirements for receiving (keep in mind that the ZBA
has already issued him one highly questionable Use
Variance for his auto repair business which has been
appealed and in all probability will be overturned by
the courts) ,
or
2) he can build a subdivision road, for which it appears
is pretty obviously too expensive.

Relative to the proposal for Mr. Racicot to construct an
additional house on his property on Pine Valley Road, I will
offer the following:
1) Under the Zoning Ordinance
a) Section 6 . 8( 2. ) prohibits the placement of more than
one single-family home on any single lot, (a Variance
would be necessary) ,
and
b) In the SR District each lot is required to have 30 ,000
sq.ft. with 125 ft. of frontage. As listed in the
Northampton Assessor' s Office, Mr. Racicot presently
owns two abutting parcels of land comprised of 80, 290
sq.ft. with no frontage. (a Variance would be necessary
due to the lack of frontage) ,
2) Under the subdivision Control Law
a) The Planning Board would be unable to approve a plan
subdividing or re-creating these lots as they do not
have adequate frontage on a sufficient "way" as
established and' de'fined under state law. His
alternative would be to create adequate frontage on a
sufficient way, which would involve the building of a
subdivision road at a construction cost of
approximately $200/ft. with $10-40,000 in engineering
expenses.
In Summary
Apparently Mr. Racicot' s interest in building an additional house
for his daughter was fueled by then Building Inspector Paul

I have received a memorandum concerning Robert Racicot' s
request to build a second single family home on his property on
Pine Valley Road. This matter was thoroughly discussed at a
meeting of the Building Inspector' s Advisory Group.
It was the opinion of all staff present at that meeting that
there is no possible way for Mr. Racicot to build a second house
on that property without extensive zoning relief from the Zoning
Board of Appeals. Pine Valley Road is not a public way, a
private way meeting the specifications of the Planning Board, or
a subdivision way. Actually, it does not even appear on the
City' s Assessor' s maps.
In order to build a house, Mr. Racicot, at the very least,
would need variances from the Zoning Board of Appeals for ( 1)
lack of frontage on the proper type of way, and ( 2) two principal
structures on the same lot. In the alternative, he could improve
Pine Valley Road to the standards acceptable to the Planning
Board. He might then be able to get an "approval not required"
plan endorsed by the Planning Board.
I feel it would be a waste of everyone' s valuable time to
meet again on this matter. I 'm sure my office and the Office of
Planning and Development would be happy to discuss the relief
needed with Mr. Racicot' s attorney again. However, I reiterate,
without zoning relief there is nothing that can be done.

Dear Bob:
I met with Building Inspector Ted Tewhill, Sr. Planner Larry Smith, and
Assistant City Solicitor Kathleen Fallon on December 12, 1988 relative
to your request to construct a home for your daughter across from your
building on Pine Valley Road.
All of the above mentioned stated that there is no way possible under present
zoning law that you would be allowed to construct a home at that location
without a variance from the Zoning Board of Appeals. All thought that it
would be very difficult to secure such a variance.
I am enclosing a memorandum from Attorney Fallon on the subject. Bob, I am
truly sorry that you will apparently not be able to build there because
from what you've told me, your daughter and her children certainly are in
need; but I am reminded that the law will not allow this action.
