DEGISIUN OF THE
ZONING BOARD OF APPEALS
At its meeting on Wednesday, February 210 1979, the Zoning
Board of Appeals for the City of Northampton voted to grant the
petition of Robert Kania for a Variance to subdivide a parcel of
land on Drewson Drive and allow a single family home to be cons-
tructed on a lot formerly known as Map 35, Parcel 118, which does
not meet the dimension requirements.
Based upon evidence presented to the Board, the Board made the
following findings in regard to the Variance:
1. The property in its present form is unique and has prob-
lems affecting it and no other in the Zoning District because
it is the only large lot in a subdivision of lots approxi-
mately one—third its size.
2. Literal enforcement of the Zoning Ordinance would involve
substaitial hardship to the owner as the undeveloped character
of the lot makes it a prime target for loitering and vandalism
and its size makes it costly for the owner to maintain it and
pay taxes on it.
3. The proposed use will not be detrimental to the public
good as the construction of a single family house would pro-
vide additional living space, put the property to its best
possible use, and curb vandalism and loitering.
4. The granting of a Variance will not nullify or derogate
the intent of the Zoning Ordinance as the majority of homes
in the neighborhood are built on parcels comparable in size
to Lot 1i8.
