HARDSHIP: CONDITION Or APPROVAL: 1) Prior to issuance of a building permit a final revised site plan shall be submitted for amendment to the Planning Board for approval. The site plan shall show final driveway location, water and sewer connections and layout of the structures. 2). Water and sewer connection must be reviewed by Department of Public Works relative to juncture between force main and gravity flow. 3). No dumpsters are allowed on either lot. 4). A common driveway should be constructed within the 30'right of way meeting all standards in zoning ordinance. 5). There shall be no individual driveways serving the lots. One curb-cut for the common driveway shall be created for the 2 lots. FINDINGS: The Planning Board granted the Special Permit for the cluster open space development for the creation of two lots in either 2 units or 4 units(2 per lot)based on the following plans submitted with the application materials: 1."Plan of Land in Northampton"prepared by The Berkshire Design Group, Inc. dated 914108 Sheet 1. In granting the permit, the Board found the following special permit criteria in section 350-10 and 11 had been met. 1) The requested use protects adjoining premises against seriously detrimental uses. The demolition of the existing structure and creation of 2 house lots on 12+acres is far less dense than what could be developed otherwise. Surface water drainage will be contained on site, sound and sight buffers and preservation of views, light, and air; will be achieved through preservation of most of the parcel under permanent protective status. (2) The requested use will promote the convenience and safety of vehicular and pedestrian movement within the site and on adjacent streets, minimize traffic impacts on the streets and roads in the area. if applicable, this shall include considering the location of driveway openings in relation to traffic and adjacent streets, access by emergency vehicles, the arrangement of parking and loading spaces, and provisions for persons with disabilities. The project, including any concurrent road improvements, will not decrease the level of service(LOS) of all area roads or intersections affected by the project below the existing conditions when the project is proposed.
