There is now a twenty (20) day appeal period you must await. After the appeal period is up, you must go to the City Clerk' s office and get a stamped copy from them which will indicate that there has. been no appeals on the decision you received from the Zoning Board. Then bring the stamped copy they give you over to the Registry of Deeds and file it with them, but be sure they give you a copy to give to us to keep on file in our office. Then you can come to our office to apply for the building permit, but until all the above listed steps are complete our office can 't issue you the building permit. Be sure to get the above mentioned copy from the Registry of Deeds , so we can process the building permit immediately. For Your Information: Zoning Ordinance Section 10.6 - Permit Time Limits. A Zoning Board Decision granted under the provisions of Section 10. 10 shall lapse within eighteen (18) months (including such time re- quired to pursue or await the determination of an appeal ) from the grant thereof has not sooner commenced except for good cause, or if, in the case of a permit for construction, construction has not begun by such date except for good cause. The burden of these restrictions shall run with the land and shall be binding on all future owners of an interest therein. The right of enforcement shall be as provided for in M.G.L. , Chapter 184, Section 32 as enacted by the Acts of 1969 , Chapter 666, Section 5 , as it may be amended from time to time. 7 . Buscher, Chairman Peter Laband Irene bavid i i' i' n atx n � JU 1987 � DEPT.Of BUILDING WrECTIOW NORTHAMPTON,MA.0:050 .�� � w �� �. .. x i � ►oNS,. � DECISION OF of etnlaM BOARD OF APPEALS At a meeting held on May 20, 1987, the Zoning Board of Appeals of the City of Northampton rgant�ed the Finding request of John Gibson, 144 West Street�, Northampton, MA.. , for the purpose of converting an existing structure, which is nonconforming in its setback requirements into a single-family residence on a lot which is nonconforming in its area at property located at 185 West FarM&_ Road, Northampton, MA. Present and voting were: Chairman Robert C. Buscher, Peter Laband and Irene David. The findings were as follows: P. Laband stated that he was familiar with the building and is aware that it is deteriorating. He found that if this structure is not being used for public use, the most suitable use for the building is for a private single-family residence. He also found that the proposed use will not require more square footage than the present use (Section 9 . 3 C. ) and will not be more detrimental to the neighborhood than the existing use. I . David concurred, noting that included in the agreement is a clause which allows the owner to change the cupola if he/she wishes. R. Buscher found that the requested use is one of a few appropriate uses for this structure, and that a single-family residence represents a less intensive use, less traffic and less detriment to the neighborhood than the current use. The following conditions shall apply: 1. The architectural integrity of the building presently located on the property shall not be altered or changed. 2. The facade of the property shall be maintained in its present architectural design. However, if the owner wishes to remove the cupola, the owner shall be allowed to do so and such removal shall not be considered to be a violation of these restrictions. 3. The repair and/or replacement of windows shall be done in such a manner as to retain the present architectural design of the windows. I 4. A monument shall be allowed and maintained on the real estate near the building which identifies the building as the West Farms Chapel and the date of construction. 5. Before any alteration may be made to the premises in II violation of the foregoing restrictions, the owners must ' submit a written request to the Northampton Historical Commission. Approval will not be unreasonably withheld. i i _
