PERMIT GRANTED ON MARCH 24, 19 8 8 TO CREATE A FLAG LOT, TO ALLOW FOR
A COMMON DRIVEWAY SERVING THREE LOTS, AND TO EXTEND THE LIFE OF THE
SPECIAL PERMIT BY EIGHTEEN MONTHS.
Pursuant to the Provisions of the General Laws of the Commonwealth
of Massachusetts, Chapter 40A, Section 15, notice is hereby given
that a decision of the Planning Board of the City of Northampton
was filed in the Office of the City Clerk
On: May 15, 1989
Granting the Special Permit amendment, and extending the life of
the Special Permit 18 months from April 27, 1989.
For Property Located at: Turkey Hill Road
If you wish to appeal this action, your appeal must be filed in
Superior Court within 20 days of the date this decision was filed
in the Office of the Northampton City Clerk.

11 . Prior to the issuance of any Occupancy Permits, the
developer shall submit to the Planning Board, a certified
statement from the Project Engineer that the driveway was
constructed in accordance with the plans approved by this
Special Permit.

2 . The applicant has successfully contained soil and debris
from entering Turkey Hill Road by placing hay bales at the
bottom of the slope. Similar measures should be taken during
the construction of the common driveway.
3 . Appropriate easements should be presented to the Board
and, once approved, recorded at the Hampshire County Registry
of Deeds. Proof that this Special Permit has been recorded
must also be provided.
4 . The proposed common driveway must be blacktopped.
5 . House numbers, identifying all of the homes utilizing the
common driveway, shall be placed at its intersection with
Turkey Hill Road for identification by emergency vehicles.
6 . Easements shall be placed on the deeds to the lots
granting access to and over the subject parcels.
7 . An Easement plan, showing said easements, shall be
prepared.
8 . Restrictions shall be placed on the deeds to the subject
lots:
Prohibiting any additional vehicular access to said lots
from other then the common driveway approved by this Special
Permit,
Stating that said common driveway is a private driveway
and is not a City way. The maintenance, operation and
repair, reconstruction ( including snow plowing and snow/ice
removal) is the responsibility of the property owners.
9. All utilities to service the lots shall be placed within
the common driveway easement and appropriate utility
easements shall be placed on the deeds to the subject
properties.
10 . All work shall comply with that shown on the
aforementioned Easement Plan, as well as the three-page
"PROPOSED DRIVEWAY PLAN" prepared by E. J. Flynn Engineers,

NORTHAMPTON,ALA.01060 meeting held on April 27 , 1989 , the Planning Board
of the City of Northampton voted unanimously to GRANT the
request of Frederick R. Mailloux for a Special Permit under
the Provisions of Section 6 . 12 of the Northampton Zoning
Ordinance to amend a Special Permit granted on March 24, 1988
to create a Flag Lot, to change from a single driveway for
Flag Lot "A" to a common driveway for Lots A "B" , and "C" ,
and to grant an 18 month extension to allow him to act on
said Special Permit. Present and voting were Chair Nancy P.
Duseau, John Cahillane, E. John Gare, III , Dr. Josef Arnould,
Judith Hale, James Holeva, Marion Mendelson, Andrew Crystal
and Dr. Joseph Beauregard.
The Findings were as follows:
The use requested is allowed by Special Permit in the
district for which application is made under the Provisions
of Section 6 . 12.
The use requested bears a positive relationship to the
public convenience and welfare, in that one driveway curb-
cut is preferred to three.
The use requested will not overload any municipal
systems.
The use requested will not create undue traffic
congestion or unduly impair public safety.
The use requested will not unduly impair the integrity
or character of the district, and if constructed according
to the submitted plans, will not be detrimental to the
general purpose and intent of the Ordinance.
The Special Permit issued on March 24, 1988 is extended
to 18 months from April 27 , 1989.
THE FOLLOWING CONDITIONS SHALL APPLY:
1. In addition to the rocks and boulders to be piled in the
abandoned roadway, the latter should be seeded as soon as
possible to prevent further erosion.
