THE SCOPE OF THIS PROJECT IS THE COMPLETE RENOVATION OF THE RESIDENCE OF ADAM ZUCKER AND HEATHER ABEL (REFERRED TO HEREIN AS THE "OWNER")
LOCATED AT 47 DRYADS GREEN, NORTHAMPTON, MASSACHUSETTS.
THE GENERAL CONTRACTOR SHALL BE RESPONSIBLE FOR ALL BUILDING PERMITS FOR ALL TRADES FROM THE CITY OF NORTHAMPTON, AS MAY BE REQUIRED.
THE SCOPE IS DEFINED BY THE FOLLOWING DOCUMENTS, DATED 12-19-13 (UNLESS OTHERWISE NOTED):
A-000 TITLE & GENERAL NOTES
A-099 EXISTING FLOOR PLANS
A-001 FIRST FLOOR PLANS
A-002 SECOND FLOOR PLANS
A-003 THIRD FLOOR PLANS
A-004 FIRST FLOOR MECHANICAL/ELECTRICAL PLANS
A-005 SECOND FLOOR MECHANICAL/ELECTRICAL PLANS
A-006 THIRD FLOOR MECHANICAL/ELECTRICAL PLANS
THE GENERAL CONTRACTOR SHALL BE RESPONSIBLE FOR THOROUGHLY REVIEWING ALL CONSTRUCTION DOCUMENTS AND SHALL VISIT THE
SITE TO VERIFY ALL EXISTING CONDITIONS PRIOR TO THE START OF THE WORK. ANY DISCREPANCIES BETWEEN THE CONSTRUCTION DOCUMENTS
AND EXISTING CONDITIONS, OR BUILDING CODES AND APPLICABLE REGULATIONS, SHALL BE REPORTED TO MUNKITTRICK ASSOCIATES PRIOR TO
THE START OF THE WORK. DRAWINGS SHALL NOT BE SCALED FOR DIMENSIONS WITHOUT THE EXPRESS CONSENT OF MUNKITTRICK ASSOCIATES.
A COMPLETE SET OF CONSTRUCTION DOCUMENTS SHALL BE KEPT IN GOOD CONDITION ON THE SITE. THE GENERAL CONTRACTOR IS TO MAINTAIN
CLEAR AND CONCISE RECORDS/DRAWINGS OF ALL "AS-BUILT" CONDITIONS.
ALL LABOR AND MATERIALS SUPPLIED AND INSTALLED TO COMPLETE THE WORK, AS DEFINED BY THE CONSTRUCTION DOCUMENTS, SHALL BE
EXECUTED IN STRICT COMPLIANCE WITH ALL APPLICABLE BUILDING CODES AND REGULATIONS, AND SHALL BE IN ACCORDANCE WITH THE
HIGHEST ACCEPTABLE BUILDING PRACTICES.
ALL WORK SHALL BE IN ACCORDANCE WITH THE FOLLOWING BUILDING CODES:
STRUCTURAL CODE: MA STATE BUILDING CODE, 8TH EDITION
PLUMBING CODE: MA STATE PLUMBING CODE
MECHANICAL CODE: MA STATE MECHANICAL CODE
ELECTRICAL: MA ELECTRICAL CODE
ALL WORK SHALL BE IN ACCORDANCE WITH THE REQUIREMENTS OF THE OWNER AS TO ACCESS TO THE SITE, PHASING AND SCHEDULING OF
WORK, REFUSE DISPOSAL, ETC.
GENERAL CONTRACTOR'S RESPONSIBILITIES
A.THE CONTRACT CONSISTS OF THE PROVISION OF ALL LABOR, MATERIALS, EQUIPMENT, SUPERVISION, SERVICES, PERMITS, FEES, SPECIAL
CHARGES ETC., AS MAY BE REQUIRED TO PERFORM THE WORK AS SET FORTH BY THE CONSTRUCTION DOCUMENTS, OR AS MAY BE
REASONABLY IMPLIED BY THE CONSTRUCTION DOCUMENTS. NO EXTRA CHARGES WILL BE ACCEPTED BY THE OWNER WITHOUT
PRIOR APPROVAL. NO DEVIATIONS FROM THE DRAWINGS OR SUBSTITUTIONS WILL BE ACCEPTED WITHOUT PRIOR APPROVAL.
B.THE GENERAL CONTRACTOR SHALL SUBMIT A DETAILED PROJECT SCHEDULE TO THE OWNER, OUTLINING WEEK BY WEEK EACH OF
THE PHASES OF CONSTRUCTION BY TRADE, INCLUDING REQUIREMENTS FOR ALL OWNER-SUPPLIED ITEMS, AND REQUIREMENTS FOR FURNITURE
OR EQUIPMENT MOVES.
C.THE GENERAL CONTRACTOR SHALL BE RESPONSIBLE FOR ALL WORK REQUIRED BY LOCAL JURISDICTIONAL AUTHORITIES WHERE THESE
REQUIREMENTS MAY EXCEED THE REQUIREMENTS OF THE CONSTRUCTION DOCUMENTS.
D.THE GENERAL CONTRACTOR SHALL BE RESPONSIBLE FOR ALL TEMPORARY SERVICES, INCLUDING BUT NOT LIMITED TO: CONSTRUCTION
BARRIERS TO PROTECT FURNITURE/EQUIPMENT AND ADJACENT SPACES; TEMPORARY ACCESS DOORS DURING CONSTRUCTION,
TEMPORARY POWER AND TELEPHONE ETC.
E.THE GENERAL CONTRACTOR'S WORK SHALL BE SUBJECT TO REVIEW BY THE OWNER OR THE ARCHITECT. THE GENERAL
CONTRACTOR SHALL BE RESPONSIBLE FOR ALL WORK TO CORRECT ANY DEFICIENCIES NOT IN ACCORDANCE WITH THE CONSTRUCTION
DOCUMENTS, INTENT OF THE CONSTRUCTION DOCUMENTS, OR LOCAL JURISDICTIONAL AUTHORITIES.
F. THE GENERAL CONTRACTOR SHALL BE RESPONSIBLE FOR THE COORDINATION OF ALL SUB-CONTRACTORS AND SUPPLIERS.
G.THE GENERAL CONTRACTOR SHALL DELIVER TO THE OWNER A COMPLETED PROJECT IN GOOD CLEAN WORKING ORDER, READY FOR
OCCUPANCY AND SHALL DO WHATEVER IS NECESARY TO AVOID LABOR DISPUTES AND ANY DELAYS OF THE WORK. THE GENERAL CONTRACTOR
SHALL INSURE THAT THE CONSTRUCTION SITE IS BROOM CLEAN AT THE END OF EACH WORKING PERIOD, AND ALL SURFACES VACUUMED AND
WASHED CLEAN AT THE COMPLETION OF THE PROJECT.
H.UPON COMPLETION OF THE WORK THE GENERAL CONTRACTOR SHALL OBTAIN ALL FINAL INSPECTIONS AS MAY BE REQUIRED, AND SHALL
FURNISH THE OWNER WITH EVIDENCE OF INSPECTIONS, INCLUDING A CERTIFICATE OF OCCUPANCY IF REQUIRED.
I.UPON COMPLETION OF THE WORK THE GENERAL CONTRACTOR SHALL FURNISH THE OWNER WITH ALL INSTRUCTION MANUALS, WARRANTIES,
AND ANY OTHER RELATED DOCUMENTATION REQUIRED FOR THE OPERATION AND MAINTENANCE OF ANY ITEM OR MATERIAL SUPPLIED AND/OR
INSTALLED BY THE GENERAL CONTRACTOR OR HIS SUB-CONTRACTORS.
J.NO ADDITIONAL COST WILL BE ADDED TO THE PROJECT DUE TO THE GENERAL CONTRACTOR'S LACK OF VERIFICATION OF EXISTING CONDITIONS
OR DIMENSIONS ON THE SITE PRIOR TO COMMENCING THE WORK.
K.ACCESS TO ALL AREAS OF THE PROJECT SHALL BE COORDINATED BY THE GENERAL CONTRACTOR WITH THE OWNER. THE GENERAL
CONTRACTOR SHALL COORDINATE ALL OF HIS WORK WITH THE OWNER, INCLUDING PLACEMENT OF DUMPSTERS.
L.ALL CONSTRUCTION DEBRIS AND REFUSE SHALL BE REMOVED FROM THE SITE AT THE END OF EACH WORK DAY OR PERIOD, AND LEGALLY
DISPOSED OF OFF SITE. THE GENERAL CONTRACTOR AND HIS SUB-CONTRACTORS SHALL USE ONLY THEIR OWN CONTAINERS FOR THE REMOVAL
OF DEBRIS OR REFUSE.
M.THE GENERAL CONTRACTOR AND HIS SUB-CONTRACTORS SHALL INDEMNIFY AND HOLD HARMLESS THE OWNER AND MUNKITTRICK ASSOCIATES
FROM AND AGAINST ALL CLAIMS FROM DAMAGE TO PHYSICAL PROPERTY AND/OR PERSONS, SUFFERED AS A RESULT OF THE GENERAL
CONTRACTOR'S OR HIS SUB-CONTRACTOR'S PERFORMANCE OF THE CONTRACT, WHETHER OR NOT SUCH DAMAGE WAS CAUSED BY NEGLIGENCE,
INCLUDING, WITHOUT LIMITATION, ANY EXPENSES CONNECTED WITH SUCH CLAIMS.
