ZONING BOARD OF APPEALS
The Zoniny Board of Appeals for the City of Northampton met
on December 15 , 1982 and voted unanimously to allow Donald Stefan
of 88 Turkey Hill Road to withdraw, without prejudice , his petition ;
for a variance to convert his home into a two family dwelling .
Based upon the evidence presented to the Board , the Board
made the following findings in regard to the petition for a
variance :
1 . The Board informed the applicant, Donald Stefan ,
that before a variance could be granted , the Board
must find that all the requirements of the Zoning
Act be met, and because of the limited amount of
information provided on the application , the Board
would be unable to make an informed decision as to
whether the applicant met these requirements .
2 . The Board suggested , for the reason above , that
the applicant withdraw his request for a variance
and ask for permission at a later date to resubmit
the petition with more complete information . The
applicant agreed to the Board ' s decision.

The Board of Appeals held a public hearing on December 15 , 1982,
on the petition of Donald Stefan for a variance to convert a home
on Turkey Hill Road into a two-family dwelling. Present were Chair-
man Robert C. Buscher , Peter Sharac, and Peter Laband.
The Chairman read the public notice as it appeared in the
Daily Hampshire Gazette on December 1 and December 8; the requirements
for a variance according to the Zoning Act; the Senior Planner 's
findings; and the Plannina Board' s recommendation that the applica-
tion be denied.
He informed those present of their right of appeal .
Donald Stefan, 88 Turkey Mill Road, told the Board that he
would like to convert a single-family home into a two-family dwelling
in order to provide a home for his widowed daughter and her two chil-
dren. He said that the parcel on which the home is located contains
28 acres, but has only 520 feet of frontage on a public street.
The Chairman suggested that he divide the property into building
lots , but Mr. Stefan was reluctant to do this.
Dr. Laband pointed out that, before granting a variance, the
Board must find that all requirements of the Zoning Act can be met,
and he could not make those findings because of the limited amount
of information provided on the application. He suggested that the
applicant ask for permission to withdraw his request and resubmit
at a later date with a more complete application.
Mr. Stefan agreed to do this.
After the applicant made his request, the Board, on a motion
made and seconded, voted unanimously to allow withdrawal without
prejudice.
The hearing was adjourned at 7 :55 PM. Present, in addition to
the Board members and the applicant, was Clare Fennessey, Clerk.
