Applicability of General Laws Chapter 40A, §6 and Article 9
of the Zoning Ordinance of the City of Northampton
Dear Mr. Clark:
Enclosed is a copy of the application of Eric S. Gross for a
zoning permit on premises of Ocram, Inc. , known as the Hotel
Northampton.
It is my opinion that the uses proposed by Mr. Gross, as set
forth on the application, fall within the exemption for structures
and uses lawfully in existence prior to the enactment of the Chapter
40A of the General Laws and Section 9 of the Zoning By-Laws. Speci-
fically, the proposed alterations to the structure are not for the
purpose of providing for its use for a substantially different pur-
pose, or for the same purpose in a substantially different manner,
or to a substantially greater extent than for which the building is
presently being used.
