nes Hotel Northampton, Wiggins Tavern, Bamboo Hut
On the above date I viewed the premises known as the Hotel Northampton,
Wiggins Tavern, and the Bamboo Hut.
We have issued Certificates based on the complete use of this structure,
which expire on September 11, 1980. This building is now only partially
occupied, egresses are chained closed, and the central heat has been
shut down.
This letter ia.,,,to notify the owners, management, and others involved,
that corrections for public safety must be made immediately, especially
with wiring, egress markings, and closing of dead end corridors. Our
Certificate of"'Ottupancy will be removed from this building if all haz-
ardous conditions are not corrected.
This structure must not be allowed to deteriorate further. I would
hope that agreements will be made soon by all those involved.

2. Could apartments be built on the 5th. floor with a Special Permit?
My answer to this would be yes.
3. Could offices be built on all floors?
My answer to this would be yes.
Building Permits could be issued for all the above conditions. Occupancy Permits
could be issued if the structure conforms to Article 2, Section 213.0 Mass. Build-
ing Codes, Article 22j and all other sections of that Code,
There is now a request for a Special Permit from the Z.B.A. If the question of
the 5th. floor apartment use is approved, and the parcel remains one without sub-
division, then all zoning problems appear to be resolved as proposed.
Condominium law of ownership of these structures would not affect the zoning or
building codes. All existing uses would be allowed to remain by right. A Build-
ing Permit could be issued for all allowed uses under Article 1 of the Building
Code,
I would request verification of this opinion from the City Solicitor and the
Chairman of the Z.B.A.

Hotel Northampton, Wiggins Tavern
Dear Mr, Gross:
The following are the findings of this office in reference to the above structures:
There exists today two principal buildings on one lot known as;
1. Wiggins Tavern, three stories, Class 3B
2. The Hotel Northampton, five stories, Class 1B
Wiggins Tavern contains Assembly Use A2, and Residential Use R2 as a use accessory
to the Hotel (Employee's quarters).
The Hotel contains RI use (transient residential rooms) Business Use B, and Assembly
A2. Upon reviewing the lot and principal structures, I find the followings
The conforming lot is 73,140 sq. ft. plus of-tht us in a C.B. Zone.
Wiggins Tavern requires no setbacks, and is a conforming structure.
The Hotel, (5 stories), Section 6.29 Page 6-3 of Northampton Zoning Laws,
requires side and rear setbacks 20 ft, The north side setback is 16 ft.
However, that portion of the building is only ''tvO stories. Rear setbacks
conform. I would say that it is a conforming structure. Building or occu-
pancy permits could be issued for all allowed uses.
On reviewing the present use of these structures, and questions on future use, I
find the following;
The Hotel Building mixed residential and business use, maximum height four
(4) stories. Any other permitted use eight (8) stories, Hotel use now re-
quires a Special Permit in a C.B. Zone. The present use is now nonconforming
under Section 4.3.
1. , Could apartments be built on the 2nd., 3rd.9 and 4th. floors? Hotel rooms,
offices, or other allowed uses on the 5th. floor? Review sections 4.3 and 4.4
with no change of use on the first floor. `
My answer to this would be yes.

located et 36 Y-tng Street requested wi or before March
21$ 19300 are hereby devied subject to appeal to the
Zoning Board of Appeals.
