32A-255 (93) Pursuant to Massachusetts General Laws (MGL) , Chapter 40A, Section 11, no Special Permit, or any extension, modification or renewal thereof, shall take effect until a copy of the decision bearing the certification of the City Clerk that twenty days have elapsed after the decision has been filed, or if such an appeal has been filed that it has been dismissed or denied, is recorded in the Hampshire County registry of Deeds or Land Court, as applicable and indexed under the name of the owner of record or is recorded and noted on the owner's certificate of title. The fee for such recording or registering shall be paid by the owner or applicant. It is the owner or applicant's responsibility to pick up the certified decision from the City Clerk and record it at the Registry of Deeds. C. The Zoning Board of Appeals found that a Special Permit allowing a ground sign may be issued because: 1. There are unique features to the structure, especially affecting such structure, but not generally affecting the zoning district in which it is located, because the ground sign will replace an existing ground sign which is in poor condition. B. Said ground sign shall be located on the same lot as the structure/establishment being advertised. C. Said ground sign shall not exceed a height of ten (10) feet, nor have a surface area greater than eighty (80) square feet in the CB District. structures and open spaces to the natural landscape, existing buildings and other community assets in the area because the sign replaces an existing sign which is in poor condition. D. The requested use will not impact the City's resources. E. The requested use meets all special regulations set forth in Section 7.4 (4) (C) of the Zoning Ordinance. (see Attachment A) F. The requested use bears a positive relationship to the public convenience or welfare because it will alert the public to the entrance to the Hotel Northampton. The use will not unduly impair the integrity or character of the district or adjoining zones because it is in keeping with the Central Business character of the district. The use will not be detrimental to the health, morals, or general welfare. The use shall be in harmony with the general purpose and intent of the Ordinance. G. The requested use promotes City planning objectives to the extent possible and does not adversely affect those objectives, as defined in City master or study plans adopted under M.G.L. Chapter 41, Section 81-C and D. Conditions imposed upon the project are as follows: 1. The sign shall not be neon and shall be lit using indirect lighting (either backlit or lighted with spotlights) . 2 .
