lower two levels to the upper level , one would travel outside
approximately forty (40 ' ) feet from the new south entrance to the
Wiggins Tavern entrance and then take a new enclosed lift to the
upper level .
Also important would be the loss of eight (8) seats due to the
installation of the lift plus a loss of four (4) seats due to the
new south door brings the total seating from fifty-six (56) to
forty-four (44) and imposes an economic hardship on The Hotel .

In the case of the two new bathrooms, we were confronted with an
existing concrete foundation stair and floor which was previously
open to the exterior. (see before plans) We were unable to
design a ramp or lift in the space aNangement shown in
coniunction with two (2) accessible bathrooms without blocking
legal use of the existing stairs and landing.
We decided to ask The Board for a variance for the additional
bathroom which we would be unable to build under section 30. 1 .
We were able to design one handicapped bathroom accessible from
the Justin Morgan function room by raising the floor of the new
bathroom eight (8" ) inches, putting in a new doorway through a
brick wall and installing a lift in the function room space.
We felt the additional ~ fixtures would free use of all other
toilets and generally improve the situation for all users.

It is unfeasible to install two accessible bathrooms in the space
given the existing conditions. Therefore, the cost of compliance
in this case is irrelevant as there are no other practical
locations to be considered. The true costs of compliance are
loss of an amenity and an additional load on the existing
fixtures. We and The Hotel feel the location of the present
design is the only one feasible while best suited to the use of
the spaces.

In the case of the Coolidge Park Cafe accessibility , we were
confronted with two interior levels and a third exterior patio
level to connect. We designed an enclosure for the exterior
patio level , and a ramp to connect it to the lower of the
interior levels. We also designed a new exterior Cafe Park
terrace with an accessible entrance into the existing interior
lower level . We are requesting a variance to allow The Hotel not
to connect by ramp or lift the middle with the upper level of the
Coolidge Cafe. A ramp connecting the two levels would have to be
30 ' long and would result in loss of use of the middle level . A
lift by necessity would have to be placed in the middle of the
restaurant space, operation of which we feel , unfortunately,
places the focus of attention by all in the space upon any user
of the lift. We feel , and it may be a point of contention , that
a handicapped person may feel more inclined to use less efficient
means of access if given the choice of a more private , less
obtrusive way. In our case, all levels of the Cafe are
